so defense wants 1129 struck on the basis of:

pre-trial publicity (he believes ICA guilty altho he also believes he can set that aside and believes her innocent)
LE issue - juror will give them too much weight to their testimony but CM did not ask follow up question about treating LE equal to other witnesses
death penalty ? from AF re: child 1120 answered 'can't say'

LDB - says pre-trial publicity is the only thing the court need deal with and the juror answered it several time

JB - back up with cases supporting his case on the juror vascilating

HHJP - Mr. George asked follow up on LE and juror indicated he could give weight

pre trial publicity (dilbeck) not required jurors be totally ignorant of facts and issues involved. In these days of swift widespread communication an important case can arouse the interest of public that will serve as jurors that are likely to serve will form opinions (I am sure I mis-quoted but that is what I got). Impossible standard to expect that they will have no opinion - if they say they will lay it aside and base verdict on evidence that is good enough (again misquoted but gist).

motion to have juror excused for cause denied - does defense use challenge (JB may backstrike later)

A lot of jurors have done that sort of thing in the past. Sad but true. I've heard things such as "I just didn't like attorney 🤬🤬🤬's theatrics so I voted against that attorney's client." "I couldn't stand his condescending attitude." "Too much display, too much putting us down." And the list goes on. I wish that were not true, and it never ceases to shock me.

But it is true.

JUROR RECAP #1129

Pretrial Publicity: *Has read about the case in the St. Petersburg Times and Orlando Sentinel in 2008. *Knows Caylee's name, that she was reported missing and her mother was arrested. *Heard about the car odor. Remembers hearing Cindy say it was a "strong odor" and Casey saying "it was a pizza box". *Has watched Nancy Grace "while channel surfing" and saw photos of Casey's "partying days". *Remembers hearing about a meter reader and a nanny but doesn't remember any details. *Saw court proceedings regarding what kind of evidence will be allowed at trial, but doesn't remember any details. *Admits he's formed opinions on the case. *Said "I believe she might be guilty" but his opinion is not firm and he could remain unbiased. *Has not blogged or read any blogs on the case. *Last time he heard about the case was this past weekend regarding jury selection. *Doesn't recognize any of the defense or prosecution team members from TV. *Has seen George and Cindy Anthony speak about the case- doesn't remember details. *Has seen "the guy in the cowboy hat" (Leonard Padilla?) but doesn't remember any details. *Is confident he could set aside previous opinions about the case.

Death Penalty Stance: Against it. *Says he's against it because he's worried he could make the wrong choice. *No political views or religious views on the death penalty. *Not a member of any church or religious group. *Believes DP is "an individual/personal decision". *Seemed wishy-washy on whether or not he would recommend death penalty for the murder of a child, murder of police officer, etc. (said "I can't say- it's a maybe").

Misc.: *Has not lived in Orlando since 2008. *Has been on a jury before (in Texas) for a smaller criminal case. *Works in the insurance industry in Largo. *Has been employed there for 15 years. *Doesn't know anyone in law enforcement. *Doesn't know anyone who has been a victim of a crime, or committed a crime. *Has heard of The Innocence Project- no opinions on it. *No opinions on whether or not he serves on the jury- doesn't care either way.

Family: *Single. *No children. *No pets. *Several cousins in the state of Florida. *1 brother in Ohio.

Education: *Has some paralegal education background experience from 1992.

State: No objections. Defense: Objectionbased upon 1) Pretrial publicity (Baez: "He has a vast knowledge of the case".) 2) Issues with his response to the DP question regarding if he would immediately recommend the DP for the murder of a child (and his response was "I can't say-maybe"). 3) Statements regarding law enforcement (said he would "probably give more weight to a police officers testimony")

Judge: Challenge denied.


Defense reserves the right to use a strike at a later time. Not challenging now.

Called back for next round.

I really can't believe they're calling this guy back. I actually thought the defense's objections were valid!

Judge mentions things have been suppressed in this case that haven't been revealed yet.

Someone has been quoted in the news about suppressed evidence. What could it be?

Number 1192 is in for now. But JB reserved the right to a pre-empterary challenge at a later time.

What do you guys think- is this juror through to the next round, or no?

WOT! What next round? Are we going to go through this again?

I'll have to see you guys at Christmas, when I expect the actual trial will start. I don't think ICA will make it that long, she's falling apart already.
