I have to add one more thing to my long winded, gosh darn it I’m so mad, explanation above.

If you notice, NP’s motion is only ONLY asking Anthem Blue Cross to release records pertaining to JD. These are going to be claims for services and EOBs! There may also be requests for authorization to see a specialist or have a procedure. IMO there would be little to no actually diagnostic information available!

NP must be, at the very least, well aware a motion requesting medical info from the provider would NEVER get past HIPAA constraints.

Wish all you want Norm, but even if JD saw a specialist for X, &/or had imaging for X, it doesn’t prove she had X.
And even if she did, good luck with your ridiculous theory. MOO

I really just think he is testing the gag order, and trying to tamper with the potential jury pool by putting out there the possibility that she is alive and in hiding to get him (the real victim in all of this) in big trouble.
 
The attorney for Fotis Dulos is trying once again to get access to the medical records of his estranged wife Jennifer Farber Dulos – this time alleging there’s a new bill indicating she saw a doctor in early July – nearly two months after she disappeared.

The new bill, called an explanation of benefits, was from the same New York City medical group that seeks payment of more than $300 from the Dulos’ insurance provider. The motion, filed Friday by Norm Pattis, seeks a court order requiring Anthem Blue Cross to turn over copies of all medical records for Jennifer Farber Dulos.

In a wide-ranging investigation and search since she disappeared on May 24, police have been unable to locate Jennifer Farber Dulos. State police say that Fotis Dulos, a Farmington real estate developer, is responsible for her disappearance.

"If Ms. Dulos herself did, as the bill suggests, receive medical services on July 7, 2019, she is obviously alive, if not necessarily well,'' the motion, written by Pattis, states. “Among the hypotheses the defendant is evaluating in his defense is that Ms. Dulos and/or her family have orchestrated an apparent disappearance to resolve a contentious divorce and custody proceeding that was not breaking Ms. Dulos’ way.”

In the motion, Pattis notes that Farber Dulos was receiving an allowance of $160,000 per month from her mother and paying as much as $70,000 per month to lawyers in legal fees to her divorce lawyers.

“The family has the means and apparent motive to keep Ms. Dulos out of public view," the motion states.

How maddening for Jennifer to be forced to pay 70k a month for divorce attorneys. How screwed up is this system when she feared for her life?!!

Based on the new information, which could be a typo on the billing summary, Pattis filed a new motion to obtain Jennifer Dulos’ medical records, which he claims could help exonerate his client.

One word, haaaaaaaaaaaaaaaaaaaaaaaaa.

Basically, FD’s defense comes down to movie plot and a typo.

It's a disgusting motion and set of circumstances....certainly a free Friday news drop for an attorney and client without any rational defense for the state's videos and evidence.

Rather emphasized that NP must really be scrambling for a defense after examining the evidence given to Attorney Smith last week. Too bad...so sad for poor FD!

why would a woman who devised an elaborate "gone girl" plan to frame her husband walk into her doctors office 2 months after she disappeared and show her i.d. to get tests she could have gotten done under the new identity she had created for herself? did the actress in the movie gone girl continue to be her former self? i never saw gone girl. this theory of dr visits after disappearing from a gone girl type just doesn't hold water. but i'm thinking maybe an admin from the dr & ins company can come to a hearing to explain to pattis what happened might work instead of giving records?
 
I don’t think FD was the policy holder for Jennifer. We know for sure that he did not pay the insurance premiums for the children, as he was ordered to do by the court. There is no reason to believe that he would have paid the premiums for his soon-to-be ex wife, for whom there was no such order. But, I could be wrong
I’m in an Affordable Healthcare fuzzy bewildered cloud here. In 2017, when JD left, the Act was in place. Thanks heavens, I was happily retired from practicing by then, but, IME , the process for servicing claims remains relatively the same as before the Act. The marketplace for insurance though has changed dramatically, as well as the rules. Basically though, looking at this as simply as possible, it’s still separated as individual or family. IIRC, FD was ordered by the court to continue paying for coverage for his children ( I have not seen content related to JD). This means they must have had family coverage. In a normal situation, family includes ”spouse”. If JD was employed and received Ins as part of her employment package, she may have opted for it, if a better plan? But she wasn’t employed as far as I know. It would not have made financial sense( prior to the separation) for her to have separate coverage for herself, than to use the family coverage. And 5 kids later, I’m assuming they had family coverage! I do not believe “separation”counts as a special reason to get ins outside of open enrollment, according to ACA, but divorce does. Technically, legally, JD was still FDs spouse and would have been entitled to coverage at least until the divorce. She may have just decided to pay the premiums herself just to keep her and the children’s policy in force. Or she may have worried that FD wasn’t going to pay the family premiums and knew as a woman approaching 50, that she better be covered. She may have bought her own insurance. If she did and FD is illegally getting her EOBs, then NP, IMO, is ........fill in the blank.

How does FD know how much she was spending per month on divorce attorneys? And if he was so concerned, why was he filing so many motions, designed to cost her more in attorney fees?

Sure-someone could definitely explain to NP what happened, but he already knows. He knows that she was never at the drs office on July 7th. His goal is to get the words “JD was at the drs on 7/7, so she can’t be dead-so my client should be home free” out there. I cannot believe that any court in the state of Ct, or anywhere else can possibly allow him (NP) to be doing this. It’s not only outrageous, but I think some part of it has to be illegal. It’s remarkable that a perpetrator should be allowed to illegally obtain information, and disseminate it in this way, circumventing a gag order. Someone said above, yes, the motions are press releases in disguise.
From a PR perspective, all NP wants is even just the simple glance of the headline for most people not digging deeper into the case.
This makes me so sick. She certainly didn’t go through the drastic measures of making such a bloody scene in her garage to make authorities believe she was violently assaulted, and then she somehow masterminded how to transfer her supposed dead body to be driven to Wavenly Park, whilst at the same time also somehow making sure some of her blood got into the Tacoma. Better yet, she also somehow managed to get her estranged husband to gather her bloody belongings into trash bags and then got him to spend a Fri. night depositing them in Hartford. This lame theory is so disrespectful to the spirit and soul of her that it makes my blood boil. And the 50-year-old woman, who is a mother of 5, is also going to a doctor for “reproductive problems??” Boggles the mind. Quite a feat for a sad to say murdered woman. And on top of everything, having an utter disregard for the five young innocent souls and the aging mother trying to keep everything together for them. He needs to come clean and save what remnant of a soul he may have left. He is jobless, friendless, and penniless; yet, he keeps costing everyone else trying to keep up his facade of nothingness.

They just take NP’s motions, repeat them, and and then copy and paste the same case summary below every single time. It’s really sad for journalists.
