Deceased/Not Found CA - Heidi Planck, 39, left son’s football game in Downey, dog found in Los Angeles, 17 Oct 2021 #5

  • #501
He did say she got prescriptions from more than one doctor. That's different than using illicit drugs since you know what you're getting. There's not going to be a random pill with a lethal amount of fentanyl.

I was just wondering if there was any truth to the claim that she would buy illicit drugs.

I'm also curious how many years ago she allegedly obtained prescriptions for a controlled substance from more than one doctor. The prescription drug monitoring program has been around for a long time. Most states use an electronic data base that tracks prescriptions. It makes it very difficult for patients to fill more than one script for the same drug.

As to my last question, I'm just asking if there is compelling evidence that Heidi collapsed from a fentanyl overdose. If the source is not credible I assume the answer is no? If she was seen walking the dog at 6:20 pm and the dog was found inside at 7:00 pm, then whatever happened must have occurred within a 40 minute period.

If she was planning on going to a party in the building, why bring her dog? Did she bring the dog to the game?
Accusations during a divorce mean diddly squat.
California has had electronic prescription drug monitoring since 2007, even veterinarians must report prescribed scheduled drugs for animals.
There are also requirements that prescribers regularly test patients blood levels of prescribed scheduled drugs along with testing for illicit drugs.
Her husband never had access to that information.
If she were abusing drugs she wouldn’t continue to be prescribed adderall.

Controlled Substance Utilization Review and Evaluation System

CURES (Controlled Substance Utilization Review and Evaluation System) is a database of Schedule II, Schedule III, Schedule IV and Schedule V controlled substance prescriptions dispensed in California serving the public health, regulatory oversight agencies, and law enforcement. CURES is committed to the reduction of prescription drug abuse and diversion without affecting legitimate medical practice or patient care.

The operation of CURES complies with all applicable federal and state privacy and security laws and regulations.
The controlled substances dispensation history of an individual that is received by a practitioner or pharmacist from CURES is subject to the Confidentiality of Medical Information Act and the Health Insurance Portability and Accountability Act of 1996 (HIPAA), including the HIPAA regulations in 45 Code of Federal Regulations parts 160 and 164.

Access to CURES is strictly limited. Licensed health care practitioners and licensed pharmacists may access information in CURES only for patients under their care. Regulatory agency officials and law enforcement officials may access information in CURES only to assist the efforts of their agencies to control the diversion and resultant abuse of controlled substances.

California Health & Safety Code Section 11165(d) requires dispensing pharmacies, clinics, or other dispensers of Schedule II, Schedule III, Schedule IV, and Schedule V controlled substances to provide specified dispensing information to the Department of Justice as soon as reasonably possible, but not more than one working day after the date a controlled substance is released to the patient or patient’s representative, in a format approved and accepted by the DOJ.

I agree it's much harder to get multiple prescriptions for drugs than it was in 2015. (2015 is when JW made those claims in a court filing. They were phrased as a current concern then.) Lots of things have changed since 2015. That doesn't mean the claims JW made in 2015 were true, of course. But it is harder to get drugs by doctor shopping today. That may lead some people to buy "off the street" who wouldn't have before. An unintended consequence of tighter prescription tracking.

HP did take the dog to the game. Some people have suggested the dog might have separation anxiety and can't ever be left alone. I guess that's possible but we really don't have any evidence of that. And if that's the case, what did she do with him while she worked? Did she have full-time dog care? Reliable dog sitters can be hard to find and dogs with separation anxiety usually aren't comforted by the presence of any old human. Also though, in my limited experience, dogs with separation anxiety often are generally anxious dogs. So they aren't necessarily great to take places like games with lots of cheering and arm/hand waving.

I guess if HP planned to be out until later in the evening, if she didn't have a doggie door at her house she might have taken the dog with her particularly if she had a dog sitter at the H&F. But we really don't have evidence of any of that either. At most, I think there have been multiple reports HP & her dog were known at the H&F. Those multiple reports could have originated from a single source though.
JMO
Thank you! Apparently I missed your post just before I asked about the prescriptions! So it was at least 6 years ago and we don't know if she continued to use after that.

If it was an issue in the custody case, I wonder if she was required by the courts to get treatment and/or agree to random drug screening?

Didn't her friend say she worked very hard for custody of her son?

About the dog, I guess if she had to leave it behind for work, she may have taken him everywhere else she was able to. IMO

Where is the office location that HP supposedly went to work every day? Her employer had 1 to 5 employees. This is not some big corporate structure or large corporation. I doubt she left her home for work. MOO

Yeah, they've been using electronic prescription drug monitoring where I live since at least 2008, so I thought it might be similar in California.

And yes, I'm wondering how he would have known about the prescriptions, unless she told him herself. Once there is an accusation like that, usually the court will order a drug test, and treatment if there is proof of drug abuse. Imo

She had her work laptop at home, so I agree that it’s likely she worked remotely.

Yes, I saw your earlier post about that. But some of the currently mandatory actions required by CURES weren't mandatory until 2018. After all, it wasn't even signed into federal law until December 2016.

