This ridiculous motion to the court from Roddie Bryan's defense attorney sounded like a joke. I stopped laughing when I realized that I just got a"glimpse" of how bad the victim blaming will be in every trial. I trust that the judge will deny this motion and exclude this theory from trial.

"Kevin Gough, Bryan’s attorney, said when the McMichaels and Bryan were chasing Arbery in their trucks, Arbery tried to enter Bryan’s pickup.

This could have been attempted motor vehicle theft, carjacking or an assault, Gough said. Arbery may have been trying “to beat him up and throw him in the woods,” he said. “Mr. Arbery was intending to commit a felony.”

The judge will likely make it very clear that he will not abide any victim blaming like this at trial. They don’t have much of a defense so they’re trying to get the idea of the victim being a criminal into the heads of potential jurors. I wish the judge would issue a gag order. As much as I hate the thought of muzzling attorneys, they’re not going to stop with this.

@sds71 - when you get a chance - was wondering if the State case had another hearing scheduled?

And can you access the Federal case? Wondering about that one too.

TIA!

The judge agreed to the defense's request for an extension and will schedule another status hearing in 30 to 60 days. There wasn't a hate crime law in Georgia when Arbery was killed. Since his death, a hate crime law has been passed.

“When we get some justice, it will ease the pain a little, but it will never go away because we won't see him anymore," Arbery Sr. said.

This federal case coincides with the state's murder case against the three men. That trial is set for October 2021.

Sorry to bother you again - but is this for the State or Federal case? And I'm going to "assume" this is for all of them.

TIA! :)

A federal judge has scheduled a trial in early 2022 for three Georgia men charged with hate crimes in the killing of Ahmaud Arbery.
On Tuesday, U.S. District Court Judge Lisa Godbey Wood issued a written order saying jury selection in the case will begin Feb. 7 at 9 a.m. at the federal courthouse in Brunswick.

Judge: Arbery’s imperfect past can’t be used by defense at trial

In a separate ruling also issued Monday, Walmsley allowed prosecutors and defense attorneys to question Larry English, who owns the Satilla Shores home that was under construction and which Arbery entered the day he died.

In a court motion, defense attorneys, joined by the prosecution, told Walmsley that English’s poor health and compromised immune system may not allow him to take the stand at trial. Walmsley said he will preside over the questioning at a Sept. 15 hearing closed to the public that will be captured on video and played to the jury at trial.

About time.
These people ruin law enforcement.
The underlying belief nothing would really happen to them no matter what they did, made them act the way they did.

Justice for Ahmaud!!!!! The wheels are moving too slow but I am appreciative that they are moving in the right direction.

A former Georgia district attorney was indicted Thursday by a grand jury, which said she showed preference to the men accused of killing Ahmaud Arbery last year.

The former prosecutor, Jacquelyn Lee Johnson, was indicted on charges of violation of oath of public officer and obstruction of a police officer, Georgia Attorney General Chris Carr announced. Johnson was the Brunswick Judicial Circuit district attorney when Arbery, 25, a Black man, was shot in February 2020. Johnson ultimately lost re-election in November.

Arbery was shot and killed on Feb. 23 after Gregory McMichael, 64, and Travis McMichael, 34, his son, followed him in their pickup truck. Arbery’s family has said he was out jogging, while the McMichaels, who are white, said they believed he was a burglar.
