2011.03.03 Motions Hearing - #3 (PM)

I sooo tried! I couldn't get it to work! I can look at news videos, but they are all like 3 minutes long and I need to see the whole thing as it happens!!!!

Sorry if this was already asked and answered but what is the definition of “Agents of the State”? As a typical American with a standard, middle, middle class upbringing and a reasonable moral compass who knows the difference between right and I wrong, I am an Agent of the State, aren’t I? Aren’t we all Agents of the State”? By being honest and telling the truth, you are doing the right thing and are therefore enforcing the rights, laws and privileges of being a citizen in society, yes?

Once a person has invoked their right to counsel it cannot be circumvented. Casey had retained Jose - so therefore nobody in any law enforcement capacity can try to elicit statements or information from her without her attorney unless she explicitly waives the right (and that would be a process to insure that she was doing so knowingly, voluntarily etc.)

With that said, law enforcement sometimes has others do the work for them...i.e. the jailhouse snitch, or a PI. The concern here is that the Anthonys were acting as basically law enforcement, with their cooperation procured by LE in order to elicit statements from Casey without her counsel present or even aware of it. When information is obtained in this way it is inadmissible - it violates a Constitutional Right.

What the state was trying to do was show that it was the other way around. The A's were pushing LE to try and get a meeting with KC for them without Baez there, or for her to send information in a letter or something. LDB was doing a good job of bringing the focus back to that - someone testified that the A's were told that LE could not approach KC because she had a lawyer no matter how bad they all wanted information on Caylee.

In the end it looks like the A's were trying to be agents for Caylee only and that LE did not put them up to the task as acting on their behalf.

Lee especially made this clear. George lied about it, but in the end, LDB brought him right back to it.

She was soooooo disgusted with Lee. He was concerned 1st and foremost about Caylee. ICA can't stand that!!! She is so enamored with Jose and gang because all they care about is HER! In her mind, as it should be. Must infuriate her to see CA and GA get all weepy over Caylee.....

You would think the defense would have clothes ready for her whether they came from CA or not. Being the vain type, IMO, I wonder what she thinks of having to wear a sweater two days in a row and if it gives her any indication of what her "team" really thinks of her. If I were CA, that alone would be a red flag for me...

Very emotional day, but my reaction was opposite yours. He's done nothing but lie and spit on Caylee's memory and has said he'd do anything to get KC out of jail. It's twisted of me, but seeing his misery made me me think: good, you (unusual person) I hope it hurts like hell.

Thanks Nacho - I had it typed up in queue and couldn't help but think I was confusing the last name (with Robyn). That's my recollection as well. Gabriel Adam.

I couldn't walk away! I think George felt like he had been punched in the stomach. He knows what he is doing is so wrong and that is why I can not feel bad for him. I tried to when he started to cry and Casey showed no reaction to her fathers cries. He is doing all of this for her and she doesn't care that it is killing him. These lies are killing him!!!! And Casey is okay with that.

I don't know? This case is really just HARD!

IMO this whole family has been built like a house of cards.It reminds me of the 50's and 60's and middle class families that had to keep up with "The Jones". Every single one of them seems to have the need to pretend who they really are not. By now they have lost all concept of family and accountability. Lee just might be tired enough of the games that he possibly can survive this with some normalcy.

Not only will this be a lonnngggggg trial, but the appeals process will be even longer. I see three choices for us all to make it through til the end...

1. Mind your manners and follow TOS...lol
2. Buy stock in popcorn, chips, coffee and whatever else you like to drink and munch on. Stock up at the grocery store, supplies you know...
3. Put in alot of overtime if you work so you have the hours to stay home, follow the case and hire someone to do your laundry and not so favorite chores.

The As weren't out to dig Casey's grave...they just wanted to know where Caylee was.

What have we learned today??

1) The BOMBSHELL today has to be that Mark Hawkins wore a "wire" for LE while with the Anthony's and in Jose Baez's office.

2) George Anthony is most definitely going to come out of this trial with at least a contempt of court charge and very likely perjury. The man is out of control.

3) Linda D-B brought everything FULL CIRCLE with one question to George Anthony that had all of us in tears, including me, and that was " Are you an Agent of Caylee Marie."

4) Jose has put himself on trial. This hearing was all about HIM!

5) Lee Anthony did a great job today.

6) Casey Anthony looked absolutely devastated when CM took away her pad and pen. She seriously looked lost without it.

Can't wait to see what tomorrow will bring?

I think one other thing I learned today, is how utterly unqualified jose angel is to try this capital case. He came dangerously close to piercing attorney client privilege while gabriel was on the stand and would have, had it not been for Judge Perry.