CURES Usage Now Mandatory for Prescribing Controlled Substances - Simas & Associates LTD

It's unclear to me exactly what CA's law did on its own. The link you provided is from 2018 and talks about CA's prescription monitoring program being called CURES. I'm not sure what was required in CA starting in 2007 nor do I know if that legislation was strictly enforced.

So I don't think we have enough evidence to absolutely know whether GP could have obtained more than one Adderall prescription in 2015. Certainly saying "but it would have been illegal" isn't convincing proof to me that it didn't happen.

There is no proof that it did happen either.
It’s all rumor and speculation based on only one side of divorce accusations being released.

ETA: The federal CURES Act was modeled on the CA state CURES program.
It went electronic in 2007 but monitoring through triplicate paper prescriptions started long before electronic records.

History of Prescription Drug Monitoring Program

The First PDMP (1918)
The origin of PDMPs goes back to the early 20th century. In the early 1900’s, drugs such as heroin and cocaine were allowed by federal and state laws to be prescribed by doctors and dispensed in pharmacies. In 1918, New York State became concerned with a growing drug problem and passed sweeping drug legislation to address the crisis. One part of the laws required a doctor prescribing a certain quantity of heroin, cocaine, morphine, opium, or codeine to use “serially numbered official prescriptions blanks” issued by the state health department. A pharmacy was then required to send a copy of the prescription to the health department within 24 hours of dispensing the drug. These laws remained in effect for three (3) years until they were rescinded. Even though the program was eliminated, New York State had drawn the blueprint for what years later would become known as prescription drug monitoring programs.

Early PDMPs (1939-1989)
Established in 1939, California is the oldest continuously operated PDMP program in the country. The 1939 law placed the administration of the PDMP in a newly created Bureau of Narcotic Enforcement. It was followed by Hawaii (1943) which housed their program in the state Narcotic Enforcement agency. Eighteen years later Illinois (1961) established their program and was the first program to be housed within a Department of Health. In 1967, Idaho was the first to house the PDMP in a Board of Pharmacy
The 1970’s saw three (3) additional programs come into existence: Pennsylvania (1972) which was originally housed in the Attorney General’s Office and moved to the state health department in 2016; New York (1973); and Rhode Island (1978). In the 1980’s, two (2) additional programs were established: Texas (1981) and Michigan (1988).
During these first 50 years, all of the PDMPs had the same characteristics:
 A tool for the enforcement of drug laws;
 Collected prescription information only on Schedule II controlled substances;
 Required multi-copy (duplicate or triplicate) state issued prescription forms to prescribe and
dispense Schedule II medications; and
 Required sending prescription information to the state within 30 days from the time the drug
was dispensed.

I wasn't aware "Jw has made it clear Heidi was not abusing her meds." When did he do that? The only claim I've seen about her prescribed meds was from JW in an older court filing published by the DM.

"Wayne said his ex-wife was addicted to the amphetamine, Adderall. He claimed she would go to three different doctors so she could get three separate prescriptions, making sure she always paid for two of them in cash so her abuse wouldn't be discovered."

Missing mom Heidi Planck had history of psychotic breakdown | Daily Mail Online

That filing was from 2015. We don't know if it was true at the time. DM did not publish HP's 2015 response and we certainly don't know if what he claimed about HP & Adderall was true in 2021. But I've not seen JW discussing Heidi's current use of drugs. Maybe I just missed it? Anyone have a link handy?

Re: whether JW or JS should have reported HP missing sooner....

We don't really know anything about Heidi's day-to-day performance as an employee during the years she worked for JS's company. If she never missed work, or always called in on the rare occasions she wasn't going to come in, and if the company had strict expectations about workplace attendance (even during COVID), then I would think her employer might have been concerned. But if she wasn't quite that reliable (personally I suspect she may not have been) and the company wasn't so strict (personally I suspect it wasn't) then as her employer, I certainly wouldn't call LE about a work absence.

So far as JW goes, he had reason to suspect something was wrong pretty quickly. He said HP was usually in contact with him when he had BW. He said it was odd HP had stopped responding to BW's texts on Sunday, the 17th. And she had no more contact with BW after that. He said that had never happened before.

If I had been JW, I definitely would have acted sooner. I wouldn't necessarily have called the police though--- Adults are allowed to be out of contact and LE is busy. It was also possible LE might have located HP in an embarrassing or illegal situation.

If I were JW, I at least would have checked her house & if I didn't have a key (likely JW didn't) & BW didn't either (seems less unlikely-- he was days away from turning 11 at the time), I would have at least checked to see if her car was at her house. What if she was inside the house and had fallen & couldn't get up? I also would have checked with her friends.

It's not clear JW did anything before the 20th even though BW was freaking out. I know they were divorced and had had alot of conflict that played out in the legal system. But they had been co-parenting BW while separated/divorced (one way or the other) for over 8 years. So I'd expect action from JW long before I would JS. But it sounds like JW had his hands full filing court papers about BW's custody and pointing fingers at JS. He even seemed to think JS should have hired a private investigator to look for HP and should have offered a reward. I'm not sure anyone should expect that of an employer these days.

