Oh it's probably kinda catty of me but I really hope Chesebro is forced to go to trial with Powell right next to him. It would serve him right.

It irks me to no end that the dude who came up with the gameplan to burn down democracy hails from my home state. It's personal. ;)
Looks like Powell wants to sever.

"SIDNEY POWELL also seeks to sever her case from all of her co-defendants in Fulton County. Her attorneys claim that she has 'no substantive connection with any other defendant regarding the charges in the Indictment.'"

I might well be wrong but I think because it's a RICO case that Ms. Willis will attempt to try as many defendants as possible together which is why, as Chesebro and Powell are the only two so far to motion to sever and both have also requested speedy trials, I'm hopeful Chesebro gets stuck with the Kraken lady.

It may be an errant hope but I kinda feel it fitting since both are desperate to distance themselves from their co-defendants and both were also actual architects of the conspiracy. JMO

No substantiative connection with/to the others ...

Only if wilfully blind, severely allergic to facts and totally ignorant of that RICO bit. IMO, the Judge will give her a rather swift "you are DENIED"!

I'm expecting the pastor, the Black Voters for Trump, and the Kanye promoter to request to sever too. We'll see!

Wow, what comes next?

Poisoning his enemies like Putin? Having them “fall” out of windows? Sending them to Siberian labor camps? Or like Kim Jung-Un?

THAT is an abuse of free speech, when someone who criticizes him is locked up.

Where will the democracy be in this country if this madman is re-elected?

IMO

He means it and his base loves it-- you can be sure of that
If, God forbid, he were to become president, the United States would no longer be a democracy- he will emulate Putin, who he worships and yearns to be like him- if he doesn't like what a journalist says or writes, he will throw that person in jail. he will shut down newspapers---

I really can't get over how DT and his team used, abused, and tried to destroy two innocent citizens. The president of the United States - the most powerful person on earth - told vicious lies about innocent citizens and he did it for his own benefit. His lawyer told vicious lies about innocent citizens and admitted they were lies.

I am sad, to be honest, that the outcry is not louder for Ruby Freeman and Shaye Moss. They have been unfairly mistreated, for the benefit of the most powerful, yet so few people seem to notice.

Their testimony in the 1/6 hearings was heartbreaking. Then to learn that two of the defendants in the GA case actually showed up on Ruby’s doorstep. Chilling.

Georgia State Senator Jason Esteves (D-District 6) and several other Democratic state senators say they are being harassed in various ways. This comes shortly after Former President Donald Trump and 18 others were charged for their alleged attempts to overturn Georgia’s 2020 election.

in the category of not seeing the obvious until someone smacks you in the face with it:

Meadows' testimony that he was simply doing his boss's bidding (whether or not his actions fell within his governmental duties lol lol lol) serves to lay the blame for the crimes more squarely at Trump's feet.

I can't take credit for this observation, because I was the one being smacked in the face with the obvious.

This was someone else's opinion but it is also JMO.

You're not wrong but he also assumed ownership over many of his actions too, distancing Trump. His testimony was a mess. From Anna Bowers dispatch from the courtroom:
When asked about his visit to a voting center where a signature verification audit was being held in Cobb County in late December 2020, for example, Meadows explains that he was in the Atlanta area to visit his children for the Christmas holidays. He knew that there was “concern” in Cobb County about the signature verification audit, and he “anticipated” that the president would ask about it. He thought that observing the audit in person would allow him to be “informed” about the subject if the president brought it up.
And considering the circumstances surrounding the recount in Wisconsin, he asked Fuchs about campaign assistance in order to advise the president on whether the audit would place a “financial burden” on a state entity.

Cross follows up: But you had no ability to offer federal funds, right? “No,” Meadows admits."

