Many question DA’s decision to charge officers in Brooks case before end of GBI investigation

ATLANTA — There has been a lot of controversy and questions from the public and legal teams over why the Fulton County district attorney didn’t wait for the result of the Georgia Bureau of Investigation probe before charging the officers who shot and killed Rayshard Brooks.

The short answer is there’s no legal requirement for him to do that. The public debate is whether the case was charged properly or too quickly.

Channel 2 investigative reporter Nicole Carr also learned that there is a call for a special prosecutor in the case, but the process, according to Georgia law, would involve more than the current request made by a U.S. congressman.

For the past five years, having the GBI investigate officer-involved shootings has been the standard.

The agency must be requested by state or local law enforcement agencies to step in and provide a third party probe. That happened in the Brooks case when the Atlanta Police Department made the initial request last weekend.

The GBI does not make charging recommendations, but their findings are typically used to supplement prosecutors’ investigations. GBI officer-involved shooting investigations usually take 30-90 days to complete, according the agency and prosecutors. Collectively, the information can be used in charging decisions.

Fulton County District Attorney Paul Howard took the unusual step Wednesday of charging the officers in the Brooks case before reviewing that third-party investigation , drawing public ire.

In part of a Thursday statement, an attorney for fired officer Garrett Rolfe described Howard’s actions as “rash.” Rolfe faces nearly a dozen charges, including felony murder.

“Had Paul Howard waited for the GBI to complete its investigation, he would have learned that while Rayshard Brooks’ death was tragic, Officer Garrett Rolfe’s actions were justified under Georgia law and that there is no legal basis to charge him with 11 felonies,” attorney Noah Pines wrote.

“When I watched the press conference, and I realized that the GBI was not included, and then later read the press release that the GBI was unaware of the charges and they were not consulted, I was quite shocked, to be honest with you,” added Vince Velasquez, a retired Atlanta police homicide detective.

But Howard is not legally bound to wait for the GBI findings to move forward. Prosecutors also use their investigators to conduct parallel probes.

“The district attorneys have the power to bring charges or to announce that they intend to bring charges on any case that they find probable cause that crimes been committed,” said Gwinnett County District Attorney Danny Porter.

Porter the former head of the Prosecuting Attorneys Council of Georgia, added the move is still unusual. In 2015, the GBI offered its independent, officer-involved shooting investigations to agencies. It followed a rash of OIS incidents in DeKalb County, Porter said. He said prosecutors across the state agreed those investigations were critical to their parallel investigations.

“For my purpose as the prosecutor, I get a better product out of the GBI,” Porter said. “The GBI does a better job than most local agencies can do. They have the technology, they have the skills, they have policies and procedures that have been honed over the last five years.”

During a Wednesday press conference Howard laid out photos, videos, multiple witnesses and physical evidence that his investigators had gathered, after acknowledging there was a question of how he was able to charge the case in a matter of days.

“Having video that corroborates witness statements — that’s huge regardless of whether we’re talking about the GBI investigating or we’re talking about the DAs office investigating it,” said Georgia State University law professor Jess Cino. “That corroboration, that at least confirms the stories that they are getting from these early witnesses that will make them a little more comfortable with going ahead and issuing the arrest warrants now.”

Velasquez echoed Porter in saying the initial investigative process typically involves GBI findings.

“I was part of an officer-involved shooting team for many years at the Atlanta police, and we decided to get away from that and send it to the GBI,” Velasquez said. “Paul Howard was included in that. The DA’s office co-signed that, and that’s been the process all along.”

Whatever the GBI does find in the Brooks case will still be key to the rest of Howard’s investigation and the next step, legal analysts say.

“It’s also important to keep in mind we’re just talking about an arrest right now. We’re not to the grand jury point. We’re not to the point of an indictment being issued,” Cino said, noting Howard would want to forward the most detailed presentment possible.

Howard said because of COVID-19 shutting down the court system, it will be months before a grand jury convenes on the Brooks case.

Georgia U.S. Rep. Doug Collins has called on state Attorney General Chris Carr to appoint a special prosecutor in the case.

If this is going to takes months before a Grand Jury then I hope he gets bond today. I mean they have been letting criminals out of jail early due to CV19 so what would be the point of putting him in prison? He is not a flight risk as he clearly turned himself in yesterday.

In my opinion

The actions of rioters and protesters are harming race relations.

Why would the opinion of anyone be swayed by actions that that cause inconvenience or damage? Loss of jobs? Injury?

Three hours late to work due to protesters blocking a major interstate

Lost job because the store or business where they work was burned down

Unable to buy groceries because all area stores are closed due to threats of violence

Can’t get to work because public transportation is shut down due to threats

Your small business was burned down

Police officers in your city or town were refused service at a local restaurant

None of the people above had anything to do with the police officers who committed murder. I don’t see how their opinions will be swayed toward BLM by these actions.

