Was/is Shawn abusive toward Billie?

I'm calling her bluff. If she said the PO was in reference to what happened last night, it's not (IMHO) possible for a ruling to be made within 24 hours -- let alone filing and completing the paperwork.

Sorry but this isn't true. My ex called and threatening harm towards me. I left at 4:40pm arrived at the courthouse at 4:50 and walked out at 5pm with a PO. It's temporary. Now she will have to go to court within 2 weeks and they will have a hearing to decide if it will become permanent for a year or not. In court there will be 3 options. #1 SA will say he didn't do anything to her BUT she can still have her PO. #2 SA will say he didn't do anything to her and he doesn't think she should have the PO. OR #3 He will say he did threaten her and she will get the PO.


ETA: Not sure if all states are the same, but the most I know of don't charge for a Protection Order (aka Order from protection, and Order of protection.)

I just woke up from a nice long nap because I stayed up late reading last night's "drama" and now I find this thread

So if my question has been asked, my apologies ...

So why didn't Billie get a "protective order" last year in February 2010 when Shawn was "threatening" her and "whoever" then ?

I think that the 'couple' is starting to crumble and turn on each other.

At least I think bd is turning on sa. I think after the LE came in and found sa, she took the opportunity to tell LE that he made her say he wasn't there. She may have told them then she was afraid of him and then when she did go into custody she told them she wanted a PO against him. She could of seized the opportunity to get the heat off of her by telling the LE sa was threatening her. Just a thought. But, I definitely think they are turning on each other. As MK said she is street smart and I think she knows how to lie and cover her butt. jmo
 
I'm still catching up so someone probably already mentioned this. Won't Billie be arrested as well if SHE violates this protective order? This should get veeery interesting.

Here's what I can tell you about Protective/No Contact Orders:

I have a no contact order protecting me from an abusive ex. It clearly states, "You can be arrested even if the person or persons obtained the order invite or allow you to violate the order's prohibitions."

So, Billie could contact him - she won't get in trouble.

And YES, she has a copy of the order if one exists. I would bet anything it's a temporary order. A court date will be determined where both parties appear and the judge will deny or grant the permanent order.

It is easy to obtain a protective order and you don't need an attorney to get one. It's not a fun process, especially if you have to have a person prosecuted for violating the order and testify against them in court, like I did.

She doesnt know HOW to tell the truth. Its that simple to be honest.

In all seriousness - doesn't SA have to be served with the PO before it is legal?

Nope - when I got mine, as soon as the judge signed it, it was legal. Ex called me the next day (Saturday - he didn't get served until following Tues.) and I called the Police. He was arrested a few hours later for violating it. That was when he was made aware it even existed.

Yes, in my state, it is free if it is a domestic violence protection order. Otherwise there is a charge.
 
I can't help but wonder why BD would get the PO now, especially after SA is said to have been at her home with no transportation, and was having to call his Mom to pick him up. Unless he threatened to kill her just before the police arrived to serve the warrant, you'd think she'd demand to still have contact just in case she could find Haylie. Maybe the news of even more child abuse 🤬🤬🤬🤬 being found has something to do with her awakening, but why did it take that to get her attention. She does have a missing kid and has ignored the obvious until now. It's a good way to try and prove that she was afraid to NOT lie to the police about his being there IMO.
 
I don't believe for one minute that BD is afraid of SA.

I believe she filed for this PO as a ruse - she got caught flat out lying to LE, and is now facing charges.

IMO, I think she's trying to garner sympathy, and she hopes to spin a tale of woe that she lied to LE because she was afraid of SA.

She's just covering her own hiney. MOO

If BD is found with SA (assuming there really is some type of protective order) - what is the penalty for HER???
honestly, I don't think she'd get in trouble. It might void the order, but I'm not even sure about that. Actually, I think she could lure him under some pretense & then call the cops & he would still get in trouble. Once he's served, he's to stay away. period. I know someone who was served with a similar order & she had to be very careful to not fall for the guy's or his families' tricks. MOO.

My brain is telling me that "if" one throws the other under the bus, it will be SA to throw her. I believe something went down at BD's home with HD and BD is responsible and I'm not longer thinking it was accidental. I for the life of me, have searched my brain and heart, and from day one pretty much, I believe that's what transpired. SA was just there to help cover up and do the disposal after he had his fun :( If SA was the instigator, I would think she would have caved by now. I'm thinking they are both going to hold out til the bitter end though until this case had definate evidence or one slips up. JMO

I have believed from day 1 that BD is the person responsible for Hailey and SA did the cover-up ... of course, I could be wrong ...

If she felt that Shawn had done something to Hailey, then Billie should have gotten the Protective Order right after he failed the poly or when he was named a "poi" ...

If BD has contact with SA, she won't be in trouble. The order is against him, the Respondent.

Even if she invites contact, once the order is in effect, he has to stay away, unless & until the order if lifted.

No, it doesn't make sense.

I think BD is just back pedaling, trying to get herself out of the jam she got herself into when she lied to LE & tried to hide SA when they came to serve the search warrant on him.
