Neither top police nor the state’s attorney-general were able to say how they would enforce the condition yesterday.

^ from the link above.

Seriously. There's ways they could make 100% sure. Ban him from the internet. He's an accused murderer, how hard is it. The internet is NOT essential to his life. Why impose a ban that will cost thousands to monitor for a year, rather the relatively cost-free option of banning from all use?

Absolute rubbish, this bail decision in its entirety. Not a Mullins fan.

ETA:

Also, sick in my mouth a little bit on reading "ongoing counselling" :

Update - (13-2-2013) - On Wednesday morning, Justice Mullins published her reasons for granting Fardon release from jail under a strict supervision order.
She ordered that the decision of the Court of Appeal ruling - that Fardon was a "serious danger to the community" in the absence of an ongoing supervision order - be affirmed, but rescinded his continued detention since July 1, 2011.
Justice Mullins ordered Fardon be subject to 34 conditions as part of the supervised release order; including that he notify them of any intimate relationship; not visit any place that housed children or people with intellectual disabilities and that he continue ongoing counselling.

http://www.mako.org.au/robert_fardon.html

Look up this guy's atrocities. No wonder Tostee got a walk in the park bail agreement.

Here's an interesting question: where does she stand on civil liberties.... WHY did she rescind a 'never to be released" sentence for this serial, violent rapist of women and children? I would LOVE to know what her agenda was there. I really would.

...

If you're not a fan of Justice Mullins then you most definitely won't be a fan of Ms Soraya Ryan who was also the defence barrister in this case....

Ex-wife killed over orgasm jibe

July 4, 2011

A woman's verbal attack on her former husband's sexual abilities allegedly caused him to lose control and choke her to death at her Brisbane home.

A jury has heard how Jiagen Pan, 45, was arguing with his former wife Linjin Cui at her Springfield Lakes home in August 2009 when she slapped him and called him a "son of a *****" and "a loser".

Pan's defence barrister Soraya Ryan said Ms Cui told her client: "You're not a man; you never satisfied me as a man; you never brought me to orgasm."

Man acquitted of ex-wife's murder

11th Jul 2011

A NOODLE chef who admitted to killing his ex-wife and trying to hide her dismembered body in a wall has been acquitted of her violent murder.

A Brisbane Supreme Court jury instead found Jiagen Pan, 45, guilty of manslaughter because he had been provoked

After cutting her body up, he put the parts in two garbage bags and left them in his car overnight parked at his home.

The next day he tried to dig a grave in his backyard but the soil was too hard, he said.

He then went back to Bunnings and bought bags of cement and a trowel and began building a cavity in a hallway cupboard.

The court heard police walked in on Pan entombing the body.

Marly, it's just *disgusting* beyond words, isnt it. I was reading a case last night (late, so I didn't think to save the link, sadly) in which several Americans, a Canadian (iirc) and an Australian man were arrested for some horrible sex crime involving kids. The Americans, in America, got LIFE in jail. The other non-Aussie got LIFE. The Australian was brought to trial here -- his sentence? 39 months.

Just a brilliant illustration of our how our legal system consistently fails the victims of violent crime, right there. Our maximum sentences are a *joke*, so even judges who aren't partial to lenient sentences have their hands tied when it comes to the punishment fitting the crime. Just makes me so angry..

And thanks for the info on the O'Gormans and Fardon (my left eye is twitching, just thinking about it).

During the two-and-a-half years, Sharwood, then 30, molested the boy up to three times a week, including when he picked him up after school, at the rectory, during musical concerts, at their homes and in a car.

Sharwood is due to be released on November 8 after serving one year of a 33-month sentence.

The Brisbane Anglican diocese is holding an investigation into Sharwood's status and has invited his victim to give evidence, which could include cross-examination by his abuser.

The diocese's Professional Standards Board began the process last November, but no further action could be taken once Sharwood was jailed.

A statement released by Brisbane Anglican Archbishop Phillip Aspinall said the board, headed by Supreme Court judge Debra Mullins, had determined that Sharwood should be "given the opportunity to make a submission before any decision is made on his future" on his release.

Bravehearts executive director and founder Hetty Johnston said the church did not need to re-examine the case.

"They just really need to draw a line in the sand and say 'no'," Ms Johnston said.

Some comments here by people who also feel wronged by Justice Debra Mullins … one in particular who asked that the non-Australian defendant’s passport be held ..
Mullins said no ..
Result: the defendant fled the country with over a million dollars of the victim’s money.

Yes, I see that Debra Mullins sits on the House of Laity board for the Diocese of Brisbane, and further into this document she provides her profile.