Cross then observes that Meadows used the phrase “we wanted an answer quickly” when discussing the text to Fuchs. Who is “we”? she queries. In response, Meadows claims that “we” is a “default” pronoun he got in the habit of using during his tenure as a congressman. He got in the habit of using it, he says, so as to not take too much credit for himself. In discussing the Fuchs text, he continues, it was not accurate to use the term “we.” He contends that it was the president and the campaign who wanted a quick answer, not him.
The prosecution then submits its first exhibit. It’s an email exchange between Meadows and a Trump campaign adviser, Jason Miller. In the email, Meadows appears to attach a copy of the “Chesebro memo” that set out a strategy for coordinating “alternate” electors across several contested states. “Let’s discuss,” Meadows tells Miller. In a later email, Meadows writes, “If you are on it then never mind the meeting. We just need to have someone coordinating the electors for States."

Again focusing on Meadows’s use of the pronoun “we,” Cross asks: “Who is we?” The campaign, Meadows replies.
He rarely stated Trump wanted to know but instead he believed Trump may want to know or to advise Trump which I think shows he was assuming a lot of initiative. I think he wants the best of both of his worlds - no personal liability but also no harm to Trump. One of the most telling exchanges was when Meadows stated Trump earnestly believed he'd won but Meadows himself remained noncommittal. He said he believed simply there was a need for further investigation but also conceeded he had no reason to doubt Barr's assessment there was no widespread voter fraud.

I admit Meadows is one of my least favorite of a bad cast of villians but he's always struck me as a politician's politician. His double dealing, self-serving antics know no bounds. JMO

ETA: One other thing - he very often testified the campaign and he were collaborating efforts rather than Trump personally and while that may be true, I believe it also undermines his defense that his actions were under color of his office. Like I said, a mess!

Fulton County, Georgia Criminal Election Influence Investigation. Prosecuting Office: Fulton County, GA District Attorney’ Fani Willis’ Office. Case #23SC188947
Officials with the Fulton county court handed the indictment to judge Robert McBurney.
Proposed trial date on 3/4/24. Judge Scott McAfee presiding. Though McAfee was assigned the case soon after the indictment was handed up on Monday evening, it could be transferred to a different judge later in the process.
8/17/23 Update from CNN: Fulton County’s sweeping indictment against Trump & 18 additional co-defendants also includes details involving 30 “unindicted co-conspirators” – people who Fulton County District Attorney Fani Willis alleges took part in the criminal conspiracy to overturn the 2020 election. Some of the co-conspirators are key Trump advisers, like Boris Epshteyn, while several others are likely Georgia officials who were the state’s fake electors for Trump. One of the unindicted co-conspirators who appears multiple times in the indictment is Georgia’s Republican Lt. Gov. Burt Jones. Willis was barred by a state judge from investigating Jones after she hosted a fundraiser last year for Jones’ Democratic opponent when he was a state senator running for lieutenant governor. The 98-page document alleges the 30 unindicted co-conspirators, who are not named, “constituted a criminal organization whose members & associates engaged in various related criminal activities” across the 41 charges laid out in the indictment. Unindicted co-conspirators per CNN: Co-conspirator 1 is Tom Fitton of Judicial Watch, Co-conspirator 3 is Boris Epshteyn, Trump political adviser, Co-conspirator 4 is Robert Sinners, Trump’s Georgia election day operations lead, Co-conspirator 5 is Bernie Kerik, former NYPD Commissioner, Co-conspirator 6 is GOP operative Phil Waldron, Co-conspirator 8 is Georgia Lt. Gov. Burt Jones, Co-conspirators 9 is former Georgia Republican Party Treasurer Joseph Brannan, Co-conspirators 10 & 11 are Georgia GOP officials Carolyn Fisher & Vikki Consiglio, Co-conspirators 2 & 8-19 are the fake electors, Co-conspirator 20 is unclear-The indictment says Individual 20 was part of a meeting at the White House on December 18, 2020, with Trump, Giuliani & Powell, known to have discussed the possibility of seizing voting machines. Co-conspirators 21 & 22 are Conan Hayes & Todd Sanders, Co-conspirators 23-30 are related to Coffee County voting machines, Co-conspirator 25 & 29 are a Cyber Ninjas CEO Doug Logan & analyst Jeffrey Lenberg, Co-conspirator 28 is Jim Penrose.

