IMO, its a shame that there is no evidence to be presented, it sure seems obvious.
I don't know what was obvious. I am still perplexed by this prosecution. If there was any prosecutorial misconduct it very well could be for THESE prosecutors.

A Georgia judge has thrown out a felony case against former Brunswick Judicial Circuit District Attorney Jackie Johnson who was on trial accused of hindering the police investigation into the murder of Ahmaud Arbery.

He was the Black jogger chased and killed by three white men on Feb. 23, 2020 — but no arrests were made until more than two months later after video of the crime came out. The case was among those that sparked a national racial justice outcry that year.

Johnson was facing a felony charge of violating her oath of office. But Senior Judge John R. Turner agreed with her defense attorney that the indictment should be dismissed on a technical flaw.

Judge Turner offered sympathetic words to members of Arbery's family as he tossed out the case, saying he will never understand why Arbery's killers were not arrested sooner.
....
Leaving the courtroom, Arbery's mother, Wanda Cooper Jones said "the law is the law," according to the Atlanta Journal -Constitution. "But this was a win for us, because we got to find out what really went on." Initially Arbery's family was told he was killed in self-defense.

In a statement, Georgia Attorney General Chris Carr said his office had fought to ensure justice was served. "We stand by the case we presented, and we regret that the Jury won't get to decide."

What a miscarriage of justice! Her obfuscation and helping her friend Gregory the suspect was obvious. They should have been arrested immediately. She had a conflict of interest.

Can someone please tell me what exactly the DA did that warranted these charges? There were the allegations but I never heard anything that she actually did.

The allegations were that she hand picked the DA to replace her after she recused herself, selecting one she already knew because of prior conversations about the case would not move forward and charge her good friend and former employee Greg McMichael and his son Travis with teh murder they committed. She recused herself immediately but continued to engage in many cell phone conversations with Greg presumably about the case after her recusal.

I believe she did just as alleged and I believe that was very wrong. The judge appears to believe it too but had to dismiss because of a technicality.

On Wednesday, Turner ruled in favor of a defense motion that the state attorney general’s office attached the wrong oath to the indictment, rendering the felony charge invalid.

“Frankly, this is a decision I didn’t want to make,” Turner said. But he said he felt like the defense’s request to dismiss the felony charge “needs to be granted.”

"I am so thankful people have not forgotten what happened in February of 2020," she said.

The Run with Maud event has become a tradition, as Georgia lawmakers designated Feb. 23 as Ahmaud Arbery Day to honor his life and legacy.

As the run concluded, Jones expressed gratitude to those who continue to stand by her side.

I'm gonna be pretty pissed if there is a review of this case where the killers could get another trial.

  • #794
Wow, this one surprises me on the directed verdict. Speculating IMO…. but have to wonder if some or all evidence that could have been used was presented? Gathered? Assessed? Or has something else occurred? SMH. MOO

Even if the appeals judges had thrown out their hate-crime convictions, the trio faced no immediate reprieve from prison. That's because they're also serving life terms for murder after being convicted in a Georgia state court.

Thank God. They'll spend the rest of their lives in prison. I hope his family can rest now.

1/26/24 Update: The 11th Circuit U.S. Court of Appeals has scheduled oral arguments hearing in the case for 3/27/24 for all 3 men in Atlanta. Attorneys for Greg & Travis McMichael & William “Roddie” Bryan are asking the court to throw out hate crime convictions returned by a jury in coastal Brunswick in 2022.
3/27/24 Update: In legal briefs filed ahead of their appeals court arguments, lawyers for Greg McMichael & Bryan cited prosecutors’ use of more than two dozen social media posts & text messages, as well as witness testimony, that showed all three men using racist slurs or otherwise disparaging Black people. Bryan’s attorney, Pete Theodocion, said Bryan’s past racist statements inflamed the trial jury while failing to prove that Arbery was pursued because of his race. Instead, Arbery was chased because the three men mistakenly suspected he was a fleeing criminal, according to A.J. Balbo, Greg McMichael’s lawyer. In Travis McMichael’s appeal, attorney Amy Lee Copeland didn’t dispute the jury’s finding that he was motivated by racism. The social media evidence included a 2018 Facebook comment Travis McMichael made on a video of a Black man playing a prank on a white person. He used an expletive & a racial slur after he wrote: “I’d kill that .... .” Instead, Copeland based her appeal on legal technicalities. She said that prosecutors failed to prove the streets of the Satilla Shores subdivision where Arbery was killed were public roads, as stated in the indictment used to charge the men. If the U.S. appeals court overturns any of their federal convictions, both McMichaels & Bryan would remain in prison. All three are serving life sentences in Georgia state prisons for murder & have motions for new state trials pending before a judge.
3/27/24 Additional Update: One of the judges from the 11th U.S. Circuit Court of Appeals (Atlanta) sounded skeptical of the argument from defense attorneys. U.S. Circuit Judge Britt Grant said the trial evidence of racist intent behind Arbery's killing "seems pretty overwhelming to me." None of the videos showed Arbery stealing & police found no stolen property or weapons on his body. U.S. Circuit Judge Elizabeth "Lisa" Branch & District Court Judge Victoria Calvert also heard the arguments. The judges did not indicate how long they might take to rule.
11/14/25 Update: Re Appeal: A federal appeals court on Friday upheld the hate crime convictions of three white men who chased Ahmaud Arbery through their Georgia subdivision with pickup trucks before one of them killed the running Black man with a shotgun. A three-judge panel of the 11th U.S. Circuit Court of Appeals took well over a year to rule after attorneys for the defendants urged the judges in March 2024 to overturn the case, arguing the men's history of racist text messages & social media posts failed to prove they targeted Arbery because of his race. Even if the appeals judges had thrown out their hate-crime convictions, the trio faced no immediate reprieve from prison. That's because they're also serving life terms for murder after being convicted in a Georgia state court.
*State case - All found guilty. Judge's sentencing: Travis: Count 1: LWOP; 2-5 Vacated; Count 6: Merged with count 1; Count 7: 20 Years consecutive; Count 8: Merged with count 1; Count 9: 5 Years concurrent. (Life plus 20)
Greg: Count 2: LWOP; 2-5 Vacated; Count 6: Merged with count 2; Count 7: 20 years consecutive; Count 8: 5 years concurrent; Count 9: 5 Years Concurrent (Life Plus 20)
Bryan: Life with Parole on Count 3; Count 7: 10 years; Count 8: 5 Years concurrent; other counts were vacated. (Life with Parole after 30 years). Appeal motions hearing on 10/24/24.

Now I do have their motion for a new trial in the State case on a hearing on 10/24/24.

Here's my notes from that hearing:
10/24/24 Update: Attorneys for Greg McMichael, his son Travis McMichael & their former neighbor William “Roddie” Bryan are making a range of arguments for a new trial, from a tainted jury to ineffective counsel for one of the men [Bryan's attorney Rodney Zell]. Superior Court Judge Timothy Walmsley, who was the judge in their 2021 murder trial & handed down their sentences, has set aside up to two days to hear their legal motions. Judge Walmsley didn’t rule Thursday. Defense lawyers & prosecutors will have a month or more to file legal briefs summing up their arguments before the judge issues a decision. See articles on posts #730 & 732 page 37 for more info. .

@Seattle1 - you helped me back in December, 2024 - any updates on this motion yet? TIA! 1763200154475.gif
