LE doesn't "require" custody of a child to file a missing person report. They may request the legal parents be notified immediately, but anyone can file a missing person report. If someone is caring for a grandchild while the parents are on vacation and that child goes missing, no one is expected to sit around and wait for the parents to return before a report is filed. A missing child is a missing child. In this case, I believe there were "hints" about Dylan being a runaway, not a missing child. Elaine was certain that Dylan wouldn't run away so LE acted on her sense of urgency. If MR exhibited any urgency about the situation, the Marshal's office would have contacted the Sheriff's office and a report would have been made. He didn't.