She was also one of the judges who snubbed the newly appointed Chief of Justice by not attending his welcoming ceremony (new Chief of Justice has been appointed by Campbell Newman to bring 'refreshing change' to the Supreme Court .. and help get rid of some of the outdated, outmoded ways).

Ha- I just read a rather scathing article regarding nepotism and the Queensland bar. I'd love to know all the *real* ins and outs of why all but one judge (and he was brand new to the bench) boycotted Tim Carmody's do. To this day, I dunno where Carmody's head was at, appointing vehemently anti-TV O'Gorman and McMurdo (along with Mullins) to a sub-committee regarding the TV broadcasting of court cases.... but something very odd went on, there.

Anyhow, cheers for the links re unhappy members of the public. I've found a few sites along those lines. Mainly family members of victims, and general public rage over rulings in sex offence cases.

Who will keep Gold Coast murder accused Gable Tostee off Tinder?

"The restrictions are kind of out there," says leading Australian criminologist and former inspector Terry Goldworthy who says he has never heard of a case where social media was banned as part of a bail condition.

"It would be very difficult to police in some respects - they could be wasting police resources pursuing it to see if it was actually him."

Mr Goldsworthy says it would be time-consuming and difficult for police to prove authenticity of profiles made under Gable Tostees' name.

"They would have to make inquiries with the company - Tinder, Facebook etc," he said.

Tostee has quite a few fans who claim his innocence. I'm tipping he recluses as he did after the counterfeiting incident, abides to bail conditions, does everything by the book, knocks up a sympathetic girl just in time to become a new father prior to the trial and claim to be a new man, might even joint a church, maybe suspeneded sentence. Sad I know, but realistic..

  • #853
What's sad is, the judge allowing him time to do all that stuff. Which will help him in court and then will be chucked the moment the trial's over... :(

If he doesn't go to jail - but so far it's looking like the dock's stacked in his favour..

Dad helped GT run from the scene isn't that a crime in itself??
This is disgusting they are BOTH walking free.
They are both as pathetic as each other. Give them a cell together.

Gittany ran to Lisa's side and he got murder.

Someone please pinch me!
He ran from the scene of the girl he had been with for the last hours.
There is something wrong with this bloke.

Mum & dad would be having a horrible time ATM.

Reap what you sow.

There is still a very good chance that he will be jailed for the police chase, in the mean time (and it probably won’t help his cause for a court to know that two weeks after the high speed chase, a girl died in another incident which involved his complete disregard for human life) ... which will cramp his style if he is trying to clean up his image.

He added that Tostee was likely to be jailed if found guilty of charges over a New South Wales police chase two weeks before Ms Wright died, during which he was shot with capsicum spray which failed to subdue him.

These are the first few cases I came across when I looked up some police chase examples … two years jail … 12 months jail … 2 months jail plus fine … 3 months jail …

A LANGWARRIN police chase has resulted in a teenager being sent to jail for two years.

A man has been handed a 12-month jail term over a police pursuit which a Kalgoorlie magistrate described as "extremely serious".

http://www.gympietimes.com.au/news/jailed-and-fined-5000-after-police-chase-fail/2425756/

Another interesting little tidbit ... in NSW they have a law called Skye's Law, in regard to police pursuits.

"In NSW, the offence of police pursuit is listed under section 51B of the Crimes Act. The offence is also known as Skye’s Law as it was introduced after the toddler Skye Sassine was killed when a driver attempting to escape police crashed into her parent's car.

The maximum penalty for "Police Pursuit" is 3 years gaol for a first offence, or 5 years in gaol if you have been convicted of another major offence in the 5 years immediately before. There is a minimum disqualification period of 1 years and an automatic period of 3 years."

Thanks Slinki ... good to hear they are still working hard on building their case, regardless of Tostee's lawyers' posturing and the allowances made by the judge.

"Police investigators are working with the US administrators of Tinder to try to locate up to 60 women who had been in contact with Tostee through the dating app, Gold Coast Detective Superintendent David Hutchinson said.

Records of conversations between Tostee and Wright have also been identified with the help of Tinder."

Evidently someone paid for the bail documents again.

Investigators are looking for statements from the woman, bail documents show.

Gold Coast police sergeant Michael Campbell reportedly told Mr Tostee's lawyers police had already conducted 'extensive' investigation into their client's actions on Tinder.
Though they had already collected the majority of the witness statements they needed, they were still seeking the 50 women who were from overseas or other states of Australia.

The evidence the women can provide could be "substantial" to the case, Mr Campbell said.
