Can you tell me if have this right in layman's terms?

And, begging a 'request for oral arguments'...which may have gone along the lines of..."But, but, Judge, LF misspoke on behalf of the WHOLE DT knowing about the exact nature of the probationary terms..."

Me thinks the DT doth protest too much ...

But, but, but, ... Daddy ... it was not us it was them. We did everything right and have a near perfect track record ... it was the big bad SA and that HHJS. Blame them. Wah, wah, wah!!!

We are highly ethical and would not game the system and not be deceptive with the Courts ...

Wonder if there are other implications in the works of the DT questionable 'crossing the line' operations? ... or is it just that CM's image is likewise tarnished as he heads into the sunset?
 
Wow, that denial was fast! I think CM's reached the very end of his 'good ole boy' rope. About time....wonder if this will open Lisbeth's eyes? His ego is going to ruin her career before she even gets out of the gate...
 
Maybe it is also JB damage control to preclude the Florida Bar from ruling against him since the Appeals slapped the DT just like HHJBP? An indictment against them.

Seeding some doubt and plausible deniability ... I did not know, did not understand or, did not remember -- so he wasn't consciously gaming the system.

Could be. Since they were denied the opportunity to orally argue, there's no telling what "fact" they would have explained in relation to Mr. Baez' understanding of Ms. Anthony's "probationary period", and thus, we'll never know. All I know is what I heard them say in court. And it was clear to me that Mr. Baez was well aware (sheepishly so), that he had mislead the court and the prosecutors on the issue. Apparently both Judge Perry and the appellate court saw the same thing I did.

But yeah, this was filed for some reason.....maybe many.

ETA: Back to this. You know, you may really be on to something with this. I would be very, very interested to know what the consequences of 'not being candid with the court' are, as indicated by Judge Perry, and backed up by the appellate court. If the consequences are serious (e.g., disbarment, etc.), Mr. Baez may well be shaking in his boots in a huge way.

Does anyone know what consequences could come Mr. Baez' way because of his lack of candor over this probation mess?

..i think this probation "issue" always was such a 'personal' thing for cheney-------he just refuses to get over it that judgeS, after he thought he had got RID of him, had the nerve to come back and not only amend his written Order-------but then ultimately win!

..i seriously would not be surprised if cheney DOES take this all the way to the Supreme Court now.

WFTV legal analyst Bill Sheaffer said it's possible the defense will ask the Florida Supreme Court to consider whether it's too late to fix the clerical error that led the Department of Corrections to put Casey on probation in jail.


"The question would be, will the Florida Supreme Court, A: weigh in on it, and B: stay any sentence until they weigh in on it?" Sheaffer said.
 
I haven't clicked on the TMZ link because I don't want to inflate their egos into thinking they are getting an exciting breaking story that everyone wants to see.
I was thinking our agreement was for someone to read or watch and then bring it back for the rest to devour.

I'm hoping that someone will do a recap of the story on this thread .....hint....hint

After all, :waitasec: we are arguing 12 months probation for check fraud that isn't even probation given the security concerns and profile of Offender Anthony. It isn't as if we are appealing a LIFE sentence for child murder. GMAB!

If this goes to the Florida Supreme Court then there are HUGE stakes behind this struggle ... it isn't about the legal principles around probation for sure ... but something far bigger than that.

To me it brings greater scrutiny on the DT motives to invest so much time and money fighting this ... which to me is reasonable and moot ... as well as just inflames anger towards Offender Anthony.

I probably should put this in the hearing thread, but I've been wondering if the SA is allowed to bring up questions of OCA's indigency at the hearing next week. Could they subpoena her? I suppose she would just plead the 5th.
 
Hasn't JB been unusually quiet of late? I did watch him on GR show (though his segment was a bit downplayed by the Libya event) and he seemed very different to me. Perhaps my imagination suspicious nature. Is he still in the middle of the CA thing and her whereabouts? Or fading into the background for some mysterious reason?
 
Since this probation for the guilty plea of check fraud was originally ordered before CFKC was declared indigent, is the DT doing appeals on their own dime or does her DT receive billed costs from the State like they do on the appeal of the guilty sentences for lying charges?

..according to attorney diana tennis--------the judge will ask about her $$$ situation, current, and future. i certainly hope that she's right!

..i want to see cheney, or lisabeth squirm when they have to answer to that..

Criminal defense attorney and FOX 35 legal analyst Diana Tennis thinks the judge will hold Casey Anthony accountable. “I think he's going to be pretty strict on the defense. I think he really wants, to the extent that he can whatever money she makes from this fiasco, I think he's gong to want coming back to orange county b/c we spent a lot of money on this case.”

Tennis believes at the hearing on the costs August 25th that Judge Perry will likely ask what money Casey will have coming in from a book deal, selling an exclusive interview, photos or movie rights and if she's got the big money deals we've been hearing about Tennis says Judge Perry will likely make Casey pay up immediately.

It was just an inflated very short article showing FCA in a cap and gown saying she is returning (:floorlaugh: ) to university and will be taking online courses to complete her degree even though she hasn't yet decided what that will be,
Also that she will be doing it in the comfort of her own home (weird wording) which has 24 hour security installed for her safety at all times.

Yawn, the usual Baez bullcarp...you didn't miss anything, honest.

I agree. Wholeheartedly. Yup, it's about money in so many ways..... Whatever she's sitting on right now as well as being stuck in Florida until her appeals on the lieing conviction fall flat and the depositions start rolling in. Once that appeal is done, FCA and her DT are going downhill faster than three fat kids on a sled, especially if she is in Florida. The lawsuits are going to be problematic once she leaves the state.
 
and having said that, I think the Sept. trial is going to be VERY interesting.....