There are bad police officers. There are good police officers. There are good people. There are bad people.

A police officer in my city was recently featured on the news because while patrolling a neighborhood he found a teenager crying holding a cat. Someone had shot his cat with a BB gun and his family didn’t have the money to take the cat to the vet. The police officer took the cat to the vet, paid for it himself, and returned the cat to the family a few days later. The officer was white, the family was black. The cat was a beautiful orange tabby. Would you refuse to serve this police officer at a restaurant?
 
I just saw on the news that Officer Rolfes stepmother was just fired from her position of being HR Director for a mortgage company in Atlanta.

I find that so extremely sad. Why is she being punished because she's his stepmother? Of course the company said it had nothing to do with it. I dont think many are going to buy that reason. The timing of the firing speaks volumes. My heart goes out to her. I find it so upsetting.

Maybe someone would be so kind to link a news article about it or it may have already been linked, and I missed it.

I wish all of the rioters who knows they have broken so many serious laws in so many cities would also do the right thing, and turn themselves in to police.

I really hope, and pray the peaceful protestors in each city who witnessed all of these felonies are calling 911 or Crime Stoppers even if they are afraid, and do it anonymously.

In many of these cities the peaceful protestors were highly upset when the criminals came in destroying the message the protestors were there to make.

I saw news yesterday where the police were able to identify one of the criminals by her tattoo, and she was arrested. They were able to compare her tattoo of her at the scene, and her social media page. Sorry I forgot the state, and city.

More video footage needs to be closely reviewed at every crime scene, but I know LE are having to deal with so many things right now it may take quite a bit of time.

However, I do believe this time will be different than in the past several riots, and more suspects will be identified, and arrested.

The link I posted about the officers turning themselves in says that Officer Rolfe is in court at noon today. Will the no bond be addressed then? Hopefully if he gets bond the 250k will help with that.
Yes. Today is the "arraignment" phase where the defendant will be advised of the charges, and his rights. He will enter a plea, (guilty or not guilty) and then the conditions or release will be addressed, including bail.

According to Heavy, she was in the process of transitioning to time off and had created a hostile work environment. The company did not note whether the leave was connected to the hostility, or when either started. In the days to come, I'm sure MSM will interview her coworkers to get a better understanding of what happened.

My hubby, and I often pay for the officers lunch or if they are in a hurry we buy their coffee. They are very appreciative. Many where I live do the same. We appreciate all they do, and now in the most trying of times it's even more important to show them appreciation. Imo

On some national news sites they show the kindness of so many police officers whether on duty or off duty. Not a day goes by without me seeing how kind they are to those in their communities. Most serve in the communities they also live in.

Even though many do not make much money, and are way underpaid they are buying clothes or groceries for families in need. Many of them are white police officers helping black families. They dont see color. They see a need, and step up to help families countless times every year.

Their compassionate hearts encompasses all when they see a way they can help others. Many mentor children as well.

Just this morning on FNN an adorable little black boy was dancing beside a street curb so the white police officer got out of her vehicle, and joins him. They both were enjoying their time together. :)

Another one this week i saw on FNN was of about a black female police officer who said a young white boy came up to her vehicle asking her if he could pray for her, and he did. :)

They do so much with little to no appreciation. They do all of these caring acts without wanting anything in return. The only way they become known to the public is because unbeknown to them someone was videoing, or the appreciative family thanked them publically.

There are far more kind, and caring police officers than the few bad apples we see among the almost one million LE officers who are serving.

Someone needs to take up the issue of no bail. Rolfe could be in jail for months before anything moves forward.

Felony murder is a serious charge. It's not uncommon for bail to be denied. If it's not, the bail is set high. Remember, this guy is looking at either the death penalty, or life without parole. There's not a lot of incentive to stick around for a trail at this point.

I am allowed to have my opinion though why I thnk she was fired at the time she was.

I sure hope she's hired a good attorney.

It wouldn't surprise me if she will also receive online funds from many to pay for an attorney.

That may very well be. I haven't heard that, however.
If there was no warrant issued for his arrest, and he turned himself in, he has to be arraigned within 48 hours.
If an arrest warrant was issued, he'd have to be arraigned within 72 hours.

Your knowledge of how the system works is much appreciated. Keep at it, for those of us who aren't in the know.

Fabulous post! My feeling is that since the George Floyd killing, there is more tension than I ever remember. If there were any forward steps taken, towards improving race relations they have taken a huge step backwards. And not because of RB being killed, but because George Floyd being murdered does not mean the circumstances are equal. The violence occurring destroys the message. JMO

Imo, I knew all along he was not going to seek the death penalty.

DAs only apply the DP when they believe they can get 12 jurors to agree. This is not one of those cases.

Imo, I see weakness in the DAs case, and he may not even be convicted of the top charge of murder.
