I think it might be a true private matter, a family emergency. He has young kids, a faltering marriage too I believe. Maybe he just needed to handle something privately.

I don't think he's allowed to quit or for Casey to fire him at this point unless something aggregious or health/life-threatening occurred. Even if he was off the case, though, Cheney is still there, so proceedings would continue, and we would have seen the Judge making some sort of ruling on it or mention of it.

Cheney volunteered for this case to "help" JB, so it isn't likely that he would volunteer to take over when he can go out and earn real money without the stress.

Maybe Casey is going to accuse him of some sort of misconduct and that's the source of the recent rift between them.

If there is a plea deal, I think they would still go ahead and seat a jury for the penalty phase of the trial.

In December 2005, my nephew was murdered by his stepson in Texas. The stepson confessed. The trial went directly to the penalty phase as the guilt had already been determined. A jury was seated and the penalty phase began. After about a week of testimony, and just before the case was to go to the jury, a plea deal was reached.


ot. I'm sorry you and your family lost your stepson, I hope peace, now surounds you. It's interesting at what point the DTs throw in pleas. So if they agree on a plea deal, they would still seat a jury?...

I can't see this being a plea deal at all. The State would have to offer that and no way in the world are they going to give her another chance of a deal now.
Deals previously offered are all off the table now, for them to re-offer would be infuriating to Floridians after all the exense to get here. Plus their positions are elected ... unless they are planning retirement soon they wouldn't dare offer her anything at this stage - pure incompetence. MOO

IF the DT went to the SA and asked for a deal of guilty to murder, and life the SA might take it. Or maybe it would take LWOP.

Under normal circumstances I would say they wouldn't accept. But with all the talk about Fl budgets, the cost of the trial and all the things going wrong in the case I think it is possible.

Though I don't know why JB would have to leave court if there was a plea.

Mr. Baez has a pre-trial hearing tomorrow @ 1:30 p.m. in Orlando at the Orange County court house. I am expecting HHJBP to go through the roof on this one.

That is a pretrial for a misdemeanor ... an intern could handle that lol He has another one next week for a felony too.

A plea deal can be complicated with lots of stipulations. I think the judge is just giving them time to work it out.

I doubt very seriously that there is any sort of plea deal in the works. Guess we'll find out tomorrow.

I just watched the newscast of Cheney Mason and other attorneys leaving the court surounded by reporters asking quetions. He refused comment and his demeanor was quite serious.

Its a plea. Judge would not close down court and waste a day. She is going to plea tomorrow.


I'm sorry, but I don't think anything would make ICA plea. She still thinks she's getting off. they are probably starting over with the jury selection or complaining about JP's way of getting a jury. I bet JB is filing a motion as we speak...

Let's suppose it IS a personal matter,such as a bad test result ,or something along the lines Bern suggested.How would that impact the case?
What happens if JB has a personal medical problem ? Is everything postponed? PJ's dismissed?
Could they continue without him?

Nope, I saw no sign of any distress either. I think that this probably is indeed some private matter. If HHJP appeared to give a couple of pointed glances, it could well be because yet another wrench has been tossed into the Perry Plan.
Guess we'll find out whether it had anything to do with court proceedings in the morning. Don't these people realize how inconvenient this is? Don't they know who we ARE? :maddening:

I am a reporter ... we are ruthless - anyone would look serious LOL

It was mentioned earlier that Baez was contacting the media to stop speculation. That happens alot when you work closely with someone long enough, I would often be told not to bother turning up to court for one reason or another. We can work together when we want lol

I also often got a heads up on police deals to "get the word out" (and get the story straight ... no one is better to get the word out than a reporter - that said, we can only report the information given.

You may be right,but ICA has heard PJ,after PJ say they thought she was guilty,and all the evidence they are basing that on is coming in!

Could JB be appealing the denied motion about the jury selection that he brought up this morning with the Supreme Court, sort of like the media did with the confidentiality agreement? That too happened very quickly.

if they had a plea deal, they would not need a jury.

OK just thought I would add my comments that I made on the lawyers thread as to why I am sceptical this is due to an interlocutory appeal

The defense is not allowed to do an interlocutory appeal, only the State.
