I do wonder, though, how the judge will handle the request for a special investigator to investigate the leaks that were visible on the latest Dateline episode. The judge invited the defense and prosecution to make the request if they felt it was necessary and now the request has been made. If the trial goes forward as planned in early August, will the special investigator do his/her work during the trial? And what would be the consequences if the leaks were identified and came from the prosecution side or defense side? These issues have to be addressed by the judge, as the appointment of a special investigator is now likely to move forward, and how Hippler handles this matter will likely be a significant issue on appeal in this death penalty case.
Could the investigations run concurrently if they are headed by a specially appointed LE entity? I believe we saw that in the Murdaugh case and the Delphi case as well.

There are going to be many automatic appeals on this DP case regardless, but I think Judge Hippler will make the correct decision. He is highly pragmatic and well versed IMO.

We have heard almost every excuse from AT about why they need a continuance, EXCEPT that the dog ate the 68 terabytes of discovery. She still has a few weeks to use that one though. She is holding onto it, like I hold onto a Mulligan when playing golf, in the event I need it on the second or third hole. JMO

I haven’t been following this case as closely as i did before BK’s arrest other than watching some of the YouTube and tv airings on the actual crime itself. (Haven’t been following the legal battles.)

So what’s AT trying to accomplish here. I’m asking in all seriousness. WHY does she want the delay? Is she REALLY just not prepared?!?! Hasn’t been doing her job? I mean come on! It’s awfully embarrassing that she says that out loud 🤦🏻‍♀️🤦🏻‍♀️🤦🏻‍♀️

Wouldn’t BK want this trial to start on the date planned? If i was as a defendant in jail, I’d want to get it started right away. Especially if innocent (i don’t think he is), but even if not innocent, seems like any defendant would want to get started. To know what their future life will or won’t be like. No?
BK's best chances of escaping the DP are on this side of sentencing. The longer she can delay the trial, the greater the chances of something she can use to get the DP thrown out, like we saw in the Lori Daybell trial.

So she says she hasn't been able to interview the neighbors of BK's great grandparents and so... facetious me, yes, but she's every bit as ludicrous. She has done all her homework because she knows the judge can call her bluff, she's just pretending there are new terabrytes and old medical records she still needs to explore...

But she hasn't produced a single specific.

IMO Judge Hippler is gonna get real specific here for her.

Swing and a snap, I swear I can already almost hear it.

FWIW DD has only delivered to me in their personal cars.

At one time, I thought that perhaps the DD delivery was made to the back slider, based on a supposition from Gray Hughes, using gps coordinates from DD, which contained a number that could not be discerned, with one of the guessed digits placing the delivery at the back. However, that was never a given, but only a thought, and after seeing the traffic stop video, where the woman told the officer that she takes hydrocodone for extreme pain from Fibromyalgia and arthritis, I am now of the opinion that it nay have been very difficult for her to negotiate the hill on the back side, especially in the dark, and so I believe that she very likely delivered to the front door, and was perhaps parked in the driveway area, or the street in front of the house. JMO
Was the DD driver taking hydrocodone? I was prescribed hydrocodone when I had a knee replacement. The surgeon instructed me to resume driving only after I quit the pain meds.

I wish I knew and answer that question and whether they are required to have a dash cam. I've never used them either. Maybe there will be a DD driver on here who can answer that.

At her traffic stop in Sept, 2024, she stated that she was taking 10mg of hydrocodone, but whether or not she was in Nov, 2022, is unknown. JMO

No, they do not have signage on the vehicles. I wouldn’t be surprised if they have a required dashcam. It’s just civilians picking up extra work.

I had the same concern on June 11 after reading the States Opposition to Defendants Motion to Continue:

In AT's Motion to Continue, she goes beyond mere concern that the leaks will taint the jury pool. Indeed, part of the reason she wants the continuance is so the prosecution can be punished if they or law enforcement are responsible for the data leaks to Dateline or James Patterson.

According to AT in her Motion to Continue:

The Court has already acknowledged that the Dateline special exposes a likely violation of the non-dissemination order, and Mr. Patterson’s purported “unmatched access” to sources including “local law enforcement” suggests that multiple unauthorized disclosures have occurred. Depending on the results of the investigation into the leaks, a continuance may be inadequate. Once the source(s) of the leaks are identified and the full extent of misconduct revealed, the violations could warrant remedies more serious than delay. At the very least, however, a continuance is essential to allow the extremely prejudicial impact to partially subside, and to give the Court and the defense time to fully investigate and address the scope of the violations.

Nonetheless, the State [in its Opposition] does not address the potential for suffering "remedies more serious than delay" if someone on their team is found to be the source of the evidence leaks.