Case & court info from 2/10/21 thru 8/24/23 reference post #338 here:

8/24/23: Fulton County DA Fani Willis has asked a judge to set a trial date of 3/4/24 for Trump & his 18 co-defendants. Willis’ proposed schedule also requests arraignments for Trump & his allies the week of 9/5/23. She hasn’t changed her Aug. 25 deadline for them to surrender at the Fulton County Jail.
8/25/23 Update: Mark Meadows is seeking to move the Fulton County, Georgia, prosecution against him to federal court so that he can try to get the case dismissed under federal law. On Wednesday, a federal judge scheduled an 8/28/23 hearing for Meadows & others to present evidence about whether to move the case.
8/25/23 Update: GOP operative Michael Roman & Georgia State Sen. Shawn Still are now booked in the Fulton Co Jail & show as being processed shortly after midnight. 8/25/23 Update: John Eastman's attorney Harvey Silverglate said his client intends to sever his case from his co-defendants & pursue a speedy trial. Chicago pastor Stephen Lee has turned himself in to authorities at the Fulton County Jail. Former Justice Department official Jeffrey Clark, former Coffee County elections director Misty Hampton, Georgia lawyer Robert Cheeley & Trump staffer Michael Roman all surrendered for processing since last night, the sheriff's office said. Publicist Trevian Kutti has surrendered to authorities at the Fulton County Jail, leaving only one defendant remaining to turn themselves in before the DA's noon deadline, according to the Fulton County Sheriff's Office.
8/25/23 Update: Sidney Powell is seeking a speedy trial, according to a new court filing. One of the other 19 defendants charged in the election interference case, Kenneth Chesebro, has also sought a speedy trial. A judge recently set his trial date for 10/23/23.
8/25/23 Update: Notice of Initial Batch of Discovery. DA Willis requested that attorneys for the defendants “provide a USB drive that is at least 2 terabytes large for copying of the initial batch of discovery” by September 5, the filing states.
8/25/23 Update: Harrison Floyd will remain in the Fulton County jail for now. During his first appearance in court Friday afternoon, Judge Emily Richardson told Floyd that she would not be setting bond because Floyd had already been indicted & assigned to Judge Scott McAfee, who would address bond moving forward. Richardson also informed Floyd of his rights & read the charges that he is facing during the brief virtual appearance. Floyd does not have representation & told the judge that he could not afford a private attorney. Richardson told Floyd he did not meet the eligibility requirements for obtaining a public defender. He appeared over video conference in a large, empty room dressed in a prison uniform. When a bond release was denied, Floyd objected, arguing that he voluntarily surrendered.
8/25/23 Update: Cathy Latham, who served as an illegitimate elector for Trump after the 2020 presidential election, has joined other defendants seeking to have the Georgia election subversion case moved to federal court. In a court filing Friday, Latham said she was following the orders of then-President Trump.
8/25/23 Update: All but one of the defendants have surrendered after negotiating a bond deal with prosecutors, allowing for a fast booking process at the Fulton County jail. The 18 agreements allow each defendant to be out on bond during the course of their legal case, as opposed to remaining in custody. Each of the 18 defendants has also pledged to a standard set of conditions, including prohibitions on discussing the case with witnesses or one another.
8/26/23 Update: Shawn Still, one of the Georgia fake electors, is trying to move the case to federal court.
8/26/23 Update: A superior court judge has set the first group hearing in a Fulton County case implicating Trump & more than a dozen allies in alleged election interference, according to court documents. The notice shows that all 19 co-defendants are expected at the Fulton County Courthouse at 1pm next Thursday, 8/31/23. It is unclear what the hearing will address, or if anyone will attend virtually. The case’s trial date has been heavily debated. Court documents suggest that Fulton County DA Fani Willis was originally considering 3/4/24 trial, but defendant Kenneth Chesebro was approved for a speedy trial set for 10/23/23. Willis then moved to set all the trials for that date — a motion Trump objected, looking to sever his case.
8/24/23 Update: Former Trump White House chief of staff Mark Meadows’s request to move his case to federal court will be the subject of an evidentiary hearing Monday. It’s possible that Meadows might need to testify for his request to succeed, and we learned Thursday that Fulton County District Attorney Fani T. Willis has subpoenaed two central witnesses to participate: Georgia Secretary of State Brad Raffensperger (R) and his chief investigator, Frances Watson. (Politico’s Kyle Cheney said this makes Monday’s hearing something of a “mini trial.”) Also Thursday, a judge set an Oct. 23 trial date for one defendant, Kenneth Chesebro. Chesebro has requested a speedy trial, which he is entitled to under Georgia law. Former Trump lawyer Sidney Powell has also requested a speedy trial, though her trial date hasn’t been set. While their prosecutions might be separated from the defendants who prefer to delay their proceedings (including Trump), an early trial for one or more defendants could get at central facets of the alleged conspiracy.
