I really like how she breaks everything down on a level that non-lawyers will understand. It's very conversational.

She really knows how to communicate to a jury --- she talks at a level she believes they can understand---

Ms Linda's closing statement so far is sounding really good. I can imagine the jurors noting her concise statements. Wishing for a fair verdict.

Good morning! They're convened in the #AhmaudArbery shooting case. Judge Walmsley is going over the final jury charges with attorneys. Remember, Friday, the judge was set to tell jurors citizen's arrests must happen at/immediately after the time of the alleged crime.

Bob Rubin said then the judge had "gutted" their case, as they've built it on probable cause & arguing the McMichaels had the right to chase #AhmaudArbery. This jury charge would say the arrest must be at the alleged misdemeanor or in a subsequent chase if it's a felony

Kevin Gough says he's made a motion to sever his case, as evidence developed during Travis McMichael's testimony has made Roddie Bryan's defense antagonistic, along with the "vigilante" evidence presented against McMichael.

State argues there's no sufficient prejudice alleged in any of Gough's motion's points. ADA Ollivierre says she can cite case law if needed. Judge says the motion's untimely & most of this has been addressed previously, but he wants to hear from the State

ADA Larissa Ollivierre is arguing against Gough's motion to sever Roddie Bryan's case from that of the McMichaels.

Leigh McMichael's in court with a woman she calls a former coworker/friend, and a man. #AhmaudArbery's mom Wanda Cooper-Jones walked in during the talk about Kevin Gough's motion for severance. A pool reporter says she seemed upset.

Attorney Lee Merritt is with Wanda Cooper-Jones. Bryan's fiancee Amy Elrod & another woman who's always refused to identify herself when she's in the courtroom are also in the row reserved for the defendants' supporters.

Gough says he's withdrawing the charge he submitted on "duty to inquire." He says, "I hope that will satisfy the McMichael defendants. I guess sometimes people don't want help." He laughs, sits.

Judge is removing the citizen's arrest "duty to inquire" from the draft jury charge. State says it's ready to proceed. Judge says, "Let's go get the panel." Jason Sheffield says after the State's done they'll need 10 minutes to set up without the jury present.

ADA Linda Dunikoski begins the State's closing argument. "All three of these defendants made assumptions about what was going on that day, and made their decision in their driveways to attack #AhmaudArbery because he was a Black man running down the street."

State: "Mr. #AhmaudArbery was under attack. They committed 4 felonies, and then they shot and killed him--not because he was a threat to them, but because he wouldn't stop and talk to them."

State: If you are the initial unjustified aggressor, you don't get to claim self-defense. If you're committing a felony against somebody, you don't get to claim self-defense. If you provoke someone so they attack you, you don't get to claim self-defense.

State: In order to make a citizen's arrest, the offense has to be committed in the private citizen's presence. Do we have that here? No.

State: We don't want to you to think we're not acknowledging what #AhmaudArbery was doing--going onto someone's private property, wandering around, then leave. On video, never took anything, never damaged anything.

State: Is #AhmaudArbery this giant burglar who happened to never showed up with a bag or means to steal, or is he a looky-loo? He shouldn't be in there, okay, but it's trespass. And on Feb 23 none of the defendants knew he'd been in there--and that's all he did that day

State: Their own words to the police prove they don't know what #AhmaudArbery's done, why he's out there running. No immediate knowledge. They have speculation because he's running down the street. Immediate knowledge is REQUIRED under citizen's arrest

They keep showing Travis McMichael and honestly I want to puke just looking at him. He is absolutely disgusting. What got me was when he said killing Mr. Arbery was so traumatic FOR HIM- Well, Mr. McMichael, it was a lot more traumatic for Mr. Arbery cause he is dead and you killed him.

Per GMA this morning: defense will get 2 hours each and prosecution will get 3 hours for closings, plus jury instructions.
So, the defense gets a total of six hours for closing? (2 hrs each)

State: This story is "completely made up for trial." Travis McMichael claims he was going to arrest #AhmaudArbery for a 2019 theft from Larry English's boat. But in 2 hours 45 minutes talking to police and a a written statement he NEVER said that on Feb 23 2020.

State: If you determine this was not a legal citizen's arrest, then they are not justified in ANY of the felonies against #AhmaudArbery.

State is talking about the defense witnesses. Annabelle Beasley waved at the McMichaels when she got off the stand: "Team McMichael." Sube Lawrence off on a boat with the Perezes after the #AhmaudArbery shooting: "Team McMichael."

Did Travis McMichael have motive to lie to you--to make up things he NEVER said b4, to claim he was CONFUSED on Feb 23? Convenient. "The most traumatic--I don't dispute it was probably the most traumatic experience of his life. How'd Mr. #AhmaudArbery's day go for him?"

State: Consider words, conduct, demeanor, motive, other circumstances. Look at each separately. My suggestion: Start at the bottom of the indictment--criminal attempt to commit a felony, false imprisonment--it's easier. Work up to murder.

What a MASTERFUL closing argument by that woman!! She's making it very easy to follow and understand, and knows her jury audience well. I think this will be used as a teaching tool for lawyers in training for many years to come. Yes, she's that good!

Yes, she is good and talks to the jurors as a social equals. I learned from last week's trial in WI that the prosecutor must come across as pleasant and sincere. I think Ms Linda displays both traits...Let's see how defense performs in this regard.

State: They're not law enforcement. No patrol car, no badges, legal authority. Chased #AhmaudArbery w/trucks. Travis McMichael said he was "pinned b/t the 2 trucks" & Greg McMichael said he was "trapped like a rat." The ultimate false imprisonment: He never left Holmes, did he.

State: The medical examiner told you you hit someone w/an F150 or Silverado intentionally you can hurt or kill them. Actual injury may not be seen to #AhmaudArbery from truck but you have to place that person in reasonable fear of violent injury. Very important. Did they? Yes.

State: Travis McMichael says, "I just pulled up next to him. I didn't startle him; he wasn't afraid." Do you believe any of that stuff? Look at the Night Owl video at how #AhmaudArbery tries to get away from him, how they speed after him, & know they put him in reasonable fear

State:...of bodily harm/injury from pickups. Count 6: Agg Assault on #AhmaudArbery with firearm--that 12-guage pump shotgun with 7 already in it. Two steps, pull the trigger, that's all you gotta do. Evidence is they attempted to cause violent injury by shooting him

State: Travis McMichael does this with the shotgun. This is the beginning of the aggravated assault. It continues as he steps away from truck and blocks the road. He says, putting distance b/t me & #AhmaudArbery. Was it putting distance or blocking the road. You decide.

State: He doesn't stay right there does he? We can't see this but we know he makes it around that car door, over here in front of his truck and moving forward closing the distance on #AhmaudArbery, intercepting him, and right here with that shotgun.

State: It wasn't at port arms, it was like this, and how fast does #AhmaudArbery come around that corner and boom--shoots him. That's one continuous aggravated assault ending in shotgun blast--right here. Like this. Got it across the wrist right in the torso. Turned like this.

State: For felony murder, we must prove defendant caused the death of another--check--by committing a felony--check. We've got 4 of them. We don't need to show malice. Need to show felony directly caused the death #AhmaudArbery

Yes! Even inviting them to think of her as "Linda," and to imagine having a conversation with her about things they're unsure of or even might disagree with. Making light fun of attorneys was also a nice touch. :)

Wow, that was one of the best closing arguments I have ever heard. I really like the phrase/ mental bookmark 'driveway decision.'

She made that great presentation in an hour and a half- keeping their attention and not losing them
