Simon Giannini, a well known Toronto realtor, was shot and killed in a crowded Toronto restaurant 5 months ago while having dinner. TPS has the killing on video, as well as the killer on video, and the escape vehicle on video. They have many firsthand witnesses, as well as forensic evidence. The killer even spoke to several people in the restaurant, and his face was in plain view, although he was wearing a hoodie. But to this day the TPS have made no arrests. In light of all the evidence in that case and no arrest having been made, I certainly wonder if the Toronto Police might never solve the Sherman case. Imo.

That is disheartening. If it's those Iranians mentioned a few posts back that BS lended mortgage money to, they will probably never be found and brought to trial, IF they are the culprits. MOO
 
Kowa Pharmaceuticals America, Inc. Announces Agreement with Apotex to Resolve All Outstanding Litigation related to Livalo®(pitavastatin)

Plaintiffs had brought suit against Apotex for patent infringement based on the filing of Apotex’s ANDA seeking Food and Drug Administration (FDA) approval to market 1 mg, 2 mg, and 4 mg pitavastatin calcium tablets, generic to Livalo®.
Court upheld the validity and infringement of U.S. Patents Nos. 5,856,336 and 8,557,993. The Apotex settlement leaves Amneal as the sole remaining appealing defendant.
“We are very pleased with the District Court’s rulings upholding the infringement and validity of the patents for Livalo®, and with the recent resolution of the Apotex litigation,” said Ben Stakely, Chairman, CEO and President of Kowa Pharmaceuticals America, Inc.

Federal Court of Appeal rejects ‘novel argument’ for remedy in patent infringement

“The court went through the history of the equitable [remedies] that are granted under the Patent Act and concluded that Apotex’s interpretation was wrong. And that the trial judge was correct in the outcome,” said Wilson.

“It’s a handy reference. I see this case being used in the future as the citation people use when they talk about equitable remedy,” she added.


“I think credit is due to their lawyers and Apotex for running this novel argument, but it’s not all that surprising that it failed,” said Michal Niemkiewicz, of anticIPate Law, adding that the Federal Court of Appeal did a good job of putting the phrasing of subsection 57 in historical context.

“This affirms the law as we all knew it. That a winning plaintiff in a patent action is entitled to damages as of right under the Patent Act. And if it so chooses may elect to ask for an accounting of profits. This is subject to the court’s discretion to refuse, but in practice it’s expected that generally speaking you either get damages or you can elect profits subject to the court’s discretion,” he explained.

Niemkiewicz said reading the court’s analysis was informative and the decision was very clear on why Apotex’s argument failed.

Barry Sherman allegedly duped by convicted fraudster (January 2018)
It was in the final week of his life that Sherman stepped up his legal efforts to recover the $150,000 he said he had lost, a relatively small amount for a man reportedly worth nearly $5 billion. Still, on Dec. 13 his lawyers filed an aggressive motion to the court — with the goal of moving the case more promptly to trial.

Emails filed in court show Sherman was introduced to the investment opportunity through his longtime friend Myron Gottlieb.

Those emails show correspondence between Sherman's holding company, Sherfam Inc., Gottlieb and Shaun Rootenberg.

Rootenberg is believed to be in the Toronto area, though he has spent time in Thornhill, and has been known to hang out in the Avenue Road area, typically between Eglinton and Lawrence Avenues, Devereux said. He has also spent time in Vancouver and Montreal during the past year.

Fraudster surfaces in Sherman case

Somehow, by 2014, he had talked his way into a Chief Financial Officer position with Algoma Pubic Health in Sault Ste. Marie. There, he kept an eye on the public health agency’s $23 million annual expenditures and $25 million in capital assets.

The long con appeared to developing the waterfront in the Sault, but it all ended after city officials were informed of Rootenberg’s past.

The Sherman lawsuit appears to be the latest chapter in the local grifter’s story.

Gottlieb was convicted of fraud in 2009 together with Livent co-founder Garth Drabinsky. Their musical production company called Livent Inc was involved in shady dealings.

Rootenberg was recently released on bail after spending time at the Toronto South Detention Center. He maintains that he is not involved in Sherman losing money on a bad investment. He has a record for fraud and met Gottlieb while serving time in prison for his fraud conviction.

Court dismisses Apotex suit against lobbying watchdog over political fundraiser

The Federal Court has dismissed a lawsuit launched by generic drug manufacturer Apotex against the federal lobbying commissioner over an investigation her office opened into a political fundraiser held during the last election for Liberal candidates.
A court order issued this week by case management judge Kevin Aalto states that Apotex’s application for judicial review has been “dismissed without costs as moot” following submissions from both parties about recent events.
The suit closes weeks after the new lobbying commissioner, Nancy Bélanger, ended her office’s investigation into the fundraiser given Sherman’s sudden and unexpected death late last year.

The company’s legal action started in May 2017 when Apotex filed an application for judicial review in a bid to block Shepherd from investigating the event, which was held in Sherman’s home, through compelling testimony from company top brass.

Shepherd’s office had issued subpoenas to Apotex’s ex-director of government relations Elie Betito, who was at the 2015 fundraiser, and former president and CEO Jeremy Desai — who left the company in January after Sherman’s death.

It was the first time the Office of the Lobbying Commissioner was challenged in court since the position was created nearly a decade ago.

I don't think police are interested in just arresting the shooter, I think they're looking for who hired him, and in those cases surveillance is key to gathering evidence. Once you arrest the guy, there's no hope of gathering more evidence by watching who he contacts.

It was almost two years before an arrest was made in Florida for the hit on Dan Markel, and even tho police know who paid for it, they still don't have enough evidence to arrest him (the brother-in-law).

I think in many cases LE knows who committed the crime but may not have enough evidence to take to trial. If you don't have the evidence, then you can't hold them. Sometimes that takes a year or two of surveillance.

Haven't posted much in this thread but my personal feeling is that once the myriad of suspects, motives, and legal issues are all sorted through, Occam's Razor will apply and it will end up being much simpler than expected. My money is on KW. As to why there hasn't been an arrest, well, this is a super high profile case and every possibility, no matter how far fetched, must be eliminated first. The TPD is under a microscope here, no doubt about it, and I'm sure they want to dot every i and cross every t!

Brian Greenspan, a Toronto lawyer who has been speaking on behalf of the Sherman family, said Monday’s activities signify “transition” after the Shermans’ deaths.

“The police engaged the house for the completion of their investigation, then we completed our analysis and our investigation of the scene and have done a number of things. That’s now over and the transition continues towards putting the house back in order and making a determination — that has not yet been made — of what to do with the house,” Greenspan said.

“The executors of the estate are now going through the normal course of what needs to be done.”

He declined to comment on the status of the parallel probe the family has undertaken through private investigators retained through Greenspan to assist police in the high-profile and perplexing double murder probe.
