Defense lawyers are obligated to offer BPD to the jury as a mitigating factor in the retrial. If they didn't do it the appeal lawyers would argue ineffective counsel. The defense couldn't make a strong case for BPD to the first jury because that jury heard the argument for PTSD and they heard the defense cross examine the state's BPD expert. The next jury, if indeed there is one, will hear a much different presentation. imo. moo.

I was watching that truly cerebral tv show tonight..Dance Moms.. While fast forwarding through commercials, I saw the clip for the upcoming Lifetime movie about the case.

I am furious the title is that murdering wenches name! I really wish they'd call it The Travis Alexander Story ...make it more about domestic violence perpetrated against men.

Everything I've seen online says it's a mental illness. Not the same as legal insanity, but a mental deficiency nonetheless. The defense isn't using it to negate appreciation of right and wrong, but as a mitigator.

What is really disgusting to me is that there are many people living with BPD and PTSD who will never physically harm another human being. For the DT to imply that this is what caused JA to do what she did or played a hand in it is not only disgusting, it will promote misconceptions of mental illness in general and set us back in the effort to educate the public.
