You don't have to have a lawyer on retainer for privilege to apply. I can go to 5 free consults with 5 different lawyers, retain none of them and what I say is still privileged.
Also, if I commit a crime today and am arrested and retain a lawyer on Monday, how is she supposed to represent me if I can't even discuss the crime with her since it happened prior to Monday? It's the communication that is privileged, at the time it is conveyed, irrespective of the time the events occurred.

Grieving means great sorrow. This does not exclusively mean death. Everyone in both families are suffering. What more does the public want? Almost anyone who has a son or daughter loves that child no matter what. If you don't get that, I cannot convince you. Everyone wanted to crucify BL. He did it to himself. Time for letting the families heal and letting LE do what they have to do. I think going for the throat or going for blood says more about the public and what they want over what BL did.Bringing forward @BCSleuth 's post from the previous closed thread.

Yeah, he (air quotes with my fingers) "misspoke" all right. More like a slip of the tongue if you ask me. He only said he "misspoke" because that was important information he was NOT supposed to say. I would think lawyers would be more careful about what they say, especially in recorded interviews with the media. He should have stuck with text only IMHO. He could easily correct that before posting for all to see. Hard to take back words said in a video. We all heard and saw ya say it!!!

This tactic seems to have worked before. The first claim was BL left for his hike on the 14th and the Ls picked up the mustang from the reserve on the 16th, only after the ticket was dated the 14th and BE showed video of the car on the 15th night, did those original dates change to the 13th and 15th respectively…..MOOOOO
Cady you just made me think of something. Last night on Banfield after railing at the whole world, he softened completely when talking about LE—“I don’t blame them, & you shouldn’t blame them.” That took me off guard—his change of tone, for one thing, & also that he harbours no hard feelings at all? He’s not mad for example that FBI didn’t convey to NPPD that he told them BL was missing? Or that they dispute so many of his public statements? I didn’t know what to make of it but now based on what you say I wonder if in his junket he’s trying to ingratiate himself to LE if he feels he or the family face any exposure? JMO
I hear you, but Banfield was curious as to his representation of all 3 of them as clients..there is a marital exception to having your spouse in the room, but not your son. He can have conversations with R&C but not RC&B in the same conversation to be privileged. He would have to talk to B separately as his client. I have looked at a lot of maps, read through all the official documents including the search warrant, arrest warrant, FBI posters, and statements. I have watched all the interviews and was present online during pivotal moments. I have heard the discrepancies, heard the clarifications, and considered the "experts'," news anchors', and WS members' views.
Taking all the information I have gathered into context, IMO, the overall big picture is not complicated nor convoluted. There are holes in public knowledge, obviously, which is to be expected, but I do not feel it is necessary to have to force pieces to fit. I also do not think every word out of SB's mouth is a lie. I think he makes mistakes, corrects them, and would not put himself on the line by lying in regards to things the FBI could turn around and refute him on. Taken at face value, the compilation of facts seem to speak for themselves. JMO.
But I feel nearly alone in this assessment.
Re a refutation of parental knowledge: As BL's actions have been absolutely self-serving through the entire timeline I would be shocked if anything like that was expressed in his notebooks. If anything is written in there pertaining to this tragedy I would expect a story that paints him as innocent victim who either was abandoned, couldn't locate her, or stumbled upon her body and panicked. I'm not holding my breath that the unvarnished truth is in there.
Yes. Absolutely. A big one. But, I don't think he's that reckless. MOOIt is a crime if he told the FBI one thing and is now saying another.

bbmyes it is pretty straightforward.
I have felt this since the beginning. If only one or two decisions had been made differently, we might have had a case of manslaughter, and all of this hatred, vitrol and speculation would not have been fueled by social media.
All six parents deserve our respect of privacy.
Brian screwed up big time and should have paid the price, but he was not an evil person.

Well I think the father found him alive, and maybe by the time BL had spent a few hours alone in the wilderness he was easier to talk down.

What I don't understand is why he keeps doing these interviews. He has no obligation to do so. I posted before, all he had to do since BL's remains were found was to say that his clients are devastated at their son's death and no further statements will be forthcoming from the family at this time and please respect their privacy.
Yet he doesn't. Even worse, he goes out and muddies the waters further and makes his clients look worse in the public eye.
Why? I can't think of any reason. It just doesn't make sense.

I disagree with this (respectfully). It's not the end of the story IMO. There is still an active open investigation. Additionally, if there were other persons who violated any laws in this matter, they must be held to account. No American should want it any other way. We want to live in a society where the rule of law is followed. Whether it is the case or not that anyone was involved in any wrongdoing still remains to be seen. We do not know. But, it must be determined, MOO.
And possibly, the killer's parents and their lawyer. jmo
Not for himself. For his clients, RL and ChL, if BL made statements in the notebook that incriminate them in some way and become public.Why would you say that? Guilty people hire attorneys all the time. SB has nothing to worry about and has not committed any crime. In fact, cases where an attorney represents someone who is guilty is not the exception, but rather the rule. SB has already stated that he does not know if BL killed Gabby. Whatever story BL told him is client-attorney privilege and SB doesn't have to reveal that to anyone. Worst case scenario, the notebook contains a confession which will explain what happened and why. SB has nothing to fear from that. There is no murder indictment for BL much less a plea that SB had to file with the court. With luck Gabby's remains had physical evidence that will prove who killed her. Then the case is over.