8/25/23 Update: Jeffrey Clark, former Justice Dept. (DOJ) official, filed a notice of removal on Aug. 21, requesting that his case be moved from state to federal court, where he is expecting the charges to be dismissed. A request to expedite the process before the arrest deadline was denied by Judge Steve Jones of the U.S. District Court for the Northern District of Georgia, who will oversee the hearings related to removals. The hearing will take place Monday, 9/18/23 & the DA’s office has until Sept. 5 to file a response.
8/28/23 Update: A date for arraignment apparently just hit the docket too. 9/6/23 @ 9:30am for Trump. Everyone else that day too in 15 minute increments. Donald Trump: 9:30am, Rudy Giuliani: 9:45am, John Eastman: 10am, Sidney Powell: 10:15am, Mark Meadows: 10:30am, Cathy Latham: 10:45am, Scott Hall: 11am, Kenneth Chesebro: 11:15am, Trevian Kutti: 11:30am, Harrison Floyd: 11:45am, Jeffrey Clark: 1pm, Stephen Lee: 1:15pm, Jenna Ellis: 1:30pm, Shawn Still: 1:45pm, Ray Smith: 2pm, David Shafer: 2:15pm, Michael Roman: 2:30pm, Bob Cheeley: 2:45pm & Misty Hampton: 3pm.
8/28/23 Update: Meadows motions hearing. Meadows also added another lawyer - Robert Bittman. Meadows testified on his own behalf. Georgia Secretary of State Brad Raffensperger also testified. US District Judge Steve Jones did not rule from the bench on Monday. He acknowledged that arraignments in the criminal case were scheduled for 9/6/23 & aid he would rule as quickly as possible. Meadows’ attorney said “we are entitled to a prompt determination” of whether his state criminal charges will be moved to federal court. As the hearing drew to a close, one of the judge’s final questions was whether Meadows had any federal authorities that Trump didn’t have as president. DA Fani Willis’ office said no, but Meadows team said yes, arguing that the chief of staff has a “wide range of authority.” The breadth of his federal authority is key to determining whether the case will stay in state court.
8/28/23 Update: Atlanta lawyer Ray Smith filed a waiver of arraignment & entered a not guilty plea on Monday, 8/28/23. 8/28/23 Update: Judge McBurney has ordered the full release of the Fulton County special grand jury report now that all have been indicted. He says he’ll do it 9/8/23 unless there are objections.
8/29/23 Update: Judge Steve Jones has ordered an evidentiary hearing for two more of Trump's Georgia co-defendants seeking to move their cases to federal court. David Shafer & Cathleen Latham — who both posed as electors — will make their case on 9/20/23.
8/29/23 Update: Judge Jones just entered an order for a supplemental briefing to be filed by 5pm Thursday, 8/29/23 by both parties. The issue is - if even one of Meadows overt acts (but not all) as charged in the indictment occurred under the color of his office would that alone be sufficient for federal removal of a criminal prosecution?
8/29/23 Update: Consent Bond Order: Harrison Floyd now has bond $100K. Chris Kachouroff, a Virginia-based attorney who filed paperwork Monday to represent Floyd in Georgia, said he was contacted Tuesday by Fulton County District Attorney Fani Willis’ office to arrange the bond & claimed his client was only given bond because the prosecutor “didn’t like the optics” of Floyd remaining behind bars any longer. Jeff DiSantis, Willis’ spokesman, strongly denied Kachouroff’s version of events. “Mr. Floyd has had the opportunity to work out a consent bond in the same manner as the other defendants named in the indictment, but chose not to do so until today,” he said.
8/29/23 Update: Motion to Clarify or, in the alternative, partially set aside case specific scheduling Order entered on 8/24/23 filed by DA Fani Willis. She is asking the judge in the Trump racketeering case to fast-track all 19 of the defendants — not just Ken Chesebro — while permitting the others to file motions to sever from the larger case. Defendant Chesebro has not filed a motion to sever & because the Court has held no hearing on a motion to sever, the State of Georgia respectfully requests that the Court set aside its Case Specific Scheduling Order entered on August 24, 2023. The State of Georgia further respectfully requests that the Court set a deadline for any Defendant wishing to file a motion to sever, allow the parties, including the State of Georgia, sufficient time to brief the severance issue & hold a hearing on any filed motion to sever so that the Court may consider the factors set forth in Cain & its progeny, as required by Georgia law.
8/29/23 Update: Attorney Sidney Powell has waived a formal arraignment & pleaded not guilty, a court filing on Tuesday showed. Other Trump allies, Trevian Kutti & Ray Smith, have also waived formal arraignment & entered not guilty pleas.
8/30/23 Update: Attorney Kenneth Chesebro filed a motion Monday, 8/28/23 asking a judge to unseal a host of underlying records in the case -- including the special grand jury report that recommended charges, the transcripts of testimony heard by the panel & any recordings of the proceedings.
8/30/23 Update: Sidney Powell files a motion to sever her case from the other 18 co-defendants claiming that she has “no substantive connection with any other defendants regarding the charges in the Indictment.”

