I know JS refused to turn his cell phone over to police or even let them look at it in his presence, but do we know if LE subpeoned his cell phone records?

Although I'm sure a lot was learned about his hoax from the 2 brothers phones who fully cooperated with LE.

Anyone have any idea why JS refused to turnover his cell?

Maybe he also has high profile contacts on his phone that he was in contact with as soon as he had made his false accusations that he didn't want LE to know about.

Or even texts, and calls made BEFORE he even carried it out? Possible contacts before, and after who he wanted to be kept a secret from the police?

At first I did give JS every benefit that he was being truthful. I wanted to believe so badly he was telling the truth.

At that time, I couldnt imagine anyone making up these specific detailed claims when they had to know how dangerous it could have turned out, especially when he knew he had been given a national platform that went worldwide, more than anyone I can remember in recent memory.

But one thing I kept having major struggles with was his constant refusal to turnover his phone.

I don't think I can remember another 'victim' refusing to fully cooperate with LE in anyway they possibly could to find the suspects. So the benefit I had so wanted to give Jussie at first began eroding away, and it only got worse.

His interview with Robyn was bizarre. The way he talked, very relaxed. his mannerisms showed he wasn't someone who had suffered any recent trauma.

Imo. It was a very poor acting performance.

He had to pretend to know how it felt to go through something like this, and because he has no clue, it was an epic failure, and the reason it came across as odd, and unbelievable..

They wouldn't have subpoenaed the phone records, they would have obtained a warrant. That is very common, almost standard anymore. The CPD investigations seems to have been very thorough and it led them right to the two brothers, which in turn led them back to JS.

I have seen the police do the very same thing when they are key witnesses in any case.

It makes me wonder if they may have feared for the safety of the 2 brothers at the time

Good point about fearing for their safety, I never thought about that, but now, in light of what's coming out in the news, it seems a real possibility.

In MY opinion.

It is interesting that the FBI did not seem to be doing anything with this case. So probably why Tchen wanted it turned over to them. I suspect she and the FBI SAC in Chicago were “aquatinted.” But Tuesday we learned that that fbi now has the letter and gave it to the US Postal inspectors. Then this morning the President has ordered the DOJ and FBI to look into it. That circumvents the Chicago office of the FBI.

Morning Prairie!

I'm not worried about the pace the FBI is taking in the white powder threat letter involved.

I've learned years ago, no matter what case they do, they take much much longer than most expect. It's just the way they have always operated in all cases.

I think the investigation goes way beyond just the threat letter though.

JS also transmitted texts from his cell phone concerning the planning of his crime between himself, and his 2 coconspirators. That's a big Federal no no. We see this pivitol evidence entered in many trials.

That is also federal crimes or if he used the internet to communicate his plot like using any communication data system to send emails prertaining to his plan via the internet.

Also if the FBI agents have spoken with him as well, and he lied about anything at all to them, then that too is a federal offense.

One good thing this entire fiasco has done is shed sunshine on the Feds due to it being exposed high powered officials may have tried to interfere to get the Feds involved so it would turnout in JS favor by getting the case assigned to certain agents for that very reason.

Due to that becoming known now it has put pressure on the FBI to fairly investigate the case fully like any other, without any biases in JSs favor.

My contacts over at #CPD say they have no knowledge of an @FBIChicago investigation into SA Kim Foxx’s handling of #JussieSmollett case. That doesn’t mean it’s not happening.
That would not be surprising. If the DOJ is investigating this, which they now apparantly are, the FBI office in Chicago would NOT be a party to that since there would be obvious conflicts, since the local FBI has daily interaction with the States Attorney office. That investigation would be carried out by DOJ investigators and FBI from other offices.

How is this ok?

Thank you for this terrific post.

I agree with everything you said here.

And it brings this divisive issue back to some incredibly important points that the hasty and unorthodox way this case was finalized by the State's Attorney simply do not answer and show some significant deviation from standard procedure.

The phone, text, email, and other communication issues are in the realm of Federal crimes.

There should be full public disclosure of the records.

How is this ok?

State Attorney Kim Foxx said in a televised interview yesterday (3/27) that the case was handled just as any ordinary case would be.

So then, I think State Attorney Foxx should just give out her cell phone # to all arrested individuals and their families in this jurisdiction.

They should all get this same access to her and to highly connected attorneys like Tina Tchin

I can think of another case that involved a verbal agreement with the prosecutor:

https://www.litigationandtrial.com/2016/01/articles/attorney/cosby-non-prosecution-agreement/

Smollett is the next Cosby...and this would be a reason for getting rid of Foxx. Different from Cosby some of this went to court, but it seems rather shaky and I wonder if another SA came in, if they could then prosecute Smollett due to the lack of a written plea agreement. Smollett is certainly making the verbal agreement very questionable with him claiming he is innocent and threatening to sue CPD, which doesn't exactly sound like someone who took a plea.

IMO, it takes a special kind of crazy mental gymnastics to be able to herald Jussie Smollett as both a hero and a victim. It’s a type of brainwashed, propagandized condition that’s highly contagious to vulnerable minds.

“Oceania is at war with Eurasia.” Or maybe it’s eastasia. Who can keep track anymore?

I'm wondering if the Osundairo brothers are lining up the highest bidder to pay for their stories?
Any wagers?

Attorney for Osundairo brothers shocked by Smollett dropped charges

The brothers’ attorney Gloria Schmidt said her clients were telling the truth and were prepared to do so in court.

Schmidt said she was baffled by the decision to drop charges against Smollett.

“I was shocked. I couldn’t believe it,” Schmidt said. “For the State’s Attorney’s office to drop it completely, and not consult with the victim, and with the complaining witnesses, and the key witnesses in this case, I think is baffling.”

I believe the claim is that the brothers wore white makeup under their facemasks?

This is absurd

The only thing that is *clear* about this is that Jussie himself “identified” the Osundairo brothers as “white” men. Wearing MAGA hats. And yelling a phrase intended to slur an entire swath of the population due to a stereotype of political beliefs.

It won’t be long before we have word from the O brothers, or via their attorneys or statements, as to whether they wore “whiteface” beneath their ski masks when they staged the “attack” at Jussie’s direction. IMO. My guess is “no”. That would be smeary all over the mask, right? There would be physical evidence.
