Its quite ironic that we were here to talk about a possible violation of the rule of sequestration.....I guess Spitz shouldnt have been giving those media interviews....

Baez is losing his train of thought - just audibly harumphed. This is everyone else's fault but his.

He sat in on hundreds of depos...I really am not sure I can watch him anymore. Accusing the state of not doing their work.

HHJP - you think you can pick which court orders you will and won't comply with. That's not gonna happen here. To be frank both sides have been game playing - this isn't a game. The reason the order was entered was because I didn't want to be here. We have experts with major opinions not contained in their reports. The easy thing is if an opinion comes about you disclose it. Not hard to do.

What is the remedy? Quite ironic we were scheduled to talk about a violation to rule of sequestration. All cases seem to say excluding witness is a harsh rule not to be done except in most aggravating of circumstances. This was intentional, not an inadvertant slip, should Ms. Anthony be punished as a result?

Contempt, an instruction to jury concerning violation that has occured, what other witnesses are available for today? Witness is to step down to have deposition taken. HHJP will entertain a possible instruction should the State choose to draft one.

whoa, what happened? I'm intrigued but totally lost here. What was the issue about sequestration? It wasn't about a juror was it?

Well, Mr Baez, to be quite frank both sides have engaged in game playing. The reason the order was entered because I don't want to be in the position I'm in now. We have experts who have opinions . . . Even if it happens at the last minutes. So here I am faced with "what is the remedy."

Now talking about the rule of sequestration. (Guess HHJP is referencing JB's consultation with the current witness two nights ago.) "This was not inadvertent." Now he's citing case law and mentions contempt. (sorry reception is breaking up now)

This is what we're going to do. We're going to stop at 1. This witness will step down. I will entertain a possible instruction if the state wants to draft one. (out again) about this violation and I will decide if I want to do it.

They were there early for possible breach of rule of sequestration, did I hear that right? Could we lose a juror?

IMO

I wish he would let me know! Suspense is killing me. There are so many possibilities! :crazy:
