Portnoy says he cant “change the data to fit the case better,” which is language the prosecution honed in on from the defense.

1:42 PM · Nov 13, 2023

State: and sometimes does it happen where the data you might initially receive does not become significant until later in the investigation? Portnoy says that can sometimes happen. Also a possibility some data can be lost.

Defense says someone can consent to their device being searched, or search warrant. Portnoy says yes to both. Portnoy says he has written search warrants before. Defense: it doesnt have to be you have probable cause that someone is implicated to go into their device? Portnoy: no

-- Defense passes witness but state has follow up questions. Redirect ---

Mid-morning thread on Day 7 of #KaitlinArmstrong trial

State asks if there are multiple scenarios were it’s not legally allowed to extract the data. Portnoy says that’s correct.

State is asking about changing the date in the extraction data. Portnoy says every single track point, and the entire extraction, was calibrated with the correct times and dates.

State asks what Portnoy is representing with the animation of the blue line, which he says it’s just a video of how the points progress.

Portnoy says he cant “change the data to fit the case better,” which is language the prosecution honed in on from the defense.

-- Defense’s turn again.

Defense says someone can consent to their device being searched, or search warrant. Portnoy says yes to both. Portnoy says he has written search warrants before. Defense: it doesnt have to be you have probable cause that someone is implicated to go into their device? Portnoy: no

Defense: Nothing you have testified to today or last week tells us Kaitlin Armstrong drove that Jeep?Portnoy says that wasn’t the focus of his data, so no.

Prosecution: have you identified any errors you made in the infotainment system?Portnoy: Not my data.

Recess for lunch. We’ll be back around 1:45.

With the time that has been taken today with the forensic analyst, and with AT LEAST CA left to testify, if no one else, I do not believe it is likely that the state will rest by end of day. I suppose they could just ask CA if she knows how her passport came to be in KA's possession, but I suspect the state will have far more to talk to her about. I am looking for a lot of "I can't recall". JMO

Other than her sister, who will never admit that she thinks KA murdered MO, even if she may, I wonder if KA has any other female friends or acquaintances who do not believe she killed Mo? We already have seen that two of her good friends actually called LE and gave them vital information pointing at her. Think the defense may offer up some character witnesses for her? I don't see where they can offer up much of any real defense, and they certainly have not done a very good job of poking holes in the state's case, JMO

Defense questioning reliability of software used to track Armstrong's jeep (jury saw animated map on Thursday) & DP's process of analyzing raw data
@fox7austin

State: “Did you manipulate any of the data in this case in order to get a specific result?"
DP: "No"
State: "How frequently is trial & error part of your process?"
DP:“A big portion of our job”

1:45 PM · Nov 13, 2023

Defense: “Nothing that you have testified to tells us that Kaitlin Armstrong was driving that jeep on May 11, 2022?”
DP: “My data was only focused on devices so no”

I don't know man. If I had a sibling who somehow acquired my passport and used it in such a nefarious way, and for whom the evidence piles up to show almost certain guilt, I don't think I would be supporting them in court.

I wouldn't either, but apparently, KA and her sister have always been very close, and have traveled extensively together. IIRC, her sister is into yoga and such as well. Not remotely suggesting that her sister would do any such deed as KA allegedly has done, but I get the sense they may be very much alike, in a lot of ways. Short of perjuring herself, I expect she will likely do and say all that she can to protect her. Also remember, their parents have been in the courtroom, supporting KA. JMO

Standfield finds an instagram story on Armstrong's phone from Jan. 12, 2022 of Kaitlin Armstrong in a long sleeve pink shirt and jeans pointing a gun in a home. Text says Gun safety w/ x user & KA's instagram account.

Prosecution has Standfield describe a photo jurors are seeing. It says “gun safety” and appears to show Armstrong holding a gun. Armstrong is tagged in the post, which looks to have been from Instagram or a similar social media platform.

I'll pick up my live tweeting today with the first witness following lunch: Brandi Standfield, DA's office, Digital Forensic Unit.We are looking at pictures that have been introduced into evidence. The first photo shows Kaitlin Armstrong with a firearm posted to IG.

The next photo is a log of names and dates of those who have signed into a gun range. The name "Allison Paige" is listed. The next photo is a closeup that shows scarring around a hairline. Next is a photo of Kaitlin with a bandage across her lips and nose.

The next photo is another picture of Kaitlin. Her hair is a lighter shade of reddish brown and there is a bandage around her nose. She is looking directly at the camera. The date is 6/24/22. More photos with various profiles of her nose and the bandages. These were taken on 6/26.

These are all selfies with her looking directly at the camera. You can see a trace of blood inside of her nostrils. The base of her nose is red and swollen. Her face glistens in the profile shot. In one picture, it appears as if her lower lip is also swollen. She has bruising around her eyes.

Well, well…so she used Allison Page to sign in at the gun range

…..or is this where she picked that name up from?

Now looking at a Forensic Examination Report. Generated Jan. 5, 2023. We are looking at messages pulled from a WhatsApp extraction. There are 54 messages in the conversation. It is in Spanish, with a translation in English. It is an inquiry into rhinoplasty surgery.

Indeed. People who genuinely buy a weapon for self-defense have no need to use an alias when they are learning/practicing how to use said weapon. Certainly makes it seem nefarious.

Wonder how the Defense will spin that -- will we hear that "Kait" is big on protecting her privacy and so used fake names?
