It's being done as an alternative argument - which is typically allowed in the pleadings. Pretty straightforward for an attorney to brief every viable option, etc.

as many are posting: they are going to IMMEDIATELY start briefing for all alernatives, including any that may take the DP off the table of possibilities.

So George and Cindy were/are ignorant to the possibility that their daughter who has lived with them all her life is unstable.

Well, they certainly can't have it both ways....claiming Casey was "mother of the year" and everything was perfectly normal until the "kidnapping" ...and now turn around and claim Casey was "emotionally distressed" and "acting erratically", etc etc.

They've gotta pick one and stick with it!

The defense team is ONLY trying to get the death penalty off the table before this heads to trial.

Yeah, good luck with that!:furious:

Sounds like a first step toward a bargain. They're trying to see if there is room to work out a deal.

The crime she's charged with is cold, calculated, and premeditated. So they couldn't have been referring to that. IMO, they were referring to what Casey did as opposed to what she is charged with.

Hmmm... good point.

Evidently the evidence is not good for the defense. I hate it when they cry crazy, nuts, wacked. It's just an excuse. She could have left Caylee with Cindy.
As mentioned "suffering from episodes of extreme emotional distress and disturbance since her daughter's birth". Puleeez...could she have had it any easier? Will they say her mother put undo pressure on her? Cindy made her nuts? If they want the dp off the table they better have something better to offer than this.

and...............where ARE those docs??????????????????

Watching/listening to JB today seems like that they are "thinking" of a deal. He seemed much more relaxed today. More like he's accepted what's going on and ready to make the best deal for her. IMO

Seeing Casey spend the rest of the next 60+ years in a hardcore prison is ok with me. I'd love to see her get the DP, but LWOP would probably be more of a punishment and hardship in Casey's eyes.

Who said that she had a psych evaluation, I'm sure she'll have another one by a defense psychiatrist and a prosecution psychiatrist - Casey might have been told to say certain things and Baez and she rehearsed it (which most defense attorneys do with their clients) BUT if it's rehearsed for the evaluation, with Baez helping, this would be perjury, would it not? And if it comes out that this is the case, Baez could lose his license, like he's being investigated already on other stuff

This could be some of what they were doing for 6 hours daily

Apparently, they won't be released until tomorrow as they were having trouble "uploading" them.

Submitted by defense to prosecution outlining why prosecution should not seek death penalty, in part reads:

"The crime was not cold, calculated and premeditated. In the months leading up to Caylee's disappearance, Anthony's behavior was described by friends and family as "erratic and not entirely rational."

He wrote that filicide – the act of a parent killing a child – is different than other homicides. The underlying reasons why mothers kill are complex and can be divided into various categories. For example, one type is a parent who kills under influence of mental illness. Another type suggests a parent's motive may be to save the child from real or imagined harm.

Juries are more likely to show mothers mercy. He mentioned Andrea Yates – a Texas mother who drowned all five children – was sentenced to life in prison. Susan Smith, the Arkansas mother who pushed her car with her two children inside in a lake, got life in prison.
"

Is this an acknowledgement of Caylee's murder??

Sure looks like a confession to me.

Yes, but if this crazy thing works she'll go to a hospital and probably be out in 20, I'd love to be 42 again.

If you watch the end of the first bond hearing, among other things, the judge ordered one.

well that stinks............. to say the least

Posters are right, that we shouldn't read too much into this. The language in which this was couched could put a whole different spin on this.

p.s. Just saw Elley Mae's comment - 42 seems fairly young to me now...

Reported on WFTV9 Orlando

Baez "We all believe [Caylee is] alive and, if these tips, if there's one credible tip in that 5,000, it's worth us going through them," attorney Jose Baez told Eyewitness News on Wednesday.

The defense is accusing prosecutors of purposely releasing all the psychics' tips first just to make it appear as though there were no credible tips showing Caylee is alive. The Anthonys claims about following her kidnappers and getting closer to finding her don't seem to be panning out.

"She says she gave the child to a babysitter that no one can find. Doesn't the key lie with her? Why do you need to rely on stranger's tips when she is the one who could really lead you in some direction?" WFTV reporter Kathi Belich asked attorney Jose Baez (full interview).
"Kathi, I'm not going to discuss theories of defense or anything we plan on bringing out in court. The truth is, under the rules of discovery we're entitled to it," Baez said.

Investigators said the tips are not panning out because Caylee's gone.

"Do you think she's being open and honest with you?" Belich asked Baez.

"I don't think it's wise to make statements about my communication with her," he said."

Well it's about time someone asked Baez why he needed tips from strangers to find Caylee when he had Casey. And he can't even answer the question, gives the excuse that it's part of the defense strategy and will come out in trial.
