Yes the car was backed in, next to another car, by the edge of a grass patch and at the edge of the parking lot away from the middle spot under a tree where RH normally parked.

But HEY you never know, maybe the aliens came down and mind controlled RH and it's not his fault at all....:facepalm:

It looked to me like he was parked next to a little raised grassy island in the parking lot. With the windows tinted, I think someone would have to be pretty close to see into the car from that side. Nobody saw or heard anything (that we know about). but I think that's more likely due to his arrival time. I wish we knew R's schedule and whether HD employees are on staggered shifts, etc. All MOO

The judge does not have ESP. I assume he used those statements to determine there was probable cause that RH planned the murder of Cooper.

No, once again, this was not a trial. He used those statements along with all the other evidence presented to determine if the prosecution had probable cause for the arrest and enough evidence for them to present the case to the Grand Jury. This is not some random guy they pulled in off the street, this a judge who is presumably experienced and well-versed enough in the antics, theatrics, spins, prevarications and diversionary tactics of lawyers (whichever side of the divide they happen to fall on) to not be swayed by 'fluff'. If you didn't approve of how the probable cause hearing was conducted then you're really gonna be unhappy when it goes to Grand Jury since - someone correct me if I'm wrong - I understand ONLY the DA gets to put on witnesses and ask questions there and the defense doesn't get a look in.

Another important consideration is that RH backed his car into a parking space next to another car. The idea that he didn't look over his shoulder when doing that is ridiculous. But I'm sure someone is going to suggest that he didn't have his magic sunglasses on at the time and the sun beamed in his eyes and blinded him to Cooper while at the same time allowing him to see out the back window. Or maybe it's because he's such an expert parker and just for fun he decided to do it with his eyes closed to see if he could pull it off. Or maybe he has an innate sense of direction and heightened animal like senses like cats that return home to their owners from miles away, and with this super power RH didn't have to look left or right when making turns on the roadway or crossing intersection or parking. He just "used the force Luke" and glided perfectly into the spot.

I mean, it could happen!

I have a close family member that works at HD's corporate offices (not the building RH works at, but the one right down the street) and he is positive that the hours for all regular corporate employees are 8-5 (1 hour lunch). Lunch hour is fairly flexible, meaning it wouldn't be considered terribly unusual to leave at 11:30, but most take a closer to 12-1 lunch.

I'll play devil's advocate and don't bash me. I'm just throwing this out there for discussion. ( not necessarily because I believe it ) What if there was no pre meditation? What if what Ross is guilty of is really gross negligence, so gross that he didn't really care whether or not the baby died? He could have thought ' oh crap' and meant to go to his car and get the baby but by then had the sexting going full steam and could not ' get away' and then again thought ' oh crap' a bit later and at some point KNEW the situation was going to be bad but he just didn't want to leave his sex cave and go check and may have even thought ' oh well' if the baby does die, but had no 'plan ' to take his life that morning? ( run on sentence, don't tell me )

I honestly don't understand where you are getting that this man is being treated unfairly. They aren't just going ahead giving him the needle, they are following due process, he is still presumed to be innocent, he is entitled to a defense and he's got defense counsel, he's entitled to a trial if he's indicted by the Grand Jury and if he is found not guilty he will be set free, if he's found guilty and faces the death penalty he's entitled to appeals where he can present any new exculpatory evidence or evidence of poor representation.

And given the fact that warnings out there are that a child can die pretty quickly in a closed car in 80 plus degrees it could have meant that RH was hoping someone would have found the child before he left work for that day. Even with tinted windows backing the car into that spot would have put the baby's seat next to the in-facing car next to him at the driver's side door.

If it is possible in any way that this was planned between the husband and wife, RH telling his wife that Cooper's eyes and mouth were closed is very telling. It sounds as if she may have been concerned that it would not have been as if he just went to sleep and did not wake up.

It is too bad they did not search for the other options regarding adoption or another family member taking over the care of their son because it was too much for them to handle.

If this was such an issue that they feared leaving the child in the car buy a GPS and set it for the daycare before leaving for work in the morning. Once you head away from the daycare you get a warning. I can't believe RH remembered to take his son into Chic-fil-A but suddenly forgot to turn toward the daycare facility less than a minute after getting into his car. It makes no sense at all. jmo

Charges at the moment do not require intent- just negligence. Discussion of the charges is in the thread by attys that explain it better. If guilty of 2nd degree child cruelty that caused a death, he is also guilty of the felony murder.

Well then what's your point? Why would someone be wandering around the parking lot of a corporate office? He parked next to a car and beside a grassy patch. The only person who would potentially discover Cooper would be the people who parked next to him. Who else would you think could possibly have seen the child?

You would think that people would not wander around parking lots of businesses (not retailers) but where I work, there are people milling around. It is really strange. One time at got to work at 5:00 in the morning and people were actually walking around the parking lot. It was kind of scary. I think in my work parking lot, it was probably homeless people milling around but I really do not know.

I'm not saying that it is only RH that is being treated unfairly. If what you said is true, and the defense was not given the video prior to the hearing, that would be unfair for any defendant.
