A federal grand jury in Georgia has charged three men with hate crimes and the attempted kidnapping of Ahmaud Arbery. Two of the men were also charged with separate counts of using firearms during that crime of violence.

As with all cases, until jury instructions come out.... but for myself, I think these three are POSTER BOYS for hate criminals... back in the 40's and 50's. They absolutely are the type that need to be locked up to protect society as a whole. They may "find -od" in jail, but they probably already claim they are "-od fearing men". Ptttt, if I was a spitting woman I would spit at their feet. I cannot fathom that these types exist in 2021, yet disgustingly, I know that they do. And I doubt they will change. MOO

So glad that they have hate crimes now added, and saw on David Muir last night that until AFTER this case, that there were no hate crime laws in Georgia (they now have) and that citizens arrests were ok (they no longer have after this case). MOO, as no link to the show.

Travis McMichael, Greg McMichael and William “Roddie” Bryan, all facing felony murder charges in Arbery’s death, will appear virtually before a judge in May to discuss several motions filed by defense attorneys.

Among the motions to be discussed include calls to disqualify the prosecutor and introducing evidence that defense attorneys say shows Arbery used jogging as a cover to commit crimes. Family and friends say Arbery often jogged as a form of therapy.

Defense attorneys want to exclude all jail calls from trial—calls in which Greg McMichael called the shooting a "good deed"—and produce all potentially exculpatory evidence in the case.

The hearing is scheduled for May 12 and May 13 starting at 10:00 a.m. in the Glynn County Courthouse.

A trial date has not been set, although the Georgia Supreme Court announced this month that jury trials can resume.

No way a judge will allow in "evidence" that AA used jogging as a "cover to commit crimes."

1. There isn't *any* evidence AA stole anything from English's construction site, or from any other property in that neighborhood.

2. It's irrelevant to the charges against any and all 3 defendants even if there *is* evidence of some kind that AA *did* steal something on some other day from some other place while he was out jogging. All 3 defendants acknowledge they didn't even know AA's name before they killed him, much less anything about him, much less any alleged prior criminal activity.

3. The judge who sat on the PC hearings ruled against allowing in any "bad character" evidence about AA. Especially given that all 3 are now facing (well deserved) federal hate crime charges, imo there's no better than snow ball chances in h'ell that judge or any other will permit the defense to brazenly & gratuitously smear AA's character.

(BTW, I believe the prosecutor being challenged has already left the case).

Every single charge brought against them is righteous and just. I hope they all spend a long, long time in prison.

The lead prosecutor in the Ahmaud Arbery murder case is leaving the Cobb County District Attorney’s Office, [URL='https://www.ajc.com/neighborhoods/cobb/lead-prosecutor-in-arbery-case-leaving-cobb-county-das-office/3JYCXV4MDFAALGDN5OLPEBPL2Y/']the Atlanta Journal-Constitution reported Monday.

It wasn’t immediately clear why Jesse Evans was leaving the office.

AJC reported that Linda Dunikoski will now take over. She has been working on the case with Evans.

SAVANNAH, Ga. - A day before Ahmaud Arbery’s birthday, a judge decided on a trial date for three white men charged with killing the Black jogger.

Superior Court Judge Timothy Walmsley issued a notice Friday stating jury selection will begin Oct. 18.

The perpetrators: 1. Shouldn't have tried to play police. Active Law enforcement are trained to deal with these situations. 2. Dont jump out with a gun. Had he been an actual criminal with a weapon at that point you would be challenging him to a gun fight. Travis or his father could have ended up getting killed had it been an armed thief.

The mother of a Black man pursued and killed by white men who said they suspected him of a crime says she is “thankful, very thankful” that Georgia has repealed its Civil War-era citizen’s arrest law.

Wanda Cooper-Jones, the mother of Ahmaud Arbery, spoke Monday after Gov. Brian Kemp signed House Bill 479, which says bystanders can no longer make an arrest in Georgia if a crime is committed in their presence.

