Could the investigations run concurrently if they are headed by a specially appointed LE entity? I believe we saw that in the Murdaugh case and the Delphi case as well.I do wonder, though, how the judge will handle the request for a special investigator to investigate the leaks that were visible on the latest Dateline episode. The judge invited the defense and prosecution to make the request if they felt it was necessary and now the request has been made. If the trial goes forward as planned in early August, will the special investigator do his/her work during the trial? And what would be the consequences if the leaks were identified and came from the prosecution side or defense side? These issues have to be addressed by the judge, as the appointment of a special investigator is now likely to move forward, and how Hippler handles this matter will likely be a significant issue on appeal in this death penalty case.
There are going to be many automatic appeals on this DP case regardless, but I think Judge Hippler will make the correct decision. He is highly pragmatic and well versed IMO.
