2010.12.03 Agreement: No Death Penalty, Life In Prison For Elisa Baker

Lies in those letters won't affect a deal made with LE/DA, imo. She can lie all she wants to some dude on a website...she just can't lie to LE.

I hear ya, but I find the next part of the chiefs statement interesting:

"....sound much like the same stuff that she's spouting to some other people."

The big question would be, could those 'other people' be LE?

If the letters aren't completely true, and it's not new to them because it's much the same as the statements she gave to LE , then I'm hoping that the deal is thrown out because of that. KWIM?

Maybe the cooperation is the Rape allegation...suppose EB lied about that!

I didn't think that allegation came from EB.

I really, really hope she told enough of a whopper at some point that voids the agreement

I suspect that lie will end up being that someone else killed Z.

I only hope that they can prove it

Yeah, like her husband dismembered the child with a chain saw, in the tub, wearing blue gloves that could be found under the sink and the gloves have only HER prints and DNA in them. That would do it;)

It didn't. That tip came from a source who overheard a second hand account from someone else (if you can follow that).

Now another news source reporting:

"The DA is not commenting on the terms of that deal but another source tells WBTV that prosecutors agreed to take the death penalty and life in prison off the table, if she would provide investigators with information about the little girl's whereabouts."

You have to consider the types of people that LE is working with when making a deal. There is lying and then there is LYING and not working within the agreement.

Informants lie to the cops all the time, they deal with them and use the parts they can verify.

If EB says she isn't a drug addict (a lie, but not really related to the crime at hand) but leads them to verified evidence and gives them access to the things they ask from her, and testifies when asked she has met the intent of the agreement.

If she planted fake evidence in attempt to frame Adam and then signs an agreement and leads them to false evidence no deal. Not the intent of the agreement, a judge would let them pull the deal.

Think of all the lies Cindy and George told in sworn statements. There are certain levels a court is going to look for. All criminals are liars, there would be no deals if they pulled deals everytime they could prove there was a lie told. You have to look at the larger intent.

If she said Z died one way (from an infection) and they find her crushed and fractured skull that would be a deal breaker.

But even then you would have to prove the fractures happened before she died and not during the dismemberment they admit to.

It is not a simple black and white issue.

But she did take LE to the Dudley Shoals site on Oct. 26. LE did a cursory (imo) search, and found nothing. If they found nothing in their first search, I don't see how the blame for that can he laid on her. It is possible that she didn't know the exact spot, if AB, or someone else, buried body parts at this site. But she did take them right up to the dirt turn area.

My personal opinion is that LE wouldn't have had the first clue where to look for body parts, gel liner, or the mattress if EB hadn't coughed up that info. AB sure isn't spilling anything.

I've been wondering for quite some time if perhaps AB doesn't have anything to spill.

I noticed EB's failed poly questions revolve around "Do you know who.......(did such and such).......?"

I'd love to see poly results for a more direct question "Did ADAM.......(do such and such).......?"

Now I think we have the answer for Atty Dubs being taken off the case yesterday - there was never going to be a death penalty after she showed LE where body parts and crime evidence was! (wasn't back in late October?)

I'd almost stake money on misreporting here.

The DA won't comment on the terms of the deal - and Dubbs won't even confirm the deal exists.

So, obviously, neither side is showing a reporter a copy of the actual deal.

We have no way of knowing what the unnamed source's relationship is to the deal itself.

I think we'll have to wait until the deal is published to make any sound conclusions.

OMG this is just preposterous!!!! I can hardly believe my eyes. No DP and no life???? What about justice for our little angel??????? I am just plain astounded. I put so much faith in the justice system in this case and am truly saddened now. And unlike some others I really did expect the DP for the torturers of this child.

It has been 17 days since they found the remains in the double hole in the woods. I would say they have most of the evidence back. Enough to make an arrest.

Now, if she made that deal before leading them to the remains - they may have incriminating DNA back now and that would explain why the AG wants to rescind the deal for EB.

EB, "You mean I had to tell 100% of the truth?"

I'm not following you, Wenwe.

Did I watch some detective being interviewed sometime around the christy road search state that EB was not cooperating?

Maybe I need to post this in the Questions for Lawyers'Thread but why would the death penalty and life in prison be on the table in the first place? To say I'm confused is an understatement and maybe it's because I'm so angry I'm not seeing the obvious but -

There are no charges after two months of investigation so why would EB make a deal if she wasn't charged? Why would the DA make a deal if the charges weren't sitting on his desk? So the conversation with her lawyer had to be "We will reduce the charges if. . ."which means charges of some kind have to be coming.

I'm putting my faith in LE here. There is a whole lot more to this bizarre case than we know now and may not know until it's over. I just pray that this isn't another Karla Homolka situation where the Deal with the Devil is just the beginning of the nightmare of things to come.

Probably true - we can't make any sound conclusions as to what the deal was but what we can conclude is the deal is such that the DA blew it big time. Otherwise he wouldn't be trying to get the State's Attorney General to rescind it. Thats all I need to know about this deal - he messed up big time for whatever reason.

I don't recall a detective saying that, but the only way they would have ended up at the Christie Rd. search site at all is if EB was cooperating. And video clearly shows her sitting in the SUV at that site.

maybe it was during the search of the house I don't remember but I did hear a plain clothes detective state that she wasn't cooperating. An older thin man.
