Frye hearing: the validity of scientific methods.

That is not what I feel I witnessed this morning.

Talking about how Jose has been vilified! As you sat and watched this how did you feel?
I feel sorry for Jose. The prosecution has everything and the defense has nothing.

First, I see someone trying to question an widely acceptable form of science that has no idea on how to go about it.

Second, Feed sorry for Jose? Since July 17, 2008 he has received more free advertising for his law firm than he could possible ever hope to be able to pay for. Publicity and word of mouth is what brings clients in for these lawyers. The more these guys keep their name in media, the more clients they get. Vilified? Probably. But he put himself out there for it when he does stupid things. He should have found her appropriate representation the minute the released this case was more than just a parking ticket.

Speaking of the length of the hair how much of it has to be "dark"...D. Simms establishing that part of this testing is their opinion.

Asking about when she has been mistaken.

I believe Jennifer Barringer was the lawyer in the Phil Spector case who was charged with felony assault on her husband which was dismissed because the husband after reporting the assault at the hospital refused to work with prosecutors. She hit him with a bottle or something if I remember.

So yeah I bet this Barringer woman would fit right in with this cast of clowns on the defense.

Yep...http://www.nypost.com/p/news/local/...hubby_dismissal_bottle_OOKvuSJf5pYf8R6hBkbbAP

and sure to become ICA's new BFF :blowkiss:

So do defense attorneys always show up so ill prepared or just the pro-bono ones?

I believe DS thought this was a deposition/cross examination and not a FREY hearing.

MOO

So does their mean if my cheese loving stepdaughter was to stop eating cheese, her hair would lighten from almost black to blond? LOL

OBJECTION- Relevance to the FRYE ISSUE. Ashton needs to record his voice and hit a button.

DCS going off track again. Questions of quality assurance in examining the hair in this case is not a matter for Frye. JA's objection sustained

  • #530
I keep waiting for her to say "How about that Mr. Fung".

Less strong ??????????

wth................

Jeff Ashton's objection is "Frye" over and over again. He is explaining Frye again, right now.

I have said this before: in my world of paycheck to paycheck minimum wage...we do not get this many chances to get our job wrong. D. Simms has this hearing hijacked. IMHO.

This witness is being asked how often she is wrong! How about you miss simms? How often are you wrong?

  • #533
She obviously has nothing. Give it up.

  • #534
If this is how the trial is going to go, there might be a world's record set for number of objections during a trial. Not that I blame JA, but sheesh. Why can't HHJP reign this in?

Respectfully Quoted Aedrys

IIRC, wasn't there velveeta wrappers in the trash! Hummm?

HUMMMMM!? Someone call that Jennifer lady! SOD was eating velveeta in the pontiac.

ETA: I want to argue that Velveeta is NOT real cheese...

Q: With regard to root banding you don't know what causes it?
A: No Mam

another sustained objection - who's been counting? I feel like we should have scorekeeper and timekeeper on this game just saying

JA: With all due respect to counsel . . . Experience is not part of the Frye
HHBP: Sustained

DS has a bad, bad case of stoopid!

:maddening: The break worked for DCS! She's trying to be FOCUSED by going after substance like proficiency testing, witness education, experience & acceptable scientific standards! FINALLY!:rocker:

Joypath!!! Are you sure??? I've heard five sustains so far and my audio wasn't on for the first bit.......:floorlaugh::floorlaugh:

:maddening: IF she knew WHAT the etiology of "root banding, post mortem" was.................SHE'D BE "THE" international and multi-quoted EXPERT! :banghead::banghead::banghead:

BTW: IS it me or is DCS a bit confused regarding the basic principle of FRYE?
