2011.01.05 Hearing TES Volunteer Computer Subpoena

I agree, this motion was too broad. I have been a transcriptionist for 30 years, recently retired, and I find it had to believe he didn't ask about photos...there is a format that is ingrained in every investigator and it's basic 101 to eek out every possible itsy bit of info, Although, I don't think it rises to ineffective council. That said. It is my opinion that this is a very dangerous road to go down for Baez and crew as it could bring up LB and JL. I think they have to ask themselves if it is worth it. My answer is no...however, I do think if a motion is written correctly, the photos will come in and it will only be good for the state. I am NOT an attorney.....and this is just my opinion.

Please stay NJ...and would love your input.

Respectfully, what photos? Thus far, there is nothing to suppose there are more photos..except for Mr.Baez's wishful thinking and the hope that he could get a little snooping in on JJ's blogs and his anti defense leanings.

Mine too...causes me to have a panic attack! :floorlaugh:

Especially since I have to be up early in the morning...have to stay with my mom who has alzheimers and my dad has to be taken by air flight to a main hospital for an aorta embolism. He is 86 and can't under go another surgery (has had 3 bypasses) Hubby has cancer so I'm all over the place right now...I'll try to check in if my new phone cooperates.

In this case you just happen to be the innocent bystander. Broken quotes happen most often when someone quotes a post, and in the process of editing/snipping it they accidentally clip out a bracket ("[")of the quote function. Since the computer is looking for matching quote commands (i.e. beginning & ending) to figure out how to display the information it gets confused because something is missing.

IOW....its nothing you did. Someone quoted one of your posts and accidentally wiped out a bracket in the process. All the subsequent posts were trying to match up beginning & ending quote commands and couldn't figure it out because they didn't have matching pairs. No biggie. ;) HTH.

In re. the bold: I can't say that I agree, but I am no lawyer. I think that was the whole basis for HHJP's ruling - that he wasn't going to allow a fishing expedition for something that may or may not exist. And I sincerely doubt they do exist because we have seen many photos of his search at another location (Jay Blanchard Park). These were all taken and posted before the remains were located. I see no reason to believe that he would not have shared similar photos of the Suburban area, if they actually existed. Therefore, I tend to believe they do NOT exist.

I think HHJP ruled according to the law. It is a dangerous thing when the courts start allowing personal computers to be searched without probable cause. And I do not believe that Baez established probable cause. The application for subpoena duces tecum included not just photos, but all of his posts, too. Really scary road to travel down w/o proof that those photos even exist and HHJP gave Baez every opportunity to offer proof.

ITA! When JJ was posting here at WS, he was anxious to help in the search for Caylee. He posted pictures of anything found. But, his searches were mainly in and around J.Blanchard Park. All the pictures he posted were of items found in J. Blanchard Park. If he searched on Suburban Drive and took pictures, he didn't mention it, and I would think he would have mentioned it as he was letting us and locals know what had been searched and what hadn't been searched.

I think JB is trying to find something that just doesn't exist. In the process he's harassing a citizen who volunteered to search, and trying to make it appear that the citizen in question has something to hide.

Other searchers have also stated there was water in the area where Caylee's remains were eventually found.The second search done by Texas Equasearch in early November tried to search that area and called off the search as they almost lost one of their ATVs. I remember Tim Miller being interviewed on the last day of the search and saying how they had hoped to search that area but it was too dangerous to attempt it with that much water there. There was no way Tim Miller could have known then that a little more than a month later, the water would have receded and Caylee's remains were found there. There's too many people who've stated the area where Caylee's remains were eventually found was under water for several months.



JB is so obsessed with the remains site, I think he's basing his entire defense on something that didn't happen. He wants to present to the jury that sometime after Casey was in jail, someone placed Caylee's remains where they were found. But, he has no way of proving that was the case, and the facts suggest that Caylee's remains were likely placed there in mid to late June 2008 and remained there until their discovery on Dec. 11, 2008. It's like JB is trying to put a square peg in a round hole.

Okay, the case is over and ICA is found guilty and given LWOP or the Death Penalty.
The experts have testified and proven there was standing water, the remains were completely skeletonized within 2 weeks, and had been dragged over an acre of land before flooding. The heavier bones have been proven to have plant growth securing them since early July. The decomp in the trunk has been proven, the death band hair introduced and accepted as evidence, and the duct tape was indeed wrapped around this baby's face. The garbage bag and white bag did indeed come from the Anthony home, as did the duct tape.

At this point, how interested is an appeals court in whether or not JJ has photographs of Suburban Drive, since he did not find the remains and was not in the area when they were found and in fact does not know exactly how close to the remains when he was searching? And internet searches has found no photographs posted taken by JJ of Suburban Drive?

Sorry, not a legal mind, just a logical one.

In the final analysis, that scenario is completely logical.

As I've said in previous posts, I doubt JJ has photos taken of Suburban Drive prior to Caylee's remains being found. JJ appears to have been an eager searcher, who may have searched in the area of Suburban Drive, but by his own statements (and statements of others) there was an area that was knee-deep in water and therefore not searched. This area turned out to be the area where Caylee's remains were eventually found. It doesn't matter if he searched about 20 feet or 200 feet from the remains site - a miss is as good as a mile.

When the trial is over and your scenario is proven, JJ will be just a footnote to the case........one of many who searched for Caylee, but one who became known as he posted pictures and comments to various forums online and had his own website for a period of time.

I love your logic and I too would guess that a lawyer's unsubstatntiated belief that Joe Jordan has relevant/exculpatory photographs on its own would not in the least influence an appellate court. Appeal courts generally do not retry cases. I think any future appeals lawyer would have to establish that J Perry's ruling was legally flawed and importantly that it was predudicial to his client's defense. i.e would have effected the outcome of the trial. Given all the evidence in this case, I think the Joe Jordan issue is a storm in a tea cup. And wisely cos "death is different", J Perry left the door open for Baez. Lets see if he walks through it.
