RiverRat i have been reading this thread all along and i have never stepped up to say thank you for the work you put in keeping us updated. let me correct that now. Thank You for the updates and keeping the info about this poor child out there.

I remember Dale saying shortly after the murder of Coral Rose that he was so ready to get back to things, to move back into that house and get his kids back to the school bus stop.

Is he even going to be living with his kids? Wasn't some of that *advertiser censored* of a little child being raped by an adult or was that just gossip? Regards, if he had any child *advertiser censored* on that computer than the courts should think twice about him being around his own children. They don't even know who murdered that poor little girl and after all of this time I wonder if they will ever find out.

I think that every state should automatically take DNA from each child that is born and put it into a date base. For those of us already here we should have to give a DNA sample so that it can be intered into a data base too. That way everyone's DNA would be in a data base and killers would be easier to catch. The same with fingerprints. I don't know why our finger prints aren't put on our driver license and recorded into a data base. If the goverment would just makes these things mandatory a lot more crimes would be solved.

Fullwood now lives alone in Cape Coral. His wife, Ellen-Beth Fullwood, has filed for divorce.

"I just want my kids protected," Ellen-Beth Fullwood said while sitting outside the courtroom Monday. "I filed for divorce; I want nothing to do with him."

She said she was only at the courthouse because she was subpoenaed. She said her children told her that Dale Fullwood told them he was going to jail, she said.

"They're very upset dad's going to jail," she said. "They have a right to still love him."

Fullwood was set to go to trial this week after Roberts denied his attorney's motion to have the incriminating videos thrown out of court.

Fullwood's computer was one of 10 confiscated from his home during his daughter's murder investigation. Law enforcement officials found Fullwood had multiple pornographic images on his laptop computer. One expert believed one of the pictures was of a child under 12 years old engaged in a sexual act.

He shouldn't have gotten a deal for having that *advertiser censored*. He should have been charged for the amount of *advertiser censored* that he had on his computer. I don't know what it is with Pros and plea deals. They hand them out like candy.

I've yet to hear this man say that he was wrong for having that junk on his computer...for looking at it and that he is responsible for being in jail and for what he has put his children through.

Agreed. I picture a large Oak Tree whittled down to a tooth-pick for my visual when deals like this are ALLOWED to be called Justice Served. :furious:

Hypothetically speaking........say there was a homicide where the husband murders the wife/mother of children. Husband also has child *advertiser censored* on his computer......which is ignored as it is the lesser of two evils. :furious: There are too many flaws in all of the law enforcement agencies to even know where to begin any chance of repair, IMO. But, I can always just keep sitting back and watching out of my office window as Officer after Officer issues a speeding ticket day in and day out.

Fullwood sentenced to a year in jail

Five years probation includes several conditions

SARASOTA -- Dale Fullwood 48, was sentenced Thursday to one year in the Sarasota County jail for possessing child *advertiser censored*, and will serve another five years on probation as a sex offender.

In pronouncing sentence, Circuit Court Judge Charles Roberts said, "I saw the video that formed the basis of the (child *advertiser censored*) charge. To say it was 'disturbing' is an understatement.

"Anyone who would download and save (that video) for future viewing is a depraved individual who must be punished accordingly."

During Fullwood's sentencing hearing Friday in the Sarasota County Courthouse, Assistant State Attorney Susan O'Donnell argued the court should impose two years of jail time and three years probation.

O'Donnell set up a laptop computer for the judge to view about a minute of one of the child *advertiser censored* videos.

She argued, "You saw how repulsive the video is." A doctor confirmed the child depicted in the video being raped was under 12 years old.

"This is not a victimless crime," O'Donnell continued. She said the video file was downloaded and viewed later that same day, and retained on the computer for 21 more days before it was deleted.

"If he was repulsed, he could have deleted it immediately. He did not. He saved it for 21 days."

There it is confirmed. Dale had to download, save it, and then keep it for 21 days. I'd say getting, viewing, and saving the rape of child is no accident and is very telling. So, now Dale can get on with his life right on down at the Big House for awhile.

But the judge also ruled that Fullwood can post $10,000 bail and stay out of jail while he legally challenges the police search that uncovered the evidence against him. :banghead:

"What goes through my mind every day is I still need to take care of my kids," Fullwood told the court. "We've already had one great loss -- I don't know about the kids, if they lost their father, too."

Ellen-Beth Fullwood shook her head as her estranged husband spoke. She filed for divorce in April.

Some of the conditions of his probation are he is not allowed to be near children except his children if they are supervised, he cannot work or volunteer anywhere children may go, he has a curfew from 10 p.m. to 6 a.m., he must attend a sex offender program for which he has to pay, he cannot view, own or access any kind of *advertiser censored* material, and he is not allowed access to the Internet until he completes the sex offender program.

After his sentencing, Fullwood, wearing a blue tie, sport jacket and tan pants, was fingerprinted, handcuffed and escorted from the courtroom, accompanied by his wife, Ellen Beth. The couple has four children.

After he finishes the sex offender program, he faces a risk-assessment procedure. There are more conditions on the probation and the Sun will run those in Friday.

"Although I have decided never to post and rarely to read, I could not let the libel/slander pass by.

#1 I was not there to support him. I would never do that. He is a sick depraved individual. IMO. I was there because the asst state's atty asked me to come. My impact statement was not required as his lawyer did not present mitigating evidence.

#2 I DID NOT leave the courtroom with him. I walked out while speaking to an FDLE agent. I was assured that that lie will be corrected in the morning on the website and that if it makes it into the print version a retraction would be printed as well.

#3 I agree that his sentence was light and wrong. It does nothing to protect Florida's children. But I was told by others who would rather see him spend a long time in prison that the judge did the best he could under the state sentencing guidelines based on some point system that they use. I had a long phone call with the govenor's office discussing that very issue on my ride back to Fort Myers from Sarasota.

#4 The Sun also misrepresented the amount of his bond. I heard the judge say 10,000 not 1000.

#5 Don't believe everything you read. They get it wrong as often as right.

Thanks RR for all the updates. I just went to the Herald trib site, sat down with a cup of coffee and some cigarettes, thinking I would have tons of catch up to do. Even with the multiple threads, it only took 10 or 15 minutes to catch up on 3 weeks or so worth. What happened to everyone over there? There are one or 2 die hards, mostly the friend of Ellen that keeps going to jail. Even the uncle is hardly posting. I figured once Dale was sentenced there would be a lot of postings, but hardly anyone had much to say. I'm thinking that is the reason for the chief to make his comment on everyone keeping it alive, as it seems the case is losing interest for alot of people.

I do think it was slander that they said she accompanied him from the courtroom. Although I am critical of Ellen, I do believe she was in the courtroom representing CoralRose, not Dale.
