Once a suspect has been charged with the offence under investigation, he should not be questioned further in relation to the offence, unless such questions are absolutely necessary in order to:
  • Prevent or minimise harm or loss to some other person or to the public.
  • Clarify an ambiguity in a previous answer or statement.
  • Provide the suspect with an opportunity to comment on information concerning the offence which has since come to light where it is in the interests of justice to do so.
(Paragraph 16.5, PACE Code C (Revised))

If a suspect is to be interviewed again he should be cautioned again. He should also be reminded that he has a right to seek legal advice.

Terrorism legislation provides for application to the Crown Court for further interview after charge.
So a purely voluntary statement of details relating to the crime would be entertained? That's how it is over here; even after someone is charged, if they request to speak to LE it is generally granted. The suspect has the right for counsel to be present, but that can be waived, too. We generally let them talk all they want to, especially if they are confessing and providing details.

I'm still not convinced this boy acted alone. I think someone/someones helped him, at the very least after the fact. Those people, if they exist, are probably a threat to the public, too, and should be behind bars.

Personally, I wouldn't draw a direct correlation between the cemetery activity and the liklihood of the accused having given further statements.

LE are continually looking to gather additional evidence. The will want to be satisfied that every key area has been thoroughly searched, particularly if any of LB's property is outstanding.

Going back to the beginning....and it may have already been discussed.....LE reported pretty much straight away that her phone was missing even before she was found. Surely they must have had intelligence relating to the use of it after she disappeared otherwise why be so specific . So without finding her you could assume her phone, house/ car keys /purse were also with her . I know her phone was reported to be “switched” off before her last sighting .MOO

It was reported her phone was switched off at home approx 15mins before she was last seen in the cctv footage, it was something like 15:48.

I think it was her daughter who confirmed she only had her keys and phone with her. I imagine they would have found her purse at home when they went to see what was wrong when she didn’t turn up.

I don’t understand why she would turn it off if she was going for a quiet stroll. Maybe it was something she automatically did when going for a walk but take it with her in case she needed help.

I would put it on silent rather than powered off if I didn’t want it ringing in the middle of the street.

Doesn't turning off the phone disable the GPS in it? Maybe she didn't want someone to see where she was going.

.....but why would they specifically say her phone is still missing even before she was located? If she had just taken her self away then naturally the phone would be with her and not really worth mentioning in the statement? Hmmm I’m just trying to read between the lines .

No idea..unless without actually being able to 100% confirm she took her phone with her they just classed it as missing also

Does anyone know if Lindsay done any home tutoring at any point?

I doubt it, she was a teaching assistant as opposed to being a teacher, they don’t need the qualifications

Thank you, I deleted my post as I thought I had confused threads, just wondered as I know a lady that visits kids that to teach voluntarily(this teacher in particular works with traveller kids at their homes)she is a teacher of younger children in mainstream schools but will teach any age group wanting to lean literacy skills when visiting.im sorry I didn't realise she was a teaching assistant and not qualified to tutor.thank you

That being said though there’s nothing to say she didn’t help anyone she knew wanting to learn to read and write

That is very true and could be a reason for turning it off.

There is also the possibility she never had the phone with her in the first place. Someone could have taken it if they didn't want someone seeing her messages before LE were involved

Would the police have reiterated that her phone was still missing in case it had been discarded in a crime ? Just to ensure the public keep an eye out for an abandoned phones ?

If her phone died just 15min before she went back out its possible she only had chance to put a very small amount of charge back in it ...so she may have kept it switched off to save power but took it with her to switch on if needed

To the best of my limited knowledge it is possible, but not in all cases.

It depends on the model of phone and whether or not the battery has been removed from the phone. Remember some phones don’t have battery access without breaking the phone up or using specialist tools to access it.

If the phone has ran out of charge and switched itself off, there should be still enough power in a “dead” battery to still transmit a GPS signal. If the battery has been removed from a dead phone, I am lead to believe this is near on impossible to track after the battery is removed, without very specialist software (developed by one of the international spook organisations)

I might of missed it on this thread, but do we know what make and model of phone Lindsay owned?
