They asked to exclude geofence data that was not relevant, or for the purpose of confusing the issues or misleading the jury. As I highlighted. The judge granted this paragraph unmodified.

Geofence as a whole was not excluded.

The entire reason for this is because the defense was coming up with crazy theories by misinterpreting the geofence data, so the MIL included a provision that any geofence data must be relevant, etc.

I’m not sure what you mean about my attachment being testimony. I attached the motion in limine. I’ll attach it here again.
It’s essentially excluding all geofence data and it prohibits the defense from calling their geofence expert. I can practically guarantee that no geofence data will cone in.

The problem with the attachment is probably on my end. Now I can’t open it at all (from my phone).
 
from what I have seen reported Dr. Grassian gave compelling testimony. I happen to disagree that is what happened with RA but he seems to have gotten the jurors attention and they appear to have asked good questions.

I find it interesting that Warren evaluated Oberg's reports and work product but did not in any way shape or form examine the actual evidence or complete his own analysis of a round against RA's unspent round, which would seem to have been an option open to the defense had they chosen to avail themselves of it.

MOO it speaks to their concern and that of their witness that further testing might actually add support to the prosecution claim of a consistency between RA's sig and the unspent round. easier to refute the work of someone else if you haven't yourself done it and made a different finding after doing so.
 
Next was Betsy Blair. She does not live in Delphi but walked the trail regularly. She testified to seeing Abby and Libby on the trail the day they went missing.

Her testimony shared details on the path she would regularly take on the trail.

She says on February 13th, 2017 she was walking the trail when she noticed a man on the bridge.

Blair described the man she saw as "Bridge Guys." Her testimony detailed that she was about 50 feet away from the man on the bridge.

"He was out on a platform, and looked at me like he was expecting someone. It didn't seem like he was looking for me," Blair testified.

She described the man as:

  • Causasian
  • 20s-30s
  • brown poofy hair
  • younger, boyish look
  • youthful
  • average height
  • no facial hair
Blair said she only saw the man, "for a moment."
When asked by the jury if the "brown poofy hair" could've been a hat, she said it's possible.

Blair also said the man she saw on the bridge is the man in the photo released by police of "Bridge Guy."

I doubt the information would be confusing to the jurors if explained well by the experts... I think this is the State being desperate to allow anything that might show RA as possibly not guilty to the jurors. Moo. Appeals are going to be hella interesting if there is a conviction. MOo.

Reason being, is its going to come back Guilty.
 
No, that's incorrectly stated, according to the link. It was, "That's not correct! No!" That yell was in answer to Baldwin saying, "You went and worked on your ATM machines."

Baldwin: "You didn’t drive straight home from work on Feb. 13."
Weber: "That’s not correct."
Baldwin: "You told law enforcement on Feb. 17 or Feb. 18 you went and worked on your ATM machines."
Weber: "I said I dropped off a trailer."
Baldwin: "That was earlier in the day. You went and worked on your ATM machines."
Weber: "(Starts yelling) That’s not correct! No!"

A false statement purported as fact about him, not a question, thats why BW reacted.
 
According to RA he drank a six pack that day, right before the murders, maybe he was falling down drunk?
It’s interesting that RA seemed to imply that he didn’t often cross the Monon High Bridge because it looked treacherous but he felt comfortable standing on a single platform to look down at some fish after consuming a six-pack of beer.

To me, keeping balance in such a situation would also seem treacherous or high risk.

The man WITHOUT blue eyes is wearing always blue to make his eye color shine even more. ;)

I never figured out why people made the “not blue eyes” thing to be such a big deal, considering it was reported only once with absolutely no reference to who stated it or their distance to the suspect. So really knowing nothing about the source, what if it was an anonymous tip from RA? Just kidding, not intending to start rumours! Clearly eye colour is not important as it wasn’t mentioned during testimony. Back to reminders of a ‘fragile egg’head. MOO
 
Unaccounted for or do they know who owned them?
I'm guessing unaccounted because surely everyone with a registered phone that pinged the tower during that time would've been questioned?.
Was/is it possible to buy phones in the US without having to go through a contract?
We used to call them PAYG ( pay as you go) phones in the UK. You could walk into a store and pick one up off the shelf with the sim card included in the pack. There was no need to declare your name or address to top it up with credit. You could buy minutes over the counter of lots of stores.
Almost impossible to trace.
I don’t know if they’re still around but TracPhone was a brand in the US.
 
I apologize if this has been asked/mentioned…I have fallen behind. I’ve heard KA had stepped out midday (maybe Friday? Guessing) and hasn’t come back since. Is this still the case? Also heard that the daughter testified but would not make eye contact with RA and KA was not there during this either.

IF she has not come back, are there any theories as to why not or has anything been said?

Earlier in the trial, I believe when RA's computer search records were submitted, several people including TMS heard Baldwin then go over to KA and say "we're going to need you to testify like we talked about"--likely in order to point out that some of those searches could have been KA using a shared device.

If she is going to be testifying today or tomorrow, she may be excluded from being in the courtroom until she is on the stand.
 
If the data would not be confusing or misleading and was relevant, it would be allowed. The motion in limine quite literally and clearly specifies they only seek to limit irrelevant, confusing, or misleading geofence data.
I think the issue is that the D wants to present not just SODDI as a defense …

…but the D wants to suggest that some specific other dude(s) did it, and that they were on the trails that day as demonstrated by phone data…

but if these individuals are not suspects and/or have been cleared as suspects - the P is saying that would/could confuse jurors and is irrelevant to RA’s defense

The flip side is if the D is trying to show that there were more people on the trails that day and they could be the killer and can’t present alternative scenarios that gets in the way of mounting a defense- according to that perspective…

Depending of one’s feelings about guilt vs innocent- will probably impact whether or not the inclusion/exclusion of phone data is a good/bad choice and is fair/unfair- moo

ETA- I could be totally 110% wrong about this and misreading the situation

Janice Allen, Richard Allen’s mother, arrived in the courtroom around 9 a.m. She has been gone while recovering from a fall coming into the courthouse last week.

Richard Allen entered a few minutes later in a turquoise button-down shirt.

Court began at 9 a.m. The state filed a motion in limine requesting Dr. Grassian’s testimony not be considered, presuming guilty or innocence of Richard Allen, or opinions/legal conclusions of Richard Allen.

Defense said it had reservations about the timeline of their request, saying that a witness already can’t testify to guilty or innocence, but can disagree without other testimony. Allen’s legal team argues that this could, in this case, “handcuff” Allen.

Drunks never believe they’re inebriated, why they’ll wobble back and forth and side by side believing they walk a straight line. It’s the street that’s moving. JMO

The Defense isn't stupid, but I don't believe the Jurors are either.

This is very interesting. That description does not sound anything like Richard Allen.
 
DELPHI — Three witnesses have been called to the stand Tuesday morning in the murder trial of Richard Allen. Allen faces murder charges for the deaths of Abby Williams and Libby German near the Monon High Bridge in Delphi in February 2017. This is day 16 of the trial at the Carroll County Courthouse.
