It’s to my understanding that 4/26 is his hearing. And that is IF it’s not continued.

However there is gossip, which I will not be sharing, all around town that has some people convinced that this upcoming court date will not be continued, this time.

Only time will tell.

Second pretrial date nears in McCauley case

I've never done the synopsis thing before, but here's my rookie attempt. Relevant future dates BBM.

"BERKELEY SPRINGS — The second pretrial hearing for Andy Jackson McCauley will be held Thursday after a motion for a change of venue ruling was recently denied.

McCauley ... has pleaded not guilty to felony counts of first-degree murder and concealment of a body.

An initial pretrial was held March 19, according to Morgan County prosecuting attorney Dan James ahead of the one scheduled for Thursday. During the first pretrial, McCauley’s motion for a change of venue ruling was denied by 23rd Judicial Circuit Court Judge Debra McLaughlin.

James said ... the court ruled that if a Morgan County jury could not be selected on April 16th ahead of the trial, parties would select a jury from Jefferson County on April 20. Those ... jurors would then travel to Morgan County for the trial. The trial is scheduled to begin April 26.

Probable cause was previously found by Richard Stephens, chief magistrate of Berkeley County...."

Plead not guilty. Held without bond.
Trial was set to begin on 2/2/21 has been continued to April 26. Jury selection will begin on 4/16 & jurors will be from Morgan County. If jury can’t be selection from there then on 4/20 a jury will be selected from Jefferson County. Those jurors will then travel to Morgan County for trial.

9/3/20 Update: A February trial date was scheduled Thursday afternoon in a case alleging a Berkeley Springs man murdered a local teen last May. Twenty-third Judicial Circuit Court Judge Debra McLaughlin, in May, granted the defense’s request for a media study to research whether to request a change of venue. The defense’s request for the study is due to their assertion that the “widespread media attention” of the case will keep their client from being able to impanel an impartial jury & from receiving a fair trial. With the survey not yet finalized, the Oct. 6 trial date has been moved to begin on Feb. 2, 2021, and at this point, it is scheduled to occur in Morgan County. Judge McLaughlin is expected to rule on the questions being considered for the survey in the next 10 days. If denied, parties will proceed to the Jan. 21 pretrial & the Feb. 2 trial. If granted, a “Plan B” will be decided.
1/21/21 Update: Trial has been continued & rescheduled on 4/26/21. 3/19/21 Update: Pretrial was held; according to Morgan County prosecuting attorney Dan James ahead of the one scheduled for Thursday. Prosecutors and defense attorneys will attempt to select a 12-member jury beginning Friday. The trial is scheduled to begin before Circuit Judge Debra McLaughlin on April 26. McLaughlin previously denied a change of venue motion from the defense.

If a jury cannot be seated from the pool in Morgan County, jury selection is scheduled to move to Jefferson County next week, April 20. The trial would still be held in Berkeley Springs.
 
Anything new on this case? Did they start jury selection or are they going to 4/20 in another county?

McCauley trial delayed until September

The murder trial of Andy McCauley Jr. that was to start this coming Monday, April 26, in Morgan County Circuit Court has been delayed until September 27. The decision to postpone the trial came during a pre-trial hearing in Circuit Court on Thursday, April 22. Courthouse sources said the trial postponement was tied to exposure of a primary person in the trial to an individual who tested positive for COVID-19.

Attorneys had, less than a week prior, selected a jury of Morgan County residents to hear the case. Seating a local jury has been a point of argument between the Prosecuting Attorney and McCauley’s defense team for more than a year.

Morgan County Circuit Clerk Melanie Shambaugh confirmed the trial change and said jurors who were selected to hear the trial will be notified of the postponement and will return to the jury pool for the remainder of this court term, which ends on July 6. That means attorneys will draw from a different jury pool for a September trial.
 
To keep my notes straight - I'm going to post this here. That way I won't forget to ask if there are any court hearings dates before trial. :)

COVID-19 case forces postponement of Morgan County murder trial - WV MetroNews

The trial was postponed because a primary person involved with the trial recently tested positive for COVID-19. The trial has been reset for Sept. 27.

Jury selection took place on April 16 in Berkeley Springs and a 12-member panel was seated along with two alternates. Court officials said a new jury will have to be chosen.
