@PommyMommy found the exhibit for me earlier (see prior thread) -- Believe it or not, PF wasn't dumb enough to name KK.

CO - Kelsey Berreth, 29, Woodland Park, Teller County, 22 Nov 2018 - #56 *ARREST*

The note that PF wrote was dated Dec 12. Is that note separate from additional unfiled custody paperwork?

“Custody paperwork for Berreth and Frazee's daughter found at Frazee’s property around Dec. 13. The paperwork was dated from August. There was never a custody case filed.”

I know many doubted that story, but for me it somehow rang true. Why? because it was such a cowardly thing to do, to blind fold poor Kelsey and "play a game." But that's PF, a monster of a coward that solicits a woman to do his killing and when that doesn't work summons her to clean his mess.

I'm betting he bought candles at Walgreens.
Makes sense to me... The path of least resistance so to speak.
It's so incredible that PF is acting like he loves her and planning to take her out to eat, but actually he plans to kill her. It's just incredible...

Walgreens Number 9561 is conveniently located Woodland Park, directly across Highway 24 from Safeway and Starbucks, and next door to Ent FCU. I may be a little harsh here, but in ten months, I would have expected they would have found it. Evidence is evidence, and late is late IMO

BBM:

I agree with you on that.

I'm staunchly pro-prosecution here, and I love DA May, but I don't think it was necessarily a good look for the prosecution to be throwing their hands up in the air saying, "We don't know what happened, Your Honor, Walgreens said they would be here..."

If the judge says that he wants paperwork submitted in court by a certain date, then it's incumbent upon the lawyers to ensure they get it to that courthouse somehow.

Having said that, it sounds as if the DA had found whatever this evidence is in advance of the hearing and that they made what they thought were confirmed arrangements to have it brought to the courthouse.

Walgreens dropped the ball, apparently.

However that communication breakdown happened, no-shows on court dates aren't good.

JMO.

Yes, the whole thing was just so incredibly cruel. I'm not sure we even fully understand what was to take place that day. Why was Kelsey preparing a sweet potato casserole and asking him if he wanted pecans? Were the plans to go out as CB stated? Obviously PF was expected to eat TG dinner with "mommy dearest" and the rest of the clan. No doubt Kelsey was not included in those plans.......or did she think she was invited and was therefore preparing a casserole? I mean who eats JUST a sweet potato casserole for TG dinner? I haven't been able to make sense of how Kelsey thought that day would unfold.

What a vipers nest poor Kelsey found herself in, not forgetting the snake that slithered in from Idaho to deliver some poisonous coffee and clean up "her" mess. This is such a twisted tale and I suspect we don't even know the half of it.

Perhaps Walgreens delivery service Postmates dropped the ball, by not being active in the Woodland Park area, or perhaps PF's credit card would not authorize the $4.99 minimum delivery charge IMO

Early on it was reported that she told her mom they were probably going out to eat....
Got this right, Sleuthers?

So, went back through some old articles and it looks like the story about going out to eat on Thanksgiving Day was a lie that PF told CB after KB went missing:

Kelsey Berreth's parents claim Patrick Frazee killed Berreth over custody dispute, court documents state
On Dec. 2, after not being able to reach Kelsey, Cheryl-Lee Berreth called Frazee to inquire about her daughter. The filing claims Frazee made multiple “false statements” during the phone conversation including:
  • Frazee and Kelsey broke up on or about Thanksgiving Day;
  • Frazee and Kelsey went to a Cracker Barrel restaurant on Thanksgiving Day;
Kelsey Berreth killed by fiancé Patrick Frazee over custody dispute, her parents claim
The new allegation is part of a civil complaint filed by Berreth's parents, reports CBS News correspondent Jamie Yuccas.

They're suing Frazee for emotional distress following a series of "false statements" he allegedly made to Barreth's mother, Cheryl, over the phone on Dec. 2, including that he and Berreth "broke up on/or about Thanksgiving Day" and agreed at a Cracker Barrel restaurant in Colorado Springs to split custody of their daughter.

IIRC, I think she said it was a possibility but that's been a minute... I'll check. MOO

When I think about Kelsey, being alone with her child, on Thanksgiving, because she lives out of state, away from her parents and brother and grandparents, it makes me so sad. That snake knew how to mess with her, when she was vulnerable--by promising to do something with her that night--as a family going to a Holiday dinner. What a cruel ,cold hearted monster.

From same article from my earlier post:

“According to Cheryl Berreth, Kelsey Berreth told her Frazee and their daughter were going out to dinner for Thanksgiving.”

UPDATE: Patrick Frazee facing new charges after preliminary hearing
Ugh. That's sloppy reporting. They didn't interview her; Nicki Batiste (CBS) did, and that's not what CB said.

Listen to what CB says in the link below. It is "There was the possibility of going out to dinner."

I just have this niggling feeling that "going out to dinner for Thanksgiving" meant to the Franchette, with a sweet potato casserole in hand, but we all know that's not what Patrick had planned.
That's exactly what I think as well. MOO

I too was under the impression this August "custody" paperwork was some legal forms but given the only thing produced from the search warrant 12/13 was PF's hand written authorization to care for baby K, I believe it's the same and/or not additional paperwork.

MOO

Good find, thanks Pommy.

Seems Kelsey hoped to be invited out, I wonder if she hoped she’d be invited to the Franch after all. We know how that ended. PF instead bashed her to death and lied later to CB that he’d taken her to Cracker Barrel.

Cracker Barrel has good security entrance tapes, so there’s another lie by PF that will be proven to be a false in court.

In this interview of CB’s, where she described her last conversation with Kelsey (but not her conversation/s with PF), this statement stood out.

Even then it sounded deliberately vague, because the language is passive. It would be more natural to say, “She said they might go out to dinner”.

In retrospect, it would seem this was part of the strategy with LE to not put PF on full alert that they were all looking at him. She was using what he told her, while not directly quoting Kelsey.

IMO

I agree with your thinking.
I have always wondered if the vagueness was deliberate in hopes that PF wouldn't panic and then "hurt" the baby....

If I remember correctly, he still wasn't allowing her to see the baby. And wasn't this after CB found blood in the bathroom. She knew her daughter died....

Now you have me curious. I'm going to back to older articles and reread...

"When she was reported missing Dec. 2, authorities initially believed Berreth may have killed herself -- but the flight instructor’s mother, Cheryl Berreth, insisted her daughter’s disappearance was suspicious. She believed Frazee, 32, had been using Berreth’s cellphone to text her recently in an attempt to establish an alibi and said she was tipped off to the alleged ploy because her daughter never wrote in fragmented sentences."

Are you attempting to undermine CB1's credibility by bringing up a really old article?

CB1 had no knowledge or surveillance camera to assume it was PF who sent her a text. It is a fact that it was KK who had possession of KB's phone and it is KK who sent the "fragment" text to CB1. In the texts shown in the SWs, PF mostly writes in full sentences, too, and KB texted "OK. We're home" which some might consider a fragment.
