Again, that is from the affidavit and not the preliminary hearing. At the preliminary hearing, the testimony from Agent Slater specifically stated KK told him PF told her that the murder was in the back room. No mention of the baby being in the playpen.

See item #66. It was not introduced at the preliminary hearing.

denoting an action or event preceding or done in preparation for something fuller or more important.

The most recent trial I followed was the McStay Family trial.

I watched and took detailed notes of the preliminary hearing. Much of what I heard at the preliminary had to be thrown out once the trial began.

Many 'facts' changed, some of the detectives testimony changed, as new information came forward.

That is why it is called 'preliminary'.

Hmmmm, KB's brother would hopefully have the same mitochondrial DNA as her, since they are from the same mother. That would be 50% of the sample. Little KF would definitely have it, since KB is her mother. I have some experience in genealogical matters, so that's kind of a rule that I go by, but IMO

I think she was worried about a couple of things.

The burning of the tote in the yard. I don't think she wanted to answer any questions about backyard bonfires.

What time PF and the baby arrived for Thanksgiving dinner. I don't think she wanted to nail that time down, exactly.

How long she had her grandchild in her care after Thanksgiving and if she thought it was strange they were not doing their usual custody schedule.

With that^^^ would come questions about KB, and what PF would say about her communication about the child that few weeks.


I do not think SF wants to answer any questions if she can avoid it.

I’m now wondering if PF decided to go with the baseball bat scenario to make it look like a robbery gone wrong, but then decided against that because that would leave her body and the possibility of his DNA on her?
I agree it would have been much smarter to make it look as though she left or committed suicide, but I think we all agree he’s lacking in the smarts department.
I also think he was raging at this point because he couldn’t get KK to actually seal the deal and made it as violent as possible so that KK would have to get her hands dirty. My opinion of course!

Maybe since you were not following at the time you didn't notice that it was soon corrected to the living room. The child was in the back room. The murder took place in the living room.

The blog was never corrected, but the information was.

In this case, the preliminary hearing consisted of testimony by CBI agent Slater about what KK told him in their interviews. I think KK's taped interviews with Agent Slater will be in evidence at trial.

Had it changed, it would have been a huge deal. But it didn’t, and we got a much clearer picture of what that living room looked like in the preliminary hearing.
