Sara was in no condition to perform. If the video is legit, it was someone else. Her brother perhaps?

Otherwise it was Sara under extreme force, with unthinkable injuries, just prior to the final fatal ones.

I say manipulated timestamp or decoy.

Prosecutors are checking the date of the video,
which
"on the available evidence"
appears to have been taken on August 6 last year,
the jury was told.

Batool's barrister Caroline Carberry KC suggested Sara appears "co-ordinated, alert and smiling at the camera" in the footage.

Hmm. If the video is proved genuine and of that date, why did the SM take it? Are there other videos of Sara taken by the SM? As in, is this usual or unusual? If unusual, I'm suspicious of the reason.

Also, all of Sara's injuries will still have been inflicted. Timings of when the latest/fatal injuries were inflicted were based on medical evidence and were not exact. So what would this video prove?

Where is the key eyewitness - the 13yr old brother to corroborate this? Why is his statements not used? He would be able to say when Sara was alive and when she died - he was at home as it was summer holiday. He has seen and heard things.

The only one apart from the three accused who knows what was happening and can communicate the truth. I even think the twin girls who must have been close to Sara would have some input too!!!! (IMO).

This is crazy that Pakistan Govt has given partial custody to the very people who knew of Sharif, Batool and Malik's crime (in Sharif's case self confessed!) and who hid them!

IMO: Manipulated timestamp, decoy or puppeted under duress. Something is off. Whilst I believe there can be fleeting moments of joy in the unhappiest homes, being filmed happily dancing doesn't fit the "nightmare neighbours" and Sara "not smiling once" vibes described by neighbours. I don't buy that Sara was welcomed into the communal space in the home let alone express herself in dance. She'd be too terrified of knocking over keys or documents, for a start. And with 70 known injuries. What on actual earth?

It's not as straightforward as compelling a child to give evidence. This is an extract from the guidelines for children giving evidence in family court proceedings:

9. With that objective the court should carry out a balancing exercise between the following
primary considerations:
i) the possible advantages that the child being called will bring to the determination of
truth balanced against;
ii) the possible damage to the child's welfare from giving evidence i.e. the risk of
harm to the child from giving evidence;
having regard to:
a. the child's wishes and feelings; in particular their willingness to give evidence; as
an unwilling child should rarely if ever be obliged to give evidence;

b. the child's particular needs and abilities;
c. the issues that need to be determined;
d. the nature and gravity of the allegations;
e. the source of the allegations;
f. whether the case depends on the child’s allegations alone;
g. corroborative evidence;
h. the quality and reliability of the existing evidence;

i. the quality and reliability of any ABE interview;
j. whether the child has retracted allegations;
k. the nature of any challenge a party wishes to make;
l. the age of the child; generally the older the child the better;
m. the maturity, vulnerability and understanding, capacity and competence of the
child; this may be apparent from the ABE or from professionals discussions with
the child;
n. the length of time since the events in question;
o. the support or lack of support the child has;
p. the quality and importance of the child’s evidence;
q. the right to challenge evidence;
r. whether justice can be done without further questioning;
s. the risk of further delay;
t. the views of the guardian who is expected to have discussed the issue with the
child concerned if appropriate and those with parental responsibility;
u. specific risks arising from the possibility of the child giving evidence twice in
criminal or other and family proceedings taking into account that normally the
family proceedings will be heard before the criminal; and
v. the serious consequences of the allegations i.e. whether the findings impact upon
care and contact decisions.

10. The Court must always take into account the risk of harm which giving evidence may do
to children and how to minimise that harm, although that may vary from case to case but
the Court does not necessarily need expert evidence in order to assess the risk.

Testifying against a parent or caregiver, especially in criminal proceedings, is likely to cause severe and lasting trauma for a child. In this case, the child might not even be helpful to the case that the prosecution have built.

In the UK, cases are built on narratives and "truth" can sometimes complicate that narrative, making a jury less likely to convict (because doubts have been introduced). I suspect the prosecution and police (during their investigation) ruled out interviewing the boy after assessing the likehood of what the boy would say. Noting that they had already seen text messages sent to a friend and would be able to glean something about what the boy knew or didn't know or believed.