Former Trump attorney John Eastman defended his efforts to block or delay Congress from certifying the 2020 election results in an interview with Fox News Wednesday night, claiming he wanted former Vice President Mike Pence to stop Congress from certifying the votes for a week even as he’s now been indicted in Georgia for his post-election efforts.

Eastman claimed to Fox host Laura Ingraham that he “explicitly” told Pence on January 4, 2021, that rejecting the electoral votes entirely would be “foolish,” but he advocated for the vice president to give state legislators in battleground states “a week to try and sort out the impact” of purported “illegality” in the election results (which there is no evidence to support).

[...]

“He literally just confessed to the crime,” national security attorney Bradley P. Moss wrote, while Georgia State University law professor Anthony Michael Kreis noted Eastman was “admitting to committing federal crimes on television” and “should keep his mouth shut for his own benefit.”

[...]

The federal indictment alleges Eastman put together a memo on December 23 that encouraged Pence to reject the results before Eastman “asked” Pence on January 4 to “unilaterally reject the legitimate electors from” battleground states or send the results to state legislatures, and that he then met again with the vice president on January 5, where he specifically “advocated” for Pence to reject the electors entirely.

D.A. Willis don't play, but then again, Chesebro and Powell are lawyers and should know the following, BBM:

Adam Klasfeld

@KlasfeldReports

"NEW DA Willis wants to advise all of the defendants in the Trump racketeering case that decisions by Ken Chesebro and Sidney Powell to invoke speedy trial rights come with certain consequences. The filing starts with four. "'

"'By filing a statutory speedy trial demand, the Defendants elected to proceed to trial without the benefit of the type of prior notice of the State's discovery and similar transaction evidence that would have otherwise been afforded to them.'"

I'm a little surprised sometimes by what bad lawyers they are though, ya know? Jenna Ellis was disciplined and had to admit she lied; Alina Habba has been sanctioned to the tune of a million dollars; Rudy Giuliani lost his license in New York and D.C.; John Eastman went on national television to confess and he's in disbarment proceedings too; Evan Corcoran had to recuse himself and hire his own lawyer; Michael Cohen went to prison; Sidney Powell and Rudy Giuliani got sued repeatedly; and a whole slew of them have been indicted in Georgia and are presumably under investigation in other jurisdictions. (And there's probably more I'm not remembering.)

I think the belief that one may be above the law might just be contagious. JMO
