when dad came in all excited you didn't tell him to calm down did you? No. totality of the circumstances knowing he was continuing to break into this house with there having been thefts from this house, led me to believe something has happened down there.

You had no idea what had happened thought? correct.

You tell detectives your father had suffered a couple of heart attacks hip replacement and a stroke. So you decided to grab your gun and go with your father to confront this man?

TM I was going to go investigate what's going on.

[Boy TM really is quite the neighborhood gumshoe isn't he? JMO]
Why does he think that he has the right to 'investigate' anything?

pretty sure he comes by it honest via his father. Monkey see monkey do.

So wait. TM was TRAINED in how to keep someone from getting his gun? And he TRAINED other people how to do it? But he chose to shoot instead of try to get AA off the weapon? Is that what he said?

That’s what I wish she would ask him about.
Why do you think you have to investigate?
Why do you seek out these situations?
Are you an investigator?
Why are you under the impression that people owe you their time of the day?
Do you feel like you’re entitled to an explanation when you confront people about things that are none of your business?
Why don’t you leave the investigating to actual investigators??

So When LB asked him about the purse being stolen, again, it was from an unlocked car. It happened over the summer, but he thought it happened in January when she posted about it. His response to her on Facebook was "playing with fire on this side of the neighborhood." What in the world is that supposed to mean? Sounds vigilanty to me, and he doesn't even pay attention that it happened about 6 months prior, but he investigates it?

What the hell?

Next, it seems to be TM's insistence that AA "kept coming back and stealing" from the construction house.

He was a mechanic in the CG who got off on the tidbits of his training & job that related to guns & playing cop. Greg is ex-LE who couldn't be bothered to keep up with his training & had his cop car taken away from him. After that he was a detective who was off the street, behind a desk investigating minor crimes.

It's chicken & egg which came first for both, imo: whether they sought out jobs that gave them the power over others they seem to feel entitled to, or whether they felt entitled to retain & exercise power they had once been entrusted with but wielded so poorly.

Why did TM say he called a "co-worker" about the carjacking incident he went through? She asked if he'd reported it to LE and that was his response. TM worked for the police during that time?

That situation with that homeless man really shows the character of TM and his father. They go down under a bridge where a man is fishing with a machete by him, and they are armed with guns. But they are "scared" of this man's machete.

Do they NOT realize that they are walking upon a man minding his OWN business who might see two men approaching him under a bridge as a threat? If he'd grabbed that machete upon seeing them, they would have shot him and thought it was self-defense because they didn't "know" if he'd use the machete.

These guys are real pieces of work to keep putting themselves in danger and then expecting other people to just comply with them. Who do they think they are? And when the prosecutor asks if they took it upon themselves to investigate first before calling the police, TM says "Yeah," like that's a normal thing to do. Then after they "investigate," they STILL call the police on the guy! Who isn't doing anything.

TM testified that he pursued AA in order to ID him. So where does all this citizen's arrest stuff come in? Why does TM have the right to chase AA to ID him?

Why should AA stop and allow TM to ID him? Whether AA was committing a crime or not -- what law says someone innocent or in the commission of a crime must stop for a citizen to ID them? Isn't that a violation of AA 6th amendment right?

TM testifies that he doesn't know what happened, and he doesn't know if someone got hurt. So why not go back the way AA came from and see if someone is hurt? Someone could be dying while TM is chasing AA, right?

He also wants to have it both ways. He wants to say he chased AA because he was the guy, but then he is chasing to ID him. He says on the one hand he thought his dad called the police and then he says on a transcript that AFTER he IDed AA, he told his dad to call the cops.

Well, if you IDed him as you say on the transcript, stop chasing him!

It's not placing much faith in this jury to believe their deliberations or verdicts could or will be influenced by who sat in the courtroom during trial.

I have no confidence in this jury. If the judge has to instruct them to keep each other awake (as was posted upthread), I don't see how they can be trustworthy or effective. It's a travesty, really. all jmo

I was a little disappointed with the cross, I thought some issues could’ve been pressed more, and he should’ve been corrected every time he said “break in” etc. Also he was allowed to over explain tooooooo much. But idk, I’m not an attorney.

I’m sure Ms. Dunikoski is exhausted. I’m just hoping that when she gets home, she keeps thinking about all the wet rubbish that was coming out of TM’s mouth and seethes at the thought of that guy getting away with entering the McMichael’s fan fiction™ as testimony, wakes up reinvigorated and vows to bite his head off on the stand. Metaphorically.

I think she’s saving that for tomorrow when she has more time to grill him .

the scatterbrained defense
I wonder if anyone is keeping track of TM’s inconsistencies in his statements and different from the video? If I was a juror that’s one thing I would do .
