The next status conference is scheduled for Sept. 9.
The defense team has encountered additional challenges in gathering background information about the suspect.

Gestaut noted that "there is very limited school and medical records" and that "it has been difficult in some respects to obtain information from certain family.


The irony in the second paragraph, jumps out at me. He killed two of the people who knew him best.

You know these WA cases so well @Seattle1. Do you think they will try him as an adult @ 15?

It was so violent, him checking to see if they were all dead (by pulses or by their breathing) and the fact he tried to set up the younger brother as the shooter tells me he was well aware of the nature of his actions.

It's a miracle the younger sister survived thankfully, but I cannot imagine how hard and traumatic it is and will be for her to process this. :(

I believe the youth offender here will be tried as an adult. However, WA State long ago adopted the Supreme Court Miller decision prohibiting youthful offenders from serving LWOP sentences, and WA Judges have much discretion at sentencing.

For example, I recall in 2023, Gabriel Davies and Justin Yoon, both 17, robbed and murdered Davis' mother's former fiance in Orting, WA. They took plea deals for 2nd-degree murder, and sentenced to 150 months (only 12 years plus 33 months probation).

Ben Eastman, 16, of Randle, WA, was brutally murdered by Benito Marquez, 17, his best friend since age 5, and his 21-yr old brother. Ultimately, about 5 others including their mother were also charged in Ben's death.

Benito was charged as an adult, and he pled guilty to first-degree murder, first-degree rape, tampering with evidence, and unlawful disposal of remains. The prosecutor's office recommended a sentence of 413 months. Both cases are on WS and the sentences don't include the early-time release credits for good behavior, etc.

Thank you @Seattle1. Wow, he could be looking at 10-12 year sentence IF found guilty. I wonder if the number and violent nature of the crimes would result in a longer sentence?

The victims' lives mattered and each life worthy of 10-12 years! IMO, if convicted, he'll probably be eligible for parole after 25 years, for 5 lives. :(

The cases you cited were single murders. In this case five people were brutally gunned down.

There is no way this kid would be sentenced to 10-12 years, there would be no basis for a sentence that light. Even if his parents were monsters, he killed/attempted to kill four of his siblings. Twenty five years is a light sentence.

How long do you estimate this case will take to reach a sentencing phase?
 
IMO 10 -12 years wouldn't be long enough. Not for justice, not for the surviving sister to feel safe with him out there, and not for rehabilitation, if someone like him even could be.
Totally agree.
Wondering if the surviving sister will be key in the trial or a plea deal. I have mixed feelings on that. The only reason she is alive, as we all know, is that she acted as if she were dying and then was able to run out of the house and go to a neighbor.
I feel sure that the surviving son could certainly cause trouble -- or worse -- for her.
