I have oddly conflicting feelings about Ms. Sims--

Even though she's a defense attorney, and even though she's on KC's side, there's something about her appearance that makes her seem likeable and genuine to me. Her soft voice is almost soothing, and yet when she speaks for more than a minute, that same soft monotone becomes as excruciatingly noxious as the sound of fingernails scraping a chalkboard.

Honestly, while listening to her depose or cross a witness is like a dental drilling, I must admit DCS really does impress me as a lawyer. I get the impression that she is a superb and meticulous lawyer in her area of specialty. Which is medical malpractice. If I had reason to be involved in a civil dispute regarding a medical matter I would hire her in a heartbeat. She knows what she is doing. She is more than a bit out of her element in a capital murder case and it shows. But that is fine. Unlike other attorneys (JB) who are grossly inexperienced in such areas, she has taken the back seat and is not attempting to drive the defendants case over a cliff. Other than her choice in clients (which you really honestly can't hold against a lawyer, they serve the law and the rights of all, including the most repugnant among us) I don't see anything in her performance to leave a bad opinion of her. KC probably would have been far better served to have her do more of the cross examinations of prosecution witnesses, and certainly would have been better served having her or AF present her main case.

The hair expert is quoted as saying that she is not 100% sure that the death banded hear is from a dead person.
I thought I heard all of her testimony. Did she say that?

I think she said that the science is such that the best they can say is that it is consistent with a dead body - and that she feels that the science may never be such that they can say 100%. I think she also said that the science is such at this point that the death band is not consistent with anything else but decomposition. It's semantics I think.

Maybe someone else can confirm, but that was how I was hearing it, FWIW.

I see there are still a lot of witnesses listed that have not appeared. Some that we know will not. How on earth does the State think they will wrap up by the 17th? Or were they just being facetious?

Not sure how many of the 350plus State witnesses will be called in the case in chief? Maybe some are reserved for the State's rebuttal case, after the Defense puts on whatever case they will put on?

Judge - OK folks on Friday inquire of State of FL as to where they think they are and approx time when they think wrapping case up so defense have idea when need to start
LDB - tell you numerically about half way - expert testimony might not make it to half way time mark - half way on witnesses
Judge - half way another week or two weeks
LDB perhaps by end of week, we could be up to possibly witness # 49 out of how many we called, called 20 plus now , get another 20, marking evidence bogs down, have a list for clerk in anticipated order

The hair on the duct tape was not ripped from the scalp, as I understand it. The scalp, being flesh, decomposed, leaving a hair mat, with duct tape still attached after all those months.
I think we have not heard the last from our hair witness today. It seemed that JA was objecting to something she examined that was"not yet in evidence" during
JB's cross-examination. I noticed that she completed a report in July or June of 09. Jb asked her to only answer ?s concerning the evidence from the car. The body was found in dec 09 so I would assume they sent her some hair to compare????
 
i am a little worried right now - the SA isn't selling this well enough for me...I get lost in the details and carefully chosen words. I hope they come back with some laymen's explanations.

Death band = dead person's hair in trunk.
No death band on tape on duct tape = live person wearing duct tape.

PLEASEEEEEE spell it out better SA !!

I was thinking also, it can get confusing
 
Does anyone know what the dog hits were about in the backyard of the house? I never read any discovery regarding this. Did findings say that the dogs sniffed what they believed was a dead Caylee somewhere in the yard?
 
As a health inspector I can say that we distinguish between "garbage" and "refuse". Garbage specifically has "animal or vegetable offal (ie organic matter)" in it. Refuse is simply solid waste, junk. So maybe DT prefers the word garbage because it implies there is something besides boxes and containers in there?

I noted that JB consistently refers to the bag in the trunk of the car as the bag of "garbage" as opposed to trash. The word "garbage" leaves an impression of organic material such as vegetation, meat, or dairy products..........something that would rot or spoil and leave an odor.

On the other hand.......the word "trash" is simply discarded items and can consist of napkins, paper towels, empty containers, etc. Trash wouldn't have the same element of odor that garbage has.

I believe no fingerprints were detected because rain would have erased the traces of the fingerprints on the duct tape found in the forest.
 
The first two weeks of the trial has now ended.

I think the state has made it absolutely clear that KC lies. I think the jailhouse tapes helped the states case, in proving KC lies. I think the media loves talking about the jailhouse tapes, not because they are a powerful piece of evidence in this case, but because they make great soundbites.

The odor in the trunk was mentioned several times during the past two weeks, and I am certain it will be mentioned many more times in future weeks. GB, MV, and KL are all very credible witnesses. I think they all did very well in presenting the evidence. They all have extensive experience in their fields.

As for the odor in the trunk being caused from human decomp vs. trash (garbage), what has been presented in evidence thus far, has not proven to me beyond a reasonable doubt that it was definately from human decomp. Further evidence may change that opinion.

As for the single hair with apparent decomp, for me, even after KL's very credible presentation, I still maintain reasonable doubt. One reason being, there is only one hair, and another reason being this type of evidence has never been tried in a court before.

As for the acquisation of the air samples, I am certain MV did everything he could to do this properly. I think JB mentioned some very interesting things about this, as far as the dates when the samples were taken.

As for GB and his search for trace evidence in the trunk, I have no problems with this, and I believe he did try his best. I do not think he did anything wrong in destroying his notes after he completed his reports, since this was done in accordance with protocol for his area. It does make one wonder, however, if there was something in his notes that he had missed while filling out his report, and perhaps the protocol should be changed.

I think the state has been doing a good job laying out there case, and I think JB has been trying his best to raise reasonable doubt where he can, and we all need to keep in mind (JB needs to keep this in mind as well), that he can only cross on what the state has presented on direct.

I am looking forward to the state presenting the evidence that proves premeditated murder.

I read somewhere that when the trial is over, the sidebar transcripts will become available under FLA's Sunshine Law. Can you or anyone else confirm that?

Sorry if already answered, I'm a little behind on the thread. Anyway, HHJP said they would be available. Don't remember which day, though. I do remember JB getting a sick look on his face, lol.
 
Dr.G.said the tape was placed before decomp started.
She did not say Caylee was alive. I do believe she was
still alive IMO..I believe this to be the manner of death.IMO..

Oh boy,,,,I missed it all today because I could not find it on TV anywhere!

Could be a good thing tohough because it did force me to get some things done including poison ivy on both arms.

I am going to start re-reading to see all I missed.
