I think that article is saying that the documents were lodged (the documents of proof of each ground for appeal) because leave for appeal was granted. Just that a court date for the appeal has not yet been set.

As far as I know a single judge has to rule either or not to grant leave to appeal without oral arguments ( in other words, based on the appeal reasons and evidence submitted for an application for leave to appeal). Then if leave is granted, they’re given a hearing date for the appeal hearing. As far as I’m aware, only the appeal documents have been lodged with the registry, but leave hasn’t been ruled on.

I just read an article by the ABC that says leave for appeal has not been granted as I suspected but it seems like the media are overhyping it to make it sound like leave has been granted.

The Court of Appeal has accepted the documents, but is yet to grant Patterson leave to appeal.​

Half an hour after the lunch - off she pops to the Rubbish Tip - all on CCTV (released after trial) FFS

I'm gobsmacked that WASNT allowed into evidence.

Justice is STACKED for the perp !! - always !!

IMO EP big mistake was taking the stand - if she shut up she might have gotten away with it.
Just like all the bikies do in Australia (members of outlaw motorcycle gangs (OMCGs))

I think you’re right. I think she had a good chance of getting off if she didn’t take the stand. iMO

I don't think the testimony of her Facebook "friends" hurt her chances at all. They seemed more like witnesses for the Defence, not the Prosecution.

From what I was told, some friends deleted the chats etc but one of them had screenshots saved.

The images of the mushrooms she sent to the group and the dehydrator were damning, along with the screenshots of Erin hating on her in-laws and Simon. iMO

However, they could have been obtained by subpoena from Facebook server records?

I noticed two of the witnesses said she seemed like an excellent mother. That’s not what I saw. I thought there were problems with her parenting from little things I noticed in photographs etc. Eg they always looked dishevelled and wore clothes too small for them. She never purchased them anything new - toys, clothes, devices. She got everything off marketplace. She was extremely stingy with money. They ate a lot of convenience food. Etc

One time she asked me to help her jail break one of her children’s iPods because it was so old it no longer functioned. She was too cheap to buy a new one.

She made very derogatory comments about one of the children’s looks which I found very very odd.

I always found her parenting to be off. No idea what those “friends” were seeing, but then again, they didn’t see that they had a psychopath mass murderer under their nose, either. Our original group all found Erin to be psycho which is why we stopped being friends with her.

I saw possession, not love or connection.

I have also been told about other allegations which I won’t publicly share but suffice to say I wouldn’t put it past Erin to poison her own children if it meant some sort of advantage to her.

Hardly a good mother.

I constantly find myself shocked through revelations like this. I really feel for the kids living with a mother like EP. They did not and do not deserve such terrible things to be said about looks. She truly disgusts me

While I would never be sympathetic to her, it's obvious IMO that she had self-esteem issues that she decided to project onto others, perhaps as an attempt to feel better. This, coupled with an inability to properly communicate and leave hurts in the past, would prove to have murderous repercussions. imo

Seems like in Victoria, 3 judges usually hear an appeal to ensure that the trial was conducted properly and that the sentence is in line with the legal requirements.
After an appeal, one of the following is decided upon.
  • order a retrial of the case
  • change the decision in a case; for example, reduce or increase a sentence of imprisonment
  • conclude that there was no error and that the lower court's decision stands

Im not sure she said it to the kid, but she said it about the kid. I don’t think it showed anything other than she was cold.

I don’t know any mother that could look at their little child and not see perfection only. We are blinded by love, and in my experience it’s not possible to think it let alone say it.

Ahhh ... okay thanks. Maybe ABC is trying to correct the misinformation.
I am guessing that appeal documents are public information (for a fee, of course) and that is how MSM has seen them.

ABC is probably right. I am also guessing that we might know which judge granted leave for appeal if it had been granted. And we don't.

Imo she was always going to ‘grasp’ at whatever she could, and also imo, there was always going to be a legal team ready to take the case / her $$. . they get paid no matter the outcome.

What I am intrigued about, is what was recognised as a possibility that has led to EP being granted the right to appeal - because I thought it was pretty water tight.

I definitely don’t agree. She’s always had very cold absent eyes. IMO
Even if she was twins with Kate Middleton her behavior and lack of a moral compass could never inspire a sense of beauty in that convict. Beauty is far more than physical appearance. JMO

It's all feeling like the world's smallest violin to me. Oppressive and unfair questioning? Erin chose to get on the stand! God forbid the prosecution hurt her feelings!
My thoughts exactly! Every criminal would claim that cross-examination is "unfair and oppressive questioning". Boo Hoo.

“In the appeal documents, Patterson also criticised key pieces of evidence used by the prosecution, including cell tower evidence and sightings of death cap mushrooms in Loch and Outtrim, as well as evidence given by Patterson's Facebook friends.

During the trial, Patterson's lawyers had attempted to show the jury photos and videos — found on an SD card at her home — related to mushrooms to show a history of foraging.

But the judge ruled the evidence was inadmissible, which the appeal documents claim was a "substantial miscarriage of justice".
In my opinion, a history of foraging would lead a person to believe that Erin didn't pick Death Caps accidentally. She knew exactly which mushrooms to look for, or avoid if she wanted to.