I am worried that Hippler may feel compelled to postpone the trial until the leakers are found so he can determine the most appropriate punishment for the leaks, and I fear AT is going to make a big deal about this going forward.

Apparently my fears were misplaced since Hippler implied at yesterday’s open hearing that the trial will move forward as planned. We’ll know for sure when he publishes his decision in short order.

Regarding AT and BK's defense we know of from court docs, I'm with those who may find the defense she's heading up to be one of grasping at straws, but also think there may be some method to the madness overall behind her asking for and trying to get "more time" before his trial.

In comparison to some other high profile single or double murder cases I've followed where the defendant enters a plea of not guilty, has an alibi corroborated by someone else, and 'only' circumstantial evidence has been collected, the defense could at least try to build a case of some veracity from those basic DDI (didn't do it) aspects pointing toward their rights to a presumption of innocence -- So, e.g., with a plea of not guilty, an alibi, and no forensic evidence, the defense would have nothing to lose with a let's just get on with it and see how it plays out approach.

AT, OTOH, has a defendant charged with quadruple murders, who will not enter any plea or declare his innocence, whose alibi was being out that night in the area stargazing alone, with incriminating forensic evidence collected at the scene of the crimes (at a minimum his DNA on the knife sheath) -- So, e.g., with no plea, no alibi, and forensic evidence, the defense would have nothing to lose with a "delay delay delay 'til it hopefully goes away" approach.

I don't see it getting her anywhere, and don't see JH going along with it, but I do see her as being between a rock and a hard place, and in order to do her due diligence, at this point, when all hope may be lost, she has to try and stall for more time in case something comes up down the road that may help BK's case.

I’m at a deficit here. I’ve never used Door Dash, Seamless or whatever else is out there.

Where I live, there are probably at least 20 restaurants within a block.

Now that I no longer have kids at home, I find it much quicker to run downstairs and pick up an order myself.

I am catching up here, bit by bit. Very relieved to learn that Hippler (my hero) appears to be unbowed.

I still haven’t seen any video of the apparently female DD driver. I am gathering as I go and soon will understand more of how she fits in.

Just my experience.

Thank you so much for your good wishes for me and for my family, and also to all of those again who sent me PMs.

While I certainly am aware that this is not a thread about me and my family, the compassion of my invisible fellow posters is so extraordinary.

I am not unaware that many members are undergoing their own travails, and I feel for each one.

It’s what makes us a true community.

I’ll leave out the rest but suffice it to say that two of us were diagnosed with cancer, both in the last month, one which will kill the person and one which will need treatment. Another has a different and purely atrocious end-stage disease. Another is having surgery tomorrow for something that should heal, hopefully. The 20-year old just has a broken leg, but the timing is awful in light of the rest.

Just got home from Florida but it turns out I’ll have to go back next week.

I know I’m off-topic but I am genuinely touched by the kindness we show to one another, even though most of us have not met. (I’m reporting myself for being so O/T on a thread about Idaho).


I am blessed IRL with terrific friends, but all of you add comfort.

Judge Hippler says "...It is likely you are going to trial on the date indicated."

Open portion over, but it looks like trial this summer!!!

Kohberger judge is not deciding today officially on whether to delay the trial -- but he just said:

"Fully encourage everyone to continue to get ready for the trial when it is scheduled."

"It is likely you are going to trial on the date indicated."

He will issue a written order.

Then said "as of now, I will tell you it's likely that you are going to trial on the date indicated."

It certainly sounds to me as though the judge is giving the defense an indication of how he intends to rule, but is still composing his written decision. (Or his paralegals are splicing together the salient points he intends for his legal decision).

DD drivers do not have any signage on their vehicle, and they're not required to have a dash cam.

They are independent contractors who use their personal vehicles and are only required to have a cell phone and insurance coverage, and that's it.

A: No, there are no specific vehicle requirements. You can use a car to deliver, provided you have a valid domestic driver’s license and valid personal auto insurance. Depending on your location, you may also have the option to deliver using a motorcycle, bike, e-bike, or scooter.

Not where I live and I think that's in general. My relative just uses her regular car; she got a dash cam because her adult children insisted. They're going through some hard economic times, the business she worked for, for years, closed down. At any rate, no signage. We use DD or Uber Eats and neither have signage on their cars.

Yes, stalling. Stall in case a lightning bolt gives birth to a genetic twin, and barring that, that some event, finding, thing occurs that AT can repackage as sanctionable against the State, including anything professional or personal that crops up with any of the State's witnesses, expert or otherwise.

She's now pounding leprechauns.
