Special grand jury indicts McCauley on new felony charge

A special grand jury of the April term of Morgan County Circuit Court has indicted Andrew McCauley Jr. on another felony charge after hearing a single case on June 17.

McCauley is awaiting trial on charges that he murdered Riley Crossman, 15, of Berkeley Springs in May of 2019, and disposed of her body on a wooded hillside in Berkeley County.

During this month’s special meeting of the grand jury, McCauley was further indicted on the felony charge of death of a child by a custodian by child abuse.

Indictment documents state that McCauley has been accused of inflicting upon Crossman “a child under his care, substantial physical pain, illness or any impairment condition thereby causing the death” of the teen.

Grand jurors indicted McCauley on that new felony, and for murder and concealment of a deceased human body.

This is a “superseding indictment,” said Morgan County Prosecuting Attorney Dan James. That means this recent indictment takes the place of a previous indictment.

McCauley has been held without bond in the Eastern Regional Jail since his arrest on May 16, 2019 on charges of murdering Crossman.

That murder trial is set to begin on September 27 in Morgan County. Jury selection for that trial is scheduled locally on September 17. Court officials and legal teams have agreed that if a Morgan County jury can’t be seated for the trial, they will select jurors from Jefferson County and bring them to the Morgan County courthouse to hear the trial.

BERKELEY SPRINGS — A second jury is set to be seated next month in the case against Andy McCauley, Jr., who is being tried for allegedly murdering a 15-year-old Berkeley Springs teen more than two years ago. An April jury trial, for which a jury was selected, had to be canceled due to COVID-19.

McCauley, 43, appeared in Morgan County Circuit Court for a continuance of an April pretrial on Thursday, during which the parties argued for some time on the issue of whether or not evidence of the cadavar dog used to locate Riley Crossman would be admissible at trial.

Ultimately, 23rd Judicial Circuit Court Judge Debra McLaughlin ruled in favor of the state to allow the evidence at trial. This decision was made after hearing evidence from West Virginia State Police Cpl. F. Edwards and Sgt. J.D. See about their investigation, as well as evidence located linking her to being transported and allegedly left by McCauley around the 5500 block of Tuscarora Pike and arguments by counsel.

Trial was set to begin on 4/26/21. Jury selection began on 4/16 & jurors will be from Morgan County. Jury: 12 jurors & 2 alternates. These jurors will be let go & a new jury will be selected. First trial was cancelled due to COVID.

4/22/21 Update: A pretrial hearing in Circuit Court on Thursday, April 22. Courthouse sources said the trial postponement was tied to exposure of a primary person in the trial to an individual who tested positive for COVID-19. Attorneys had, less than a week prior, selected a jury of Morgan County residents to hear the case. Seating a local jury has been a point of argument between the Prosecuting Attorney & McCauley’s defense team for more than a year. Morgan County Circuit Clerk Melanie Shambaugh confirmed the trial change & said jurors who were selected to hear the trial will be notified of the postponement & will return to the jury pool for the remainder of this court term, which ends on July 6. That means attorneys will draw from a different jury pool for a September trial. Trial is set to begin on 9/27/21. He was offered a plea deal of 25 years. No word yet on acceptance as of 4/26/21.

The murder trial of Andy McCauley Jr. that was to start this coming Monday, April 26, in Morgan County Circuit Court has been delayed until September 27.

As far as I can tell, there are no online court records, you have to call the courthouse.
So your date seem right since they have to do Jury Selection

9/17/21 Jury Selection begins. A second jury has been chosen in connection with upcoming murder trial in Morgan County. According to reports, a 12-member jury was chosen Friday. The trial that is set to start next Monday, 9/27/21. A motion to change the location of the trial was previously denied.