Even if the boy knew precisely what happened and who was responsible. There's no guarantee that the boy would tell tell the truth. Either way, it would become an impossible situation for him. Telling the truth and becoming responsible for the incarceration of a family member, or lying and living with the guilt of lying for the rest of his life.

I'm also suspicious about the step-mother conveniently having more "evidence" available. Although I believe it's likely to be genuine, why was she making and keeping such records? Photos of Sara's injuries (imagine making a child pose for bruise photos after she's had the "crap beaten out of her") and now this conveniently timed footage.

The reason it's been introduced is simply to cast doubt on the prosecution's case so far.

Urfan gave away possible timings in his phonecall to police. He said Sara had been naughty over 3 or 4 days. I believe she was critically injured 3 or 4 days before she died. This would still be consistent with the video footage having been taken taken 4 days earlier.

Yes. I agree. Running interference. Should have been struck from the record before it was presented if they weren’t able to verify its timing.
Let’s see what they come up with in retrospect.

"The video played at the Old Bailey, taken on August 6 2023, showed Sara dancing in the living room while watching TV.

In the footage she appeared happy and energetic as she copied an alien dancing on the television.

Batool’s barrister Caroline Carberry, KC,
said her client did not dispute that Sara was subjected to extensive physical abuse over a period of time.

Ms Carberry suggested this meant
Sara was not left to succumb to her injuries
‘over some days’
as Dr Cary had suggested may be a possibility.

Dr Cary said
if the date of the video was correct
there was likely to have been
another serious injury sustained between the video and Sara’s death."

(It might correlate with unusual piercing scream the neighbour heard 2 days before Sara's death.
It lasted a few seconds and stopped suddenly.

1. There were thousands of Whatsapp messages to her sisters!
According to Police.

2. Sara was dancing with her aiblings.
I bet there were also hundreds of films of kids' antics.

B's obsession with her phone documented her life.

Also,
this video is testament to Sara's zest for life.

Despite her injuries,
the little girl tried to grasp little pleasures of life.
She loved dancing, as her Mother said.

Women and their phones! :rolleyes:

Well, quite. On the face of it the video flies in the face of what we know about Sara's injuries from the pathology, but would a KC really risk professional embarrassment by putting into evidence a dodgy video that ultimately turns out not to be what it purports?

The defence must be confident that it's bullet proof to be using it as evidence.

Is this the defence setting the scene for the 'incident' that the SM referred to in the video they made in Pakistan?

I think 2 last days were crucial.
U allegedly flew into his customary rage,
"lost it" in his own words,
and that meant the end of poor child's life.

Culmination of abuse.

But for defendants -
a last "incident",
another one in thousands of others :(

By the way,
watching the photos and videos of defendants
I see clearly guilt on U's face.

During arrest
only he bowed his head hearing
"Murder of Sara Sharif".

It is hurting my eyes looking at him.

If the date on this video is accurate, all it shows is that the terrible injuries which *killed* Sara had not yet been inflicted. People who have experienced violent relationships and homes will know it often comes in waves- there are periods of terrible aggression and 'honeymoon' periods where the abuser refrains from beating the hell out of you and requires you to go along with the pretense that they are wonderful and your life with them is lovely. Children can be astonishingly resilient. It may well be that this video was taken on a day when Sara had recovered enough from the last torture to be physically capable of dancing and playing (a child used to suffering what Sara appears to have suffered over *years* will have become so used to pain and injury that a healing injury which might leave you and I distracted by pain and unable to function will just be their normal), at the end of one of those honeymoon periods. Adult victims are often desperate to believe the honeymoon periods are real and will last this time, how much more desperate might a little girl be? My guess would be, this was taken at a time when she had had a period of respite from terrible physical abuse and was being allowed and was able to dance, play, engage in family life... and within hours of it being made that period was over and the terrible torture which led to her death began again.

Poor, poor little girl.
