It’s essentially excluding all geofence data and it prohibits the defense from calling their geofence expert. I can practically guarantee that no geofence data will cone in.They asked to exclude geofence data that was not relevant, or for the purpose of confusing the issues or misleading the jury. As I highlighted. The judge granted this paragraph unmodified.
Geofence as a whole was not excluded.
The entire reason for this is because the defense was coming up with crazy theories by misinterpreting the geofence data, so the MIL included a provision that any geofence data must be relevant, etc.