“I think the signing of this bill will make people think before they take action into their own hands,” Cooper-Jones said. “Unfortunately we had to lose my son in this manner. Had this bill been in place, I think it will protect young men as they are jogging down the street.”

“This bill makes Georgia the first state in the country to repeal its citizen's arrest statue,” Kemp, a Republican, said before signing the measure. “Today we are replacing this Civil War-era law, ripe for abuse, with language that balances the sacred right of self-defense of person and property with our shared responsibility to root out injustice and set our state on a better path forward.”

Those who had long pushed for the repeal said the law was approved in 1863 to round up escaped slaves and was later used to justify the lynching of African Americans. Some other states are now also considering repealing such laws.

Under the repeal bill, people who are mere bystanders or witnesses generally no longer have the right to detain people. Deadly force can't be used to detain someone unless it’s in self-protection, protecting a home, or preventing a forcible felony. The changes retain Georgia’s “stand your ground” law, which says a person who is being threatened isn’t required to retreat.

It still allows business employees to detain people they believe stole something, and lets restaurant employees detain people who try to leave without paying for a meal. It also lets licensed security guards and private detectives detain people.

Arraignments before U.S. Magistrate Judge Benjamin Cheesbro were set for Tuesday afternoon as federal prosecutors moved ahead with their case, even with state murder charges still pending against the same defendants. A Georgia judge has set a trial in the state's case for October and will hear pretrial motions later this week.

Walmsley must decide whether the trial jury should be allowed to hear unflattering evidence of Arbery's prior run-ins with law enforcement as well as racist text messages and social media posts made or shared by the men who chased and killed him.

Defense attorneys for the McMichaels want the jury to know about 10 incidents from Arbery's past, including that he was on probation at the time he was killed. Court records show Arbery had pleaded guilty to charges that he carried a gun onto a high school campus in 2013, a year after he graduated, as well as a shoplifting charge for stealing a TV from a Walmart store in 2017.

Prosecutors say Arbery's past is irrelevant considering none of the defendants knew him prior to the fatal chase or were aware of any of his past troubles.

"The only purpose for placing the 'other acts' of Mr. Arbery before a jury is to smear the character of Mr. Arbery and suggest that his murder was deserved," prosecutors wrote in a court filing.
Meanwhile, prosecutors have asked the judge to allow jurors to see text messages and social media posts that they contend show a lack of "racial goodwill" by all three defendants. They include a text message exchange from 2019 in which Travis McMichael twice uses a racist slur for Black people.

Three defendants in the Ahmaud Arbery case are now having their first appearance in Federal Court on hate crimes and attempted kidnapping charges. Each man has asked for an appointed attorney (different from their defense attorneys in the murder trial)

U.S. Magistrate Cheesbro outlined the five hate crimes and civil rights charges, including that the defendants "did willfully, by force and threat of force, injure, intimidate, and interfere with Ahmaud Arbery, an African American man, because of his race and color"

Possible sentencing options are being read now in Federal Court.

Travis and Gregory McMichael face up to life in prison. Both McMichaels have just pleaded not guilty to all charges.

The federal prosecutors say they are prepared to turn over 1 terabyte of discovery (evidence) to defendants' legal teams within the next week, along with the entire GBI case file including video, audio, recordings, social media, surveillance, texts, etc.)

The defendants have previously been denied bond in the state's murder case so they will not get bond in the federal hate crimes case.
They are being returned to state custody now.

I just spoke to Ahmaud Arbery's aunt. I asked her what she would say to the McMichaels if she had a chance. Her response: “I would ask them why? Why didn’t you just let him run, and call the police?”

I’m pleased to read the citizen arrest law has been repealed and the killers are being charged federally with hate crimes. It’s sad that we have to have laws against hate but, since we do, I’m glad they’re being charged under them. The more they can find to charge these three, the less likely they’ll escape punishment.

When asked why Bryan joined the chase, Gough argued that any American would have done the same.

'Any patriotic American under the same circumstances would have done the exactly the same thing,' Gough said.

'I think one could reasonably take the position that Roddie Bryan is a political prisoner in this case. He should not be in jail right now... he should be out on bail,' he said.
