Welcome​

Erin Patterson’s trial is entering its sixth week.

We’re expecting Det Leading Sen Const Stephen Eppingstall, the officer in charge of investigating the fatal lunch, to continue giving evidence today.

While we wait for today’s proceedings to get under way, here’s a reminder of what the jury heard last week.

Our justice and courts reporter, Nino Bucci, was in Morwell last week and reported from inside the court room.

Police did not get SIM records for all phones

Mr Mandy asks Mr Eppingstall whether a record of SIM card removals was obtained for the numerous phones just mentioned and the detective says no.

Mr Eppingstall says records may only have been obtained for what are being called "phone A" and possible "phone B" in this case.

Mr Mandy is now asking about the phone reset which occurred on August 3, 2023. He confirms with the detective that phone records for phone A were obtained on August 31, 2023.

Questions have now turned to a text message which was sent to one of the phone numbers. Mr Mandy says the message "lands" in the number 12 hours after it was sent.

"These records appear to show this SIM card loses connection," Mr Mandy says.

He says this is an example of the "limitations" of what can be extracted from these records.

Mandy is showing the jury a flow chart which shows three sim cards police investigated.

Eppingstall previously told the court were three phones police believed Patterson used - two Samsungs and a Nokia. He said one of the Samsungs, referred to as phone A, had never been recovered.

Mandy says the chart demonstrates one sim card was used across several mobile phones from 2019.

Mandy says in early 2023, Patterson’s son’s sim card went into a phone, referred to as phone B.

Phones reset multiple times, court hears

Mr Mandy is now asking about another phone and asks whether police checked what service was connected to that phone.

Mr Eppingstall replies that he does not believe that was checked.

Mr Mandy says phone B was reset in May, 2023 and was next in use in August, 2023 and Mr Eppingstall agrees.

Mandy shows the court call records of a sim card ending in the digits “783”.

He says that between 12.01am and 1.45pm on 5 August 2023, these records indicate that “this sim card has lost its connection to the network”.

Eppingstall agrees.

Mandy says the next time the sim card connected to the network was at 1.44am on 6 August 2023.

“Yes, sir,” Eppingstall replies.

Mandy says it is an example of the “limitations” of what can be extracted from call records.

‘No one’s been telling me anything’: Lead detective recalls visit to Erin’s home after lunch​

Erin Patterson’s defence lawyer Colin Mandy, SC, is continuing his cross-examination of Detective Leading Senior Constable Stephen Eppingstall.

There are several members of the Wilkinson and Patterson families present in court today, including lunch survivor Ian Wilkinson and Don Patterson’s brother, Colin Patterson, among others.

To begin, Mandy takes Eppingstall to four images of dinner plates taken at Erin’s Leongatha home during the police search on August 5, 2023.

The first image shown to the court shows a black plate above the dishwasher on the counter, next to another white plate. The second shows several dishes stacked in the dishwasher, including a black and red plate, a white dish and a colourful plate with kindergarten-type scribbles.

The other two images shown to the jury are of an open drawer with a stack of black side plates, and a colourful, striped plate.

Eppingstall agreed that upon arriving at Patterson’s home, he indicated to her that two people had passed away, to which she responded: “No one’s been telling me anything that’s been going on, and it’s been really hard.”

Homicide detective recalls second search of Erin Patterson’s home​

Stephen Eppingstall, the lead detective in the mushroom case, is now giving evidence about the second search warrant executed at Erin’s home on November 2, 2023.

Erin Patterson’s defence lawyer Colin Mandy, SC, has taken the homicide detective to a series of images taken during the search.

The first two images shown to the jury are of an Acer laptop, keyboard and mouse atop a wooden dining room table with tan/grey upholstered seats. The third image is of a Lenovo Thinkpad computer.

Mandy has taken Eppingstall to an image of the same computer and Lego room that police searched on August 5, 2023, and pointed out two items that were present on a shelf in images of the initial police search in August are no longer there.

“I am putting to the witness that the item that was depicted underneath a keyboard is no longer there,” Mandy said.

“It’s clear that shelf has been rearranged,” Eppingstall responded.

The jury has been shown another photograph of the shelf, showing a mouse and keyboard.

Mandy pointed to a small black case on the shelf, which he suggests could have been a mobile phone case on a windowsill in an image taken during the first police search on August 5, 2023.

Eppingstall confirmed at the time of the second search, Erin was using another phone, an Oppo handset, that was seized by police.

Asked by Patterson’s lawyer whether police would have checked what SIM card was in the device at the time, Eppingstall said officers “would have”.

“From memory I don’t think it was the 783 number,” he said.

Mandy has taken Eppingstall to the diagram again, this time zooming into a SIM card connected to Erin’s son and ran the jury through a series of factory resets between February and August 2023.

Why now? He's been excused from giving further testimony/evidence, not sure why he'd need to be brought back for cross-examination.

They really don’t. Prior to now I’ve been quite bored hearing the defence arguments but now they are revealing more incriminating facts it’s become interesting 😳

Like, I'm sure there are limitations to how much they can extract from SIM cards but the fact they did recover signal messages linked to a phone number anyway tells me they recovered a fair bit.

Okay I’m back. Wow, this reenactment really drives home the extent Erin went to distance herself from the poisonings. It’s really hard to believe she didn’t have intent.

Hold on drsleuth, you're obviously forgetting EP is the true victim of all of this. Her memory after the lunch was horribly fragmented, such that she couldn't remember whether she bought the death caps at an Asian grocer or foraged for them! And of course she was so aggrieved by SP's family who pushed back against her perfect self!

in all seriousness though, she probably actually thinks that way. if she is a narcissist, she's suffered narcissistic injury from Simon's separated listing on his form. when she's challenged, she seems to take it personally and harbour rage against people who "wronged" her. dangerous combination IMO

The defence aren't asking questions they don't already know the answers to. They're being very tactical.
