The actual crime in the context of the sentence will be discussed, however it is all done in a private hearing.If the appeal is just about the sentence, then the actual crime is likely not to be discussed at all, I think. Correct me if I am wrong, but didn't he plead guilty when he knew he was about to be mentally examined?
They will have details of the crime, injuries, background reports etc. Based on that they will decide if the sentence is fair, should be reduced or increased.
