Since the Prosecution computer forensic experts work from a mirror image of the HDD, I find it highly unlikely that the <snip> was *ever* able to 'check-out' the original HDD for examination.

(Dodging tomatoes now). I know our own KCL has her negative experiences with Keifer; so -- yeah -- he might be an A-hole. But he obviously has good sources, and, you know what? That's a journalist's job. You get on the inside, you stroke egos, you get the story. He has finely honed journalistic instincts, even if he IS biased against JM. (And maybe for good reason? ... Ouch! That was a green tomato. No fair!)

THAT's why journalism is (or used to be) the "Fourth Estate." ... Edward R Murrow, Woodward and Bernstein ... Uncle Walter after his visit to Viet Nam ... TRUE journalism doesn't happen by way of press releases. It happens through the eyes of those who seek/know the facts, synthesize the facts, ASSESS the facts, and write the facts. Even if the "public" doesn't LIKE the facts.

In J-school pedagogy, this synthesis and assessment SHOULD be without bias; but that horse left the barn decades ago. Don't get me started on E-Journalism and the Blogosphere. Bleh. Label it as opinion. State your sources. Otherwise, sell it on e-Bay.

Kiefer is MAYBE getting his "inside leads" from the DT; but, most likely he is getting these 'tips' from a few folks in the court house who clue him into new filings. Again, having those tipsters is what a GOOD journalist attempts to cultivate.

AZL: They wouldn't retry it--the charges would be dropped and she would walk. This would happen only if there was intentional destruction of evidence by the state (which does happen) and the evidence was exculpatory. If the evidence is child *advertiser censored*, IMO it would be slightly exculpatory because it would support JA's latest story.

She could walk if it is found the prosecution willfully destroyed exculpatory evidence. Double jeopardy would attach and she could not be re tried for murder.

Agree! I looked up Nurmi's credentials and he's quite educated and has a masters in criminal justice. The man knows exactly what he's doing.

Just FWIW and lest we forget, a person's education has nothing whatsoever to do with their character. JMO

Michael Kiefer is supposed to be an unbiased trial reporter for the publication. He's supposed to attend the trial and report the happenings. He far passed that boundary a long time ago. His reporting is highly biased and slanted toward one side. I'm sure you know which one. And yes, you're right, he's just doing his job by getting good sources and getting a lead. That information seems to get to him before anyone else, sometimes questionably, seems to be more on the defense team than it is on him. The defense wants everything under the sun under lock and key unless it's something that will benefit them, then it's passed to him within the minute it's filed.

If he wants to be an investigative reporter, or an editorialist, than he should do that instead.

He also seems to keep no sources in the prosecutor's office. Just the defense.

If Kiefer wants to print his articles under the opinion section then his articles would be more appropriate. Journalism is supposed to be just about the FACTS pure and simple. FACTS. That's it. All of his articles reek of bias and agenda. When I read about articles on cases I just want to read about the facts and what happened not a philosophical diatribe.

Things I thought of as I read this with utter fascination:

1) I wonder if all of KN' s latest antics/motions aren't just ways to keep the clock running for $$$ and/or to protect his "reputation". I sincerely don't blame him for despising his client yet I am amazed at the lengths he is going to in order to secure a mistrial or LWP/LWOP sentence. Self-serving no doubt but I'm thinking (praying) it all may blow up in his face.

2) CKJA may have a way with words bit it's obvious she didn't grasp 7th grade English since she has no clue about how to break a word when out of room at the end of a sentence (sorry - I'm being petty but I'm just SO PEED OFF at this whole circus right now....) BTW - I betcha anything she is the type of person who corrects a person's grammar regularly (I know this may seem like "pot meet kettle" but again, I'm JUST SO FREAKING UPSET at the latest developments).

3) no wonder the killer has Carpal Tunnel/tendonitis given how long this letter is (and no doubt countless others have been). Poor thing.

4) if you have not taken the time to read her complaint/motion/whatever this communication to JSS was, I highly recommend you take a moment to do so. It gives great insight into the self-entitlement mindset of this nut as well as further understanding of how challengged and frustratied the DT must feel every day. While I simply detest their latest strategies, I now have a modicum of empathy. Maybe.....
