And how does a defense attorney look at such a killer and say “Well, I’ll do my best to help get you off.”
Sorry, but I’m generally not a fan of most defense attorneys. I know they are there to protect the rights of the defendant. But I feel many operate less by “providing the best defense under the law” than “I want to win my case. Period.” I don’t like the tactics many defense attorneys employ. Providing a fair defense doesn’t mean getting your client off. /rant
ugh oh
the time has come!
A colleague of mine and I were close . Her husband (loved him) is a prominent judge here. We all went out. What follows is sadly, the truth about justice in our contry
I am not good with shift keys and quote marks so bear with me
here is how it really works
Perry Mason (!) gives the idea that all are adversaries (prosecutors, judges, defense attorneys) nothing could be more untrue!
They are dear friends, there kids know each others kids . The travel together (a fondness for cruising all the kids!)
here is how it works!
Happy hour after we all got out of the office
A couple from our office a couple from her husbands office get together
here we go
initial meet great get seated
superficial talk first round
then justice begins!
d is the defense attorney for Chris!
p is the prosecutor handling prosecuting Chris !
j is the judge in chris case
second round of cocktails arrive
(we have to make it a case that is far along tho!)
and so it begins
d says to p (for chris case!) Ill give you 30 years in jail with no death penalty
everyone leans their heads back chuckle and take a sip of their cocktail
p responds what am i gonna do with you d - you know i am not taking that
heads go back another chuckle and a sip
d says back ok i will give you 40
another p at the table chimes in
your being stupid you know there is no way that is happening
heads go back chuckle another sip
another p at the table chimes you to d attorney
your sitting in front of bob you guys know he will throw you out of his court if you two try that BS
another chuckles
All the judges, prosecutors def attorneys know what crimes judges are hard on what they are lentiant they all work with each other for days
they all know much of nothing has anything to do with the case . It depends on who the judge is. The whole game - starts with that
They all also know which def attorney will take folks to trial which will want to plea it out
everyone in the game knows all this
none of it has anything to do with guilt or innocence
its really like a locker room
a touchdown is:
for def attornees =not guilty or plea
for prosecutors = guilty or no contest
for judges - fastest way to clear out their docket
back to dinner
p i will give you life without parole
d death penalty off the table
p i will have to talk with rick but i think i can get him to accept that
another def attorney at the table chimes in bob (the judge!) will probably be fine with that
d ok i will take it back to client and will you give me call next week and let me know if you guys will accept this
p sure well all talk next week
next case pls.................................