I thought I read that JW/BW asked a friend of HPs, with a key, to check on HP on Monday (18th), but friend stated HP wasn’t home and no car. Not sure why that didn’t trigger more intense looking/police calling. Or maybe it did. Maybe JS went over there b/c people were calling him asking him if he’d seen Heidi.

Well, it was stated in a 2015 court filing. So I'm not sure that's quite what we usually refer to as a "rumor" (although I do think it would be more fair to HP to show filings from her side too.) And we know according to Heidi's friends she had to work hard to gain shared custody. And we know she and JW didn't have shared custody until 2017.

The prescription control programs are well meant but in some cases probably have pushed some people to purchase street drugs. Certainly there have been cases of high-profile physicians in CA prescribing crazy stuff despite those programs. Somehow something's not working. So we can't really know what drugs, if any, HP was able to obtain from CA pharmacies in 2015.

Yes, the court settled the custody battle by awarding joint custody in 2017.

From your Daily Mail link:

The couple fought for years over who should have care of their son. Since 2017 they had joint custody.

But Wayne was granted full custody after his ex vanished. In court papers he said he needed to put his son into therapy 'because he is completely distraught at his mother's disappearance.'

Divorce accusations are not facts, repeating them as fact makes them rumors.

It's a fact that information is in the 2015 court filing. Of course the information may or may not be true. But being in a filing for child custody doesn't make it automatically untrue either.

It's also true that she and JW weren't awarded shared custody until 2017. And she had to fight for that according to her friend and BW's godmother.

Los Angeles mother's disappearance 'absolutely abnormal,' friend says

IMO, based on facts none of us can know if HP used Adderall (or any other psychoactive drug.) None of us can know if she used more Adderall than she should. And none of us can know if she used street versions of it or any other pharmaceutical.

Well yes, of course she had to fight those nasty accusations that the Daily Mail posted after her death but he still didn’t the win sole custody he was seeking, even with all that. Maybe seeing the other side would make that court decision more clear.
ETA: I agree about the adderall, we know nothing about her medical history as we are all protected from that information being shared.

Dropping in to see if there are any substantial updates. Apparently none posted here. Doing a Google search I can't really find if LE is even still conducting a search at the trash dump, let alone any status.

I would bet they are still searching. I know they have had a few bad weather days when they were unable to do anything, most likely. I am not sure if they would release a statement when they end their search, but I would think that media outlets are monitoring the situation well enough to know, and would likely report that. JMO

Heidi told jw she was leaving. Jw has made it clear Heidi was not abusing her meds. JW had told us they were concerned bit tried not to overthink it. Less than 3 days later when Heidi did not show up for her scheduled pick up, they went straight to the police. Tbh, he employer should have been concerned on Monday, before her ex was on Wednesday!
I have not read anywhere that she told him why she was leaving the game. Why did she leave, what did she tell him??
I didn't say anything about HP being addicted to Adderall, but I haven't read or heard JW saying that HP was not addicted to Adderall either. I have only seen one interview he's done. As far as when JW went to the police...is that before or after he went to the house and got her phones and laptop? I know he notified police about that, but had he already been in touch with them?
Was JW's reason for wanting full custody HP'S Adderall use?

I don't think it's everywhere because it's in fashion. I think it's used for economical reasons. It's much cheaper to cut drugs like heroin, oxycodone, etc, with fentanyl. The greed outweighs any concern for people overdosing and dying, apparently.

The problem is it is extremely potent and there's no way to regulate how much ends up in each pill. Many people have no idea there could be fentanyl in a pill they bought from a dealer or a friend, imo

I know Heidi's ex husband said she used to use prescription Adderall, but did he say she ever bought street pills?

Or is the only source that Heidi overdosed at a party from a woman on SM?

In reply to your queries, I cannot say for certain. But, I do believe that illegal drug users, rely heavily on drug dealers not being evil or ignorant. It'd require trust. Yes?

Over 30 people this past week were in hospitals for severe bleeding after smoking Spice.

Warning: New Synthetic ‘Spice’ Lands 35 in Hospital

Then, there's this from the link:

The outlet reports that the new outbreak comes after another outbreak a few years back, in which rat poison  was added to the illegal spice. Health officials are now warning anyone who bought spice to go to the nearest emergency room

It is possible that if our victim ingested a fatal drug in error. IOW, maybe her death was an accident and not homicide. That is, if it weren't for pastries delivered by the Muffin Man.

Heidi vanished on a Sunday, allegedly. Her boss dropped by on Thursday, correct? It was four days later, and after the MP report was filed on Wednesday, correct?

Excellent writeups, Watcher. You wrote:

Here's the issue I have with this. JW knew she left the game early, perhaps without so much as a goodbye. Proudly, BW texts Heidi about his complimentary football moves. Heidi does not respond to the one true love of her life, BW. She is silent. When JW knew BW was not receiving a reply, that should have been a huge waving Red Flag. Any further unanswered texts should have reinforced the warning.

What time was BWs first text to his mother on Sunday after his fb game? TIA
