The defense attorney is just another avenue of Croslin finger-pointing. "I didn't do it--but I know who did." We know that Tommy's own statements put him at the trailer at 10 pm (though we certainly shouldn't believe the reason he says he was there). And a lot depends on what the defense attorney means by the "it" that was "done," the "what happened." Nothing the attorney says--presuming his client is telling HIM the truth, ha!--precludes Tommy being an accessory or an accomplice or part of Joe's or Misty's clean-up.
