Wow, he outright lied. He has to get into major trouble for that. I don't think HHJP is going to take "oops, I forgot to read EVERYTHING" as an excuse either.

And now I want to turn into a five year old and sing song, "Baez is in TROUBLE, Baez is in TROUBLE!"

I've never wanted it to be Friday so bad in my life! And I suggest that LOL stands for Lords of Laziness!

I'm sure that during the long traffic hold-up Mr Slabaugh could have phoned in to JB to express his concerns about getting there on time ( although he was 5 hrs later than he thought) and JB or CM could have picked up the phone to call HHJP- from what we have seen HHJP has made himself available by cellphone and email, and a message could have got to him to ask for a one day extension.
None of this happened. You have to wonder why...
HHJP has already addressed his lack of compliance, so why do they think he is going to be willing to re-visit the topic?

1 800 Dominos Pizza, thirty minutes, or it's free....that is who they should have sent, the Pizza dude, and maybe the clerk would have kept her window open until 5:03!

OMG OMG...Just got to the end. Wanted to THANK everyone for reading the motion. I just cannot subject myself to either reading nor watching the "duh" fense AT ALL. I have not laughed so much in months! Bless you all, and I tried to "thank" everyone, but left a few out...

Yeah, and he didn't know about the traffic debacle when the judge asked him about it. Took him 5 days to come up with this - excuse....... yeah, sure. LOL with that CM!

I thought the [unusual person] explained to Judge Perry, in open court, the reason that the stuff was late was because he had been waiting for a report or something to those words, right??

And, let Judge Perry ask for a toll ticket as proof for the that nasty, thwarting traffic.............

If you are stoopid enough to lie to HHJBP in court you might need to remember your lies before you write a motion. This may have been answered and I missed it. Why is CM writing this and not JB? JB needs to put on his big boy panties and man up.

Someone upthread (sorry, can't remember who it was - this place has been really fast & furious tonight!) said that it was OK for any member of the defense team to file this. My guess is Baez was too chicken to defy HHJP himself (yet again)....

The 12-page motion also provides additional details about what defense expert witnesses will testify about during depositions and, presumably, at trial.

"The defense has, because of the intervening actions, provided the above information in an effort to, not only fulfill the requirements of the court, but also show a good faith effort in complying with this court's directions," Mason wrote.

Just saying, preview of Fridays hearing;

Cheney is calling hisself "assistant to counsel", "hey that's me .... look at me judge, I am assisting myself and still didn't get it right. But hey judge, make sure you sanction just Jose cause I have gone 40 years without being sanctiond and I want to go out on a bang, if ya know what I mean, judge. Where is Judge Easton .... he wasn't suppose to leave ...." "Sorry judge, Jose wasn't in the office to sign this so I did because the engine was running on Williams car and he was late in leaving, then had traffic ... ya know judge all those damn tourists driving down the interstate, getting lost. William didn't know the backroads. And he wasn't sure his gas gauge was working properly, didn't want to run out of gas at the Amscot. Those tourists .... thwarted in traffic he was. Trust me judge .... wait, my hearing aid isn't registering, could you repeat that .... Judge, this wasn't due until December 23, 10 not December 15, 2010. It was delivered eight days before it was due. Dontcha remember judge"

Ladies and Gentlemen. I apologize my above scenario was a tad off on the details, I heard it from our managing partner at my firm who took note of the hit 🤬🤬🤬🤬 was dealt. Actually the entire OC legal community heard about this ruling. And in some cases it changed procedures for filings. Please see the link below. Please note my firm is NOT 🤬🤬🤬🤬. And yes that's the acronym the locals around here use for this firm. But basically the filing was not 15 minutes late but only ONE minute late. And Carney ripped them a new one.

HHJP specifically asked Baez when he was one hour past the deadline did it occur to him to pick up the phone and ask for an extension and
Baez said he didn't think it would be an issue. So, IMO, I don't think it matters at this point if the 'courier' left at 8am that day and was in a terrible accident where he lost his arm and they included the arm on this motion as an attachment. IMO, Baez showed his contempt for the court when he stated he didn't think it mattered to obey a court order, and that's why he got slapped with sanctions.


I was just talking to a friend about him saying this! I think many took it that JB was only an hour late, but I knew and you can bet JP knew what he meant was when you were just even one hour late, what did you do. Answer - nothing! Much less when you were about 24 hours late!

I hope JP doesn't rule on this 'request' till Friday and does slap additional $500.00 on him and $500.00 per day to CM too. Plus, contempt would be nice - but I can almost guarantee he will with all his legal finesse rip them a new one.
