You could almost convict based on this reaction sequence alone.

This must have been a similar reaction that was video'd the day Caylee's remains where discovered in jail. Busted.

I sometimes wonder if the reason CA and GA hurriedly left the court room was because they saw KC's reaction on the monitor and it was a clear 'tell' to them --- they had seen it so many times before when KC was busted.

JA's presentation was not nearly as graphic or bad as the discussion on the autopsy photos ... so I feel KC's parents walked while KC was so pissed and did not see the subsequent change to poked tears after JB's direction.
 
confused...most people I've encountered think it would be more humane to put an animal to sleep than to cage it for 60 years and yet think it's somehow more humane to cage a person for 60 years instead of put them to sleep. I just don't get how one is more humane than the other. They are both equally bad imo, so I have no qualms about the DP. In fact, I think it is more humane and better for all.

I understand what you are saying. I must say though, that a lot of prisoners end up being "productive" for society, and even just jail society. Some write books, some teach others, and so on... I have also worked with some that are "in the program" as they call it. They are out on work release. Quite a few have told me they felt safer, felt they could control their emotions and actions, and just liked the structure of being in prison as opposed to living a normal life outside. I was stunned needless to say, I never thought of it that way. I can see KC being happy to have no responsibilities other than a menial couple of hours job, have a free place to stay, have free food, have free education, have free cable tv, a library (which is free to anyone), and become quite satisfied. There is more, but you get the idea.

Yeah, this picture would have made the jurors think all of 2 seconds on the decision. I'm still shocked at how that moment shocked me, quite an emotional reaction I had to it.

I remember I cried when I saw that mean, scary look on her face. Poor Caylee, only two years old. I cannot even imagine.

The team is on it as we speak I am sure. No way they can let her go to trial acting like this.
 
I am not going to presume which 'facts' the Judge is referring to in his statement. JA references to the LAW may be the facts the Judge is referring to.

From the video referenced below (transcribed but not word by word)

JA: the facts that the defense argued their opinion and that the death penalty is available for 1st degree murder w/out special aggravating circumstances in FL. Why does prosecution waive it sometimes (to bring it before a jury) is more appropriate. Case law does say court is not permitted to make a pre-trial decision on special/aggravated circumstances - but that is what defense is arguing. Can if there is "bad-faith" for decision- case law is limited to where it can be shown if based on race, gender, religious beliefs or sexual orientation. Prosecutor is trying to punish defendant outside of the crime - defense has not presented anything that shows prosecutorial decision has done so. Defense goes on to allege that before Caylee's body was not found and no death penalty and once body was found and state's case became stronger then prosecutor needed 'advantage' of death penalty jury to win - why waive when case weaker and reinstate when stronger?

Then JA goes on with the innocence statement and the worst case scenario he gave which others are assuming are the 'facts' the Judge is referring to in his order.

Thank you, Eaglemom. I took Judge Strickland's reference to facts to be referring to Ashton's references to law prior to his worst case scenario.

I agree. If it were me, I'd beg for the death penalty in lieu of Life in prison. I'm always surprised that the common reaction from inmates and their family members is to fight so hard for Life in prison instead of the death penalty. I feel the same way even if there was a chance of parole after 40 or 50 years. I'd be thankful for the option to be humanely allowed to die. I believe prison would kill me mentally and physically way before 40 or 50 years was up. Also, I'd prefer my family be able to move on with their lives, not have a lifetime burden of an inmate to visit, send money to, be embarressed about. I realize this isn't a popular opinion.

It's okay to feel the way you do knt. Just don't do anything that would send you to jail or prison. (I couldn't do it either.)

The state's attorneys were cagey like a fox when they got CA to declare in her depo about the extraordinary physical dexterity and prowess that Caylee possessed at such a young age. I do believe JA alluded to that fact at the hearing when declaring that Caylee would have been able to remove the duct tape if she had not been restrained. I also believe CA realized what she had done when she heard JA say that, and that was what made her so upset she had to leave the courtroom. She knew she had given the SA the ammunition they needed to strengthen their theory of how Caylee was killed. I think she got literally sick with that realization and had to get up and leave. It was only then that GA got up and left too following after CA.

For me the value of the DP 'threat' is that KC will get a DP-qualified Jury and given the shenanigans and spin of the Defense team --- I think this is a good thing. Important. This is serious and we need a conservative DP-qualified Jury to consider the evidence and cope with duelling experts, spin, etc.

Having said that, do I think KC will get the DP? -- no. I do think that she will get LIFE and in FL LIFE means LIFE. That works.

I'm one who is pleased and excited the death penalty was kept in - not because I actually want her to get the death penalty, but that it just may up the ante so she pleads out and takes LWOP.

Compelling! Had the SA just stated that when CA and GA got up and left? How close to the time when they left was that material presented by the SA?

Post Script: I see that AZlawyer thanked this post -- I know exactly why she did -- we're on the trail of a nonverbal communication by physical behavior that could be evidence, and it happened right before our eyes; like a nonverbal "excited utterance."

Extremely interesting point! I agree 100%. I bet her departure had more to do with that than what happened to poor Caylee. It's all about her. Like mother, like daughter.

They basically do NOT like people paying attention and either catching things or catching them out on things ...... they like to present a facade and for that facade to be taken asis, believed and, not challenged. None of the A's are used to things being taken to account ...... they have all lived in A fairy tale land for so long. They are all different degrees of CA was the master and KC was becoming so but CA stood in the way.
