One of yt lawyers recently stated that with JP's representation, Chad will never be able to successfully claim ineffective assistance of counsel. In their opinion two new "random" DP certified attorneys would not do a better job.
Well, I didn’t think much of Loris lawyers, so no loss there.

*Motions Hearing (@ 9:30am MT) – ID – Joshua Jaxon (JJ) Vallow (7) & Tylee Ashlyn Ryan (16) (JJ last seen Sept. 23, 2019 & Tylee on Sept. 9, 2019, Rexburg; found June 9, 2020 buried in Daybell’s yard in Salem, ID) & Tamara “Tammy” Michelle Douglas Daybell (49) (died on Oct. 19, 2019 at her residence in Salem, ID; dob 5/4/70). – *Chad Guy Daybell (53/now 55) arrested (6/9/20) & indicted (5/25/21) & charged (5/26/21) & arraigned (6/9/21) with Count 1 (for Tylee): Conspiracy to commit 1st degree murder & grand theft by deception (for Daybell, Vallow & Alex Cox) & other co-conspirators. Count 2 (for Tylee): 1st degree murder. Count 3 (for JJ): Conspiracy to commit 1st degree murder & grand theft by deception. Count 4 (for JJ): 1st degree murder. Count 5 (for Tammy, 49, died 10/19/19): Conspiracy to commit 1st degree murder. Count 6 (for Tammy): 1st degree murder. Count 8 & 9: Insurance Fraud (Two counts of insurance fraud related to 2 different life insurance policies he had on Tammy). Plead not guilty. No bond. DA will seek DP.
Trial set to begin on 4/1/24 (thru 5/31). Trial will be held in Ada County.
Judge Steven W. Boyce presiding. Prosecutors: Lindsey Blake, Rob Wood & Rachel Smith & defense attorneys Jim Archibald & John Thomas.

1/12/24 Update: John Prior, Daybell’s attorney, says his client has been declared indigent by the court & can no longer afford his services. He has filed to withdraw from the upcoming murder case Friday. “Mr. Daybell does not have the ability to pay for counsel’s continued services & Mr. Daybell seeks the appointment of two capital qualified attorneys to present him in this matter,” the motion stated. According to the motion, Daybell has consented to the motion for Prior to withdraw. Prior said since Daybell is facing the death penalty & does not have money, he is entitled to the appointment of two attorneys who are “capital-qualified” at the state’s expense. Judge Steve Boyce said he's not sealing Prior's BS & set a hearing for 1/18/24 at 10am for arguments for motion to withdraw as counsel. 1/17/24 Update: State files Objection to Motion to withdraw.
1/18/24 Update: Prior argued he wanted to stay on the case but needed to withdraw because he was not a death penalty-qualified attorney, did not have enough time to prepare for trial & Daybell could no longer afford to pay him. Prior said he did not want to discuss his trial strategy & asked to go into a sealed hearing. The courtroom was cleared & after 30 minutes, the public hearing resumed with Fremont County Prosecuting Attorney Lindsey Blake arguing against the motion to withdraw. After taking a brief break, Judge Boyce denied Prior’s motion & said that if it was granted, the trial would not happen for at least a year or even longer. “The motion, if granted, would absolutely require a continuance of the trial & not just a brief continuance,” Boyce said. “Idaho has a sparse number of (death penalty-qualified) attorneys … and Idaho is currently experiencing a lot of cases resulting in the appointment of available attorneys. I don’t have any idea of who would be appointed, but what I do know is the trial would have to be vacated & continued likely for a long time.” Boyce noted that Daybell was happy with Prior & wanted him to remain as his attorney, but if Prior could find another lawyer to assist him, the state could help pay the costs. 1/26/24 Update: 60 subpoenas issued.
*Lori Norene Vallow aka Lori Norene Daybell (46/now 50) – Fremont County: Trial started on 4/10/23 & ended 5/10/23. 5/12/23: Guilty of all charges. Sentenced (7/31/23) to 3 consecutive life without parole sentence. 8/31/23 Update: Jim Archibald, Vallow's attorney has filed a Notice of Appeal & a motion to appoint state appellate public defender. New appeal attorney Craig Durham.
 
Guessing not updates on yesterday's hearing?? I have his next one as final pretrial hearing on 2/22/24 @ 9:30am.

We’re a little further out from scheduled trial date IIRC when similar allegations of evidence disclosed close to a deadline - in this instance Prior is saying that State had these reports since June of last year - when the death penalty was taken off the table by the Judge.

Though Prior says in “this in itself is not the concern” he may mean not that concern for this specific Motion and expedited hearing he’s asking for. Though I do worry if what he’s alleging is true, that we will be seeing similar Motions to dismiss the DP again, in the future for his client.

A reminder of what Judge Boyce said when ruling to remove it in Lori’s case: “"First, with the defense having timely raised the issue, the court determines that if I were to fail to address this discovery issue, I believe this case would inevitably be reversed on appeal if there was a capital conviction," Boyce said in the ruling.” / quote taken from Judge rules Lori Vallow Daybell, charged with conspiracy and murder in the deaths of her two children, will not face death penalty if convicted

Just my opinion but I don’t think this development means that much at this point and the real story is probably more boring than we think. Remember that Rachel Smith is a Missouri attorney brought onto this case about 3 years ago as a “temporary” addition to the prosecution team by Rob Wood. He had to get approval from Judge Boyce and the Madison County Commissioners as I recall. 3 years is a long time for a temporary assignment in another state. She may simply want to be home in Missouri or she may be needed on some case there. Or perhaps Madison County decided it was time to stop paying her as her duties were primarily to help the team prepare for the case not to actually try it as I don’t think she’s a member of the Idaho Bar - at least she wasn’t when she was hired - I suppose that could have changed in 3 years but I suspect it was more along the lines of it was time to renew the contract but since most of the preparation has been done and they are ready for trial, Madison County decided not to renew it.

Those are my thoughts at the moment anyway lol

I wanted to add that public records requests for her contract showed that it was worded in such a way that she would handle the cases “until completion”, almost as if she would handle any appeal related issues if convictions were secured. I’m not sure if I can post the contract obtained from public records request here but it may possibly be around elsewhere online.

The ones they murdered were the ones they "messed up" the most. But yes, everyone else related or involved has been damaged too, especially the adult children of the perpetrators.
