Will there be reporters at this hearing?

Will we have any way of following what is going on?

Since Terri attended the last hearing, why wouldn't she attend this one?
And what about Kaine? I know he's not obligated to attend, but if Terri does, it seems to me that it would look better if he did, too.

I am assuming that the hearing will be held before the same judge, Circuit Judge Keith Meisenheimer, but I can't find a docket for tomorrow on the Multnomah County Circuit Court site. Does anyone know what time the hearing is scheduled?

I think the best we have to go on is Gwenabob's information.

She is able to see times set aside for that day, (see posts 280 and 285 - thank you Gwenabob!:blowkiss:) so either 9am Pacific or 1:30pm Pacific. I don't think anyone covered the first one live, but I am sure we will get info from reporters sitting in at the very least.

I was under the assumption that a retainer fee was what was charged up front, to retain the lawyer. As the case moved on and the retaining fee got used up than the client had to start paying for the representing as the case moved along, of course no case in a criminal manner has started yet.
How on earth could a CDA know how much a case is actually going to cost, wouldn't a lot of them go broke practicing like that?

In my state, paying a retainer that the lawyer bills against is how civil suit attorneys operate but not criminal defense lawyers.

In my state, judges really, really don't like it when a criminal defense lawyer accepts a client and then pulls out before a judgment has been rendered. Since criminal defense lawyers can generally look forward to an ongoing relationship with the judges in their area, they are motivated not to piss the judges off.

Plus, there is the fact that most criminal defendants are unlikely to have more money in the future than they do at the time they feel the need to retain a criminal defense lawyer. The lawyers know that roughly 90% of their clients will plead guilty to something or be found guilty of something, which often has a huge impact on the client's earning ability.

It just makes sense to get all their money up front, before the client loses it all.

As for knowing how much a given case will cost, that is something they learn to estimate through education and experience. Over time, I'm sure they eat the difference a few times but overall, they seem to do okay for themselves.

At least, they dress like they are doing all right! When I had reason to be at the courthouse every day for a couple weeks, I figure out right away that it was easy to tell the difference between lawyers in private practice and public defenders based on dress.

Bringing forward gwen's helpful post for the hearing schedule for today.

Thank you, gwen.

The times given are Portland time. You can find what time that is in your time zone here:
http://timeanddate.com/worldclock/fixedtime.html?month=10&day=7&year=2010&hour=9&min=0&sec=0&p1=202

I have it set for 9am. Just look down the list for a city near you, and it will show you the time.

There is a hearing scheduled for 9:00 am that is estimated to last 3 hours, then another hearing at 1:30 pm estimated to last for 2 1/2 hours. When motions are filed, the moving party is asked to estimate how much time they think it will take, and that is where the estimate comes from.

Divorce Proceedings To Continue For Hormans
Terri Horman's Lawyers Argued To Postpone Divorce
POSTED: 7:45 pm PDT October 6, 2010
UPDATED: 9:05 pm PDT October 6, 2010

Lawyers for Terri Horman moved for abatement in August and argued to postpone divorce proceedings until the criminal investigation into Kyron's disappearance had ended. They claimed Terri Horman would not be treated fairly because of intense media coverage related to the search for the boy.

The issue remained unresolved and the judge ordered a new abatement hearing to take place.

Updated today at 8:02 AM

An Oregon judge will hear two pending motions on Thursday from the father and stepmother of a boy missing since June.

Judge Keith Meisenheimer will hear Kaine Horman's motion questioning the source of money Terri Horman used to pay her lawyer, Stephen Houze, an amount he claims totals $350,000.

Terri Horman says in filings that she will agree to a dissolution of her marriage, but is asking Meisenheimer to delay resolution of other issues, such as financial settlements.

I don't know it's if mandatory, but I know one person who will be there voluntarily, looking good and having a four bodyguard team and her lawyers surrounding her like she's #1 on the FBI's most wanted list.

I wanted to put this link here. It is the news clip about the hearing today, and they use stock video from some time back when Kaine had appeared in court. You can clearly see the 4 guards there.

Hope that helps!

Yes, I already know he had guards too because of another thread. Apparently that was downplayed as I didn't know that until yesterday. I don't think either of them need protection. At least Kaine doesn't show up with armed guards for a five minute hearing. That was the most ridiculous thing to date, clearly done to show how threatened Terri feels. Like I've said before, if someone wanted to hurt either of them, they would have done it by now, or are waiting for the actual trial about Kyron. We'll see high emotion there, not at their divorce proceedings, unless the armed guards are there to protect them from each other.

No need to needle me about this like I don't pay attention to anything but Terri. It's not going to change how I feel about anything with this case anyway.

I didn't see that. I saw Kaine walking in a corridor and some deputies walking nearby who may or may not have been connected with his party. There are deputies at the courthouse all the time. They do not guard divorce parties. They guard prisoners. I don't believe for a minute MC deputies were acting as "guards" for Kaine.

Okie doke. No needling going on here. Just making sure I followed up what I said with a link. That video showing up today just made it easier for me, because I have been searching for that link again.

Carry on :)

I saw on KOINlocal6.com that they are doing updates via Twitter. Is that going to be posted here? I can't look at Twitter at work.

I guess I can just check their website as they are updating there as well, but I'm thinking the Twitter feed might be faster. I don't know for sure.

And now I'm wondering who the heck that third person could be?!?!

The only person whom I think could even be possibly related to the issues at hand in court today would be Michael Cook.

And now I'm wondering who the heck that third person could be?!?!

The person who paid Terri's defense retainer fee maybe? To testify he/she really was the one who paid it or to provide their bank statement or swear that it is their bank statement?

I don't know.
