well, you're right it's no surprise. they may as well have cooked it up by reading right here at WS - heck, manymanymany posters had Casey committing suicide a la Mrs. Duckett the first time she was bailed out of jail. (the old threads are full of this jibberish.)
personally, i'm ready to eat some :popcorn: and watch the fireworks go...

Isn't this normally discussed reviewed at the end of a trial? How can a decision be made without going through all of the information there is? One can't just ASSUME that "the crime was not cold, calculated and premeditated." Isn't that the point of having a trial?

The defense team is ONLY trying to get the death penalty off the table before this heads to trial.

It is one sentence out of 30 pages so I don't know for sure, but it may just be referring to the crime she is charged with? We really don't have a context to frame it in.

But she's charged with murder! How is that not cold or calculated. Maybe it's one of the other charges?

Because that is what she is accused of... so they are attempting to get the death penalty off the table by pointing out cases of filicide that were convicted did not get the death penalty.

I wonder if they wanted to hurry up and get this report to the DA, BEFORE the search this weekend? Would it give them more negotiating power over the DP now, versus when Caylee is found??

It's being done as an alternative argument - which is typically allowed in the pleadings. Pretty straightforward for an attorney to brief every viable option, etc. :yawn:

So how was she erratic and not entirely rational?

My thoughts exactly! Over and over again, everyone said that she was acting normally. Reckon they are throwing it out there to see if it will stick?!

She was stealing from Cindy and from her grandparents prior to Caylee's disappearance, she was working at a pretend job, she was leaving Caylee with a pretend babysitter. In hindsight, much of what Casey did was erratic and not entirely rational, but that is not how she was described by anyone in the LE interviews.

According to Cindy, Casey was "mother of the year" during that time. Never did she say Casey was erratic or not entirely rational. You would think she'd know.

You can face a murder charge that is not calculated or intentional. Florida allows for aggravating circumstances as well. Not saying I think Casey is guilty of anything less than premeditated cold blooded murder.

So if she was acting erractic and not entirely rational, prior to Caylee's disappearance, why did she appear to be so calm and rational running around Orlando to nightclubs, dancing, going on shopping sprees with your friend's checkbook, cooking for your friends, renting videos from blockbuster arm in arm with her boyfriend....after? I hope the SA tells them, nice try, thanks for playing! :rolleyes:

The crime she's charged with is cold, calculated, and premeditated. So they couldn't have been referring to that. IMO, they were referring to what Casey did as opposed to what she is charged with.

That would be erratic and irrational for you or me, but it was normal for Casey ;)

Ah that could be, that there was surrounding verbiage that made it clear it was the crime charged they were addressing. That would definitely give it a different context.
