But the ECJ appeal has nothing to do with the current investigation, dear Dlk79! It's likely more possible, as long as everybody is looking at the ECJ appeal, investigations carry on very silently. No matter what ECJ rules out, that court has no power to get someone out of prison. It takes only a few hours for an arrest warrant!

As long as a suspect is in prison, there isn't any need to appeal for an arrest warrant. That wouldn't be productive, cause the suspect is warned and could take part by himself! Why should L.E. do that?

Keep patient to the end of August!

Malaga, along with Cadiz, is one of the main Spanish gateways to the European drug market. Possibly CB used the caravan pull as a over for his trip. Either because it would logically follow from 1) or they have actually found something in the thousands of pornographic image files that points to MM, but which does not allow evidence about the perpetrator because he is not visible on it.

a lycra bodysuit or similar is all thats needed to conceal identity from being 100% certain.

i suspect MM is in the images/video alive or...or both...sigh..

and thats why they are certain of her fate. it would follow then that rather than immediately charge and arrest, the lead points to all kinds of other victims and perps which would suddenly make this a much longer, involved process.

8000 images, dogs are in a few and CB is in 100. Still 7,800- something images to go through and identify. I’m not sure how good camera quality would be back in 2007 as well if MM is in any. Unless her eye was noticeable it will be hard to identify her. There are a couple of CBs potential victims who look similar.
It’s going to take a long time to get through the images/videos.

personally the narrative doesnt follow that storyline IMO. That is of course assuming that the publicly portrayed narrative is accurate, and it may not be. (essentially making this whole forum nothing but loose speculation).

I believe that if they are having any trouble with identification, its the location and the perps in the video. Part of the investigation some weeks ago was focused on things like what did the inside of CB's house(s) look like?.. what furniture and so on.

It was subsequently discovered that all of his furniture and such were gone - appearing to make the location uncertain as well as (IMO) the adults in the videos/pics.

I've been trying to work out if the Barranco VW image was taken before or after 30th March.

The screen cap doesn't seem to show the elongated dent above the wheel arch. This would suggest that Barranco image was taken after the 30th March 2007



However, looking at the state of the fuel cap area on the screen cap I would say the opposite and that the Barranco image was taken before the 30th March



The low res screen cap doesn't make it easy to ascertain if the dent is there.

This is just my opinon, I'm sure others here are a lot better than me at analyzing this sort of stuff. It would be nice to know for sure if it was before or after, not exactly sure why yet, It would just be nice

Back in Germany in 2011, he was sentenced for trafficking narcotic drugs, and then in 2016 he was convicted for child sex abuse & possessing indecent images. His reported total of 17 previous convictions also include theft & forging documents. In December last year, Brueckner was convicted of the 2005 rape in Portugal & jailed for seven years, but the sentence has not yet been imposed because of an ongoing appeal (set for 7/16/20). He is currently serving a 21-month sentence for drug trafficking on the Island of Sylt in the northern German city of Kiel. After travelling to Italy to take a holiday, he was arrested again at the end of September 2018 in Milan, and extradited to Germany. In August 2019 authorities in Braunschweig charged him with the 2005 rape of the US woman, with his conviction following in December, 2019. CB was caught stealing diesel & got 8 ½ months in prison on remand waiting for a trial in Portimao, Portugal. Jailed from April 7, 2006 to December 21, 2006.
Portuguese police have less than two years to make their case against Brueckner for the kidnap & murder of Madeleine. According to the McCanns' lawyer Rogerio Alves, a 15-year statute of limitations for prosecutions in Portugal means that police only have 22 more months left.
7/16/20 Update: There is a chance Brueckner could be released from prison on July 17 if the European Court of Justice overturns his conviction for the rape of the 72-year-old American woman in Portugal. The ruling is set to be made in a July 16 hearing which has been fast-tracked because of the nature of Brueckner’s case. Of the potential outcomes, Portugal could give retrospective permission for the extradition, or the court could order a retrial. The third possibility is that Brueckner could have his conviction overturned and be released – potentially then fleeing to a country without an extradition treaty with Germany. Bundesgerichtshof must decide whether or not to release suspect Brückner.
7/16/20 Update: Christian Brueckner's lawyer Friedrich Fulscher appeared before a panel of judges at the European Court of Justice in Luxembourg on Thursday. Fulscher argued that it was 'unconstitutional' that Brueckner had been tried for the brutal sex attack Praia da Luz in 2005 – two years before Madeleine vanished from the same resort in May 2007 – because it breached international law. The ECJ will publish their 'opinion' in three weeks' time, on August 6. Their final judgement, which usually follows the opinion and is binding on courts across the EU, will be delivered soon afterwards. Brueckner, who was not in court today, remains in prison and will be informed about the court's decision in the coming weeks. Brueckner's current jail term will expire in January next year.
8/2/20 Update: Brueckner’s lawyer, Friedrich Fulscher, accused police of creating a smokescreen with this week’s search. He denied his client had ‘anything to hide’ but would not cooperate with the investigation. Mr Fulscher said: ‘Before our client starts to co-operate with the prosecutor’s office, you could order holy water as a long drink in hell. That is not unusual. It is very normal not to talk to the police when you are suspected of committing a crime. Mr Fulscher claimed the allotment search was designed to build ‘bad media’ against Brueckner ahead of a court decision that could see the convicted rapist freed from prison after serving his sentence for drug trafficking. The European Court of Justice will decide whether an arrest warrant relating to the rape of a 72-year-old woman in 2007 was legal.

1) It is obviously necessary for the purely legal aspects of criminal prosecution to assume murder (and to call it that way: "We are investigating Mr. X for murder").
Kidnapping could become time-barred, murder never.

Re your point 1

I agree and don't find it surprising to assume she is dead - it is actually logical given everything we know. Especially if LE believe based on some withheld evidence, that CB is guilty then the theory of the case will be she is dead. Like 99.99%

This is why we don't need to assume they have a picture - the inference flows from his suspected guilt.

Do you think if the German police found hard forensic evidence of MMs death, let's say a blood trace that somehow could not be tied to CB, that they would conceal this?

If not, why would it be different for a photo?

I believe they would immediately announce any such breakthrough which proved abduction and 99.99% death - if only because there is no way in hell German police will leave the parents believing she might be alive for years when they can prove otherwise.

This is why I think there is no photo - rather there is a piece of evidence that makes police believe he is guilty - say more likely guilty then not but not BARD. And if he is guilty, the only logical inference is she is dead.

Exactly, but could the missing grove on the 30th image actually be there, but hidden by the light? it's not easy to tell with the available footage.
